APPROVAL of 401 Water Quality Certification

Dear Mr. Ames:
You have our approval to place fill material in 0.36 acres of waters for the purpose of multi-
family residential at The Pointe, as you described in your application dated 14 November 1994. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead ,with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.

Re: General 401 Water Quality Certification for The Pointe - Multi-Family
Residential Community
Dear John:
On behalf of Mr. Charles Ames of the Allegiance Group, Inc., I am requesting a
401 Water Quality Certification - NWP#26 to impact ±0.25 Acres of headwaters on
this ±24.5 Acre Multi-Family residential site in Charlotte.
The site is forested with young to mature mixed hardwood species such as Oak,
Red Maple, Sweet Gum, Tulip Poplar, Ironwood, Black Cherry and Red Cedar. Heavy
understory occurs in past clearings, in areas of Hurricane Hugo damage, and
along the clearing for the Sanitary Sewer Right of Way. The soils on the site
are Pacolet sandy loam (PaE) which occurs on side slopes adjacent to drainage-
ways and Cecil andy clay loam (CeB2) which occurs on broad smooth ridges. Both
are well drained soils. The site drains to a deeply incised and eroded inter-
mittent tributary of Sugar Creek (Water Classification - C), however the vege-
tation has stabilized the bank. The total area of Jurisdictional Waters on the
project site is ±0.36 Acres based on my site review and approximate width of the
channels. No seeps or perched wetland areas were identified on the site. The de-
velopment plans call for the area to be impacted by general site development and
to install stormwater detention areas as required.
I have informed my client that a formal application to the NC Division of Envi-
ronmental Management will be required if the development area changes and impacts
of 1/3 Acre or greater to headwaters are necessary.
