BOX 1890 WILMINGTON, NC 28402-1890 (919) 251-4511 DISTRICT ENGINEER, I/we would like to request of the Department of the Army a Nationwide 26 Permit to construct a farm pond approximately 2.5 acres in size. The purpose for the pond is recreation and livestock water. This site was previously evaluated in October 1991 by Jeff Richter for Mr. Tim McDonald (See Attached). Please refer to Action ID 199200070. The Soil Conservation Service and the Moore Soil and Water Conservation District have determined that approximately .75 acres of wetland will be impacted by this project. They have also provided me/us with information concerning my/our specific site. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 IN REPLY REFER TO October 23, 1991 Regulatory Branch Action ID. 199200070 Mr. Tim McDonald 900 Bethesda Road Aberdeen, North Carolina 28315 Dear Mr. McDonald: Reference your September 30, 1991, meeting with Mr. Jeff Richter of my staff concerning your proposed pond construction on a tributary of Big Juniper Creek, off S.R. 1229, between Carthage and Pinehurst in Moore County, North Carolina. During this meeting, Mr. Richter determined that your site is in the headwaters of the tributary. He also determined that there are wetlands subject to our regulatory jurisdiction, pursuant to Section 404 of the Clean Water Act, present on this property, and explained that the issuance of Department of the Army authorization must precede any placement of excavated or fill material within any wetlands on your property. Due to the presence of thick vegetation, an accurate delineation of wetlands was not possible at that time, although flags were put on either side of the wetlands just upstream of the proposed dam site on a cut-line. Based on information gathered from walking this cut-line, and a walk around the perimeter of the pond site, enclosed are copies of 2 Wetland Determination Forms, providing specific information obtained at stations on your property. The data on these forms supports the delineation of wetlands on your site. Mr. Richter suggested that you contact Mr. Jerry Hall of the Moore County Soil Conservation Service and request that he determine the proposed pool elevation. Using the elevation of wetland flags, a general idea of the amount of wetlands to be impacted by the proposed project can be determined. At that time, you should forward this information to Mr. Richter in order for him to determine whether this work can be authorized by our Nationwide Permit No. 26 (PDN). Our PDN process involves applications for work impacting between 1 and 10 acres of wetlands in headwaters. A 401 Water Quality Certification (401) must be applied for and received from the North Carolina Division of Environmental Management and submitted along with a copy of the application to this office to initiate our PDN review process.
