Dear Mr. Harrelson:
You have our approval to place fill material in 1.07 acres of wetlands or waters for the purpose of road
construction at Middle Sound Road near SR 1814, as you described in your application dated 12 August 1994.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps
of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. For this approval to be
valid, you must follow the conditions listed in the attached certification. An additional condition is that no
additional approval will be given for lot fill given access as a result of the Certification. Any lots with
jurisdictional wetlands shall have deed restrictions to prevent future wetland fill. In addition, you should get any
other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition
which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding
unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401 of the

PROJECT DESCRIPTION: The applicant proposes to fill 1.07 acres of pocosin type wetlands
for the construction of a residential street. The street will begin on Middle Sound Loop Road,
cross a 51.22 acre undeveloped tract of land and connect with the existing Stoneybrook
Subdivision. The stated purpose of the proposed road is to provide access to highground from
Middle Sound Loop Road and to connect to the existing Stoneybrook Subdivision. It appears
that access to highground is currently available from the Stoneybrook side of the proposed road.
The application states that the proposed road will follow a previously disturbed sanitary sewer
route. This sewer line was installed through wetlands, presumably 1.07 acres, however, the
application states that no Section 404 Permits have been previously requested on this property.
I can find no record of a 401 Certification for this sewer line in the Wilmington files. Jack
Stocks, RLS, who coordinated the sewer line project, stated the project was constructed 6-8
months ago and that Jeff Richter told him that the installation of the force main through wetlands
would not require a permit from the Corps (I am presently trying to contact Jeff concerning this
matter). Conversations with another consulting firm which originally delineated the 51.22 acre
tract which the proposed road crosses indicated that the 51.22 acre tract is approximately 80-
90% jurisdictional wetlands. I received a fax today from Chris Stephens (Landmark
Organization, Inc.) including a preliminary plan (appears to be very preliminary) for the "single
family residential development associated with this permit request".

In order for this Office to evaluate the cumulative impacts of such a project, it is
recommended that the applicant provide a site plan for the entire 51.22 acre tract including 404
boundaries and lot lines for any proposed future development plans. All fill in wetlands
requested for the entire 51.22 acres should be covered in one Certification request. If no
additional fill in wetlands will be required for subdivision development a statement indicating
this should be provided to DEM and the COE.
The project as proposed will require an Individual 441 Certification and a Public Notice.

The project as proposed will require a Stormwater Management Plan in accordance with
the Coastal Stormwater Rules.

Reference your application received August 11, 1994, for Department of
the Army (DA) authorization to discharge fill material into 1.07 acres of
jurisdictional wetlands above the headwaters of Howe Creek. The site is
located on the north side of Middle Sound Road, approximately 2,000 feet east
of State Road 1814, near Wilmington, New Hanover County, North Carolina. The
proposed fill is to create an access road through your property connecting to
Stoneybrook subdivision.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM) and, in the coastal area, a
consistency determination from the North Carolina Division of Coastal
Management (NCDCM). You should contact Mr. John Dorney, telephone (919) 733-
1786, regarding water quality certification, and Mr. Steve Benton, telephone
(919) 733-2293, regarding consistency determination. This nationwide permit
does not relieve you of the responsibility to obtain other required State or
local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
This verification will remain valid for the two years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification. If during the two years,
the nationwide permit authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced or are
under contract to commence, in reliance upon the nationwide permit, will
remain authorized. This is provided the activity is completed within twelve
months of the date of the nationwide permit's expiration, modification or
revocation.

PUBLIC NOTICE is hereby given that Landmark Corporation, North
Carolina, has applied to the North Carolina Division of
Environmental Management for a Water Quality Certification pursuant
to Section 401 of the Federal Clean Water Act and Environmental
Management Commission rules in 15A NCAC 2H .0500 and 15A NCAC 2B
.0109. The activity for which the certification is sought is to
fill 1.07 acres of wetlands to construct an extension of
