The Town of Spring Hope appreciates the opportunity to respond to NOV-2019-MV-0099 dated
July 10, 2019, for a frequency violation for Total Ammonia Nitrogen for the month of April 2019.
This response will provide additional information regarding the incident and it is our hope that
the additional information is sufficient and that the Division will decide not to pursue further
action. The Total Ammonia Nitrogen (N) (C0610) for the date pertaining to April 2019 was
absent due to the laxity of the operator. The COC to the lab was mismarked as NH03
(nitrate/nitrite) rather than NH3 (Ammonia).
Therefore, we request that as the Division considers these efforts when deciding on further
enforcement. The Town of Spring Hope has limited resources and we would much rather
dedicate these resources to addressing issues with the Utility infrastructure versus civil
penalties. If the Town of Spring Hope can be of any further assistance or additional information

A review of the April 2019 Discharge Monitoring Report (DMR) for the subject facility revealed the violation(s)

continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial
construction activities, then you may wish to consider applying for a Special Order by Consent (SOC).
