Dear Permittee:
The North Carolina Division of Water Resources conducted an inspection of the City of Lumberton RLAP on July
25, 2019, due to a complaint. This inspection was conducted to verify that the facility is operating in compliance
with the conditions and limitations specified in Non -discharge Permit No. WQ0000672. A summary of the findings
and comments noted during the inspection are provided in the enclosed copy of the inspection report.
The Complaint inspection was conducted by Division of Water Resources staff from the Fayetteville
Regional Office. The following violation(s) were noted during the inspection:
Violation 1:
Section I1, Performance Standards, 8 (Setbacks)
Setbacks for Class B land application shall be as follows:
Habitable residence or place of assembly under separate ownership or not to be maintained as part of the project site:
Vehicular Surface Applied 400 ft.
During the complaint investigation wastewater solids were found to have applied within the 400 ft. setback from habitable
Dwellings across Rennert Road. The solids application was as close as 150 ft.

Violation 2:
Attachment B — Approved Land Application Sites.
During the complaint investigation wastewater solids were found to have been applied to a field site not on the approved land
application sites list for permit WQ0000672 (Attachment B). The application site in question is part of the PWC Land
Application Program (WQ0000527).
In addition, the issues below must also be addressed:
Compliance Issue(s):
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law.
Mr. Michael Currie is the ORC for PWC. The City of Lumberton will need to provide Mr. Currie the following
information:
1. Site location.
2. Acreage applied on. (Actual measured acreage)
3. Gallons applied.
4. Lab analysis of material applied.
5. TCLP analysis.
Please provide a detailed explanation in writing within ten (10) business days after the receipt of this Notice, of
how
the above violations occurred and steps taken to ensure these violations will not be repeated. Please include in you
response the information provided to PWC. A review of your response will be considered along with any information
provided. If no response is received in this Office within the 10-day period, a civil penalty assessment
may be prepared.
