After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735 and 2671. This certification allows you to use Nationwide Permit Number 1.4 and 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. An additional conditions is that 0.3 acre area adjacent to and on a shelf within the stormwater pond must be restored to wetlands. Written DEM approval for a mitigation plan must be approved before construction begins. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Lund and Dorney: W11 The purpose of this letter is to request Nationwide Permits 14 ar?d 26 J:YfiT t?pi r SECTI Water Quality Certification for the project known as Beverly Crest: The project is located in Mecklenburg County north of Hwy 51, near its intersection with Hugh Forest Road, as shown on the enclosed plans and vicinity map. Fill in Waters of the US will be required to develop the site for a residential development, including roadways, a clubhouse and parking. It will necessary to impact a total of 0.62 acres of jurisdictional Waters of the US above headwaters for placement of the proposed facilities. Of the total acreage impacted, 0.03 acres will be impacted under NW 14, and 0.59 acres will be filled under NW 26. An additional 0.29 acres will be flooded for the creation of two lakes, but this acreage has not been included as a negative impact in the total acreage to be impacted. Because the proposed pond nearest Beverly Crest Blvd. is currently within an old existing farm pond whose dam was recently breached and is now serving as a sediment basin for construction of the road and because both areas currently contain water with no vegetation and will continue to do so after construction of this project so no adverse impact is occurring. Note that on the project plans, a small area of wetland adjacent to the proposed clubhouse has been counted as an area to be filled under NW 26, even though it is to be part of the proposed lake, and will actually be flooded. Beverly Crest Boulevard and the sewerline shown on the plans have been or will be constructed by others as part of other projects. Therefore, they have not been counted as impacts on this permit application, with one exception. The exception is an area along the sewerline which crosses a wetland; this area will be filled as part of the construction of the lake proposed in the southern portion of the project area. The wetland rated moderately high. Even though the applicant has requested only 0.6 acre, the wetland has already been partially filled by a roadway (Beverly Crest Blvd.). The road accounts for approximately 0.25 acre filled. A sanitary sewer has also impacted the wetland. Both the sanitary sewer and the road were constructed by another developer. 2. This office has discussed mitigation with the applicant's consultant, 5&EC, Inc., who has initially agreed to restore the wetland between the stormwater pond and Beverly C3-est. Boulevard. This would reduce the amount of permanently filled wetland to 0.3 acre for this pi.oject. and a total of approximately 0.6 acre, including the roadway.
