You have our approval to place fill material in 0.07 acres of wetlands or waters for
the purpose of lot fill at lot # 131, as you described in your application dated 31 April,
1994. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2733. This certification allows you to use
Nationwide Permit Number 18 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. In addition, you should get any other federal, state or
local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the Clean Water Act. If you have any questions, please telephone John

Dear Mr. Dorney:
In response to our telephone conversations over the past three weeks regarding the submittal of
a request, under Nationwide Permit #18, to fill 0.10 acres of wetlands associated with McDowell
Creek for Lot #131, we have carefully evaluated the minimum lot size required to site a single
family home on this lot. By adjusting the structure's location and minimizing the transition from
the foundation fill to the existing grade, we would be able to reduce the fill area to 0.07 acres,
leaving a 20+ foot area along the lot line which traverses wetlands (see attached figure).
Assuming this is satisfactory, we look forward to your concurrence with the Corps of Engineers'
issuance of a Nationwide Permit #18 authorization, which was issued May 25, 1994.
In regard to our Individual Permit application for a nature trail through wetlands of McDowell
Creek, the applicant continues to review the options available to avoid and/or minimize wetland
impacts. We are by this letter requesting an additional 60-day extension of the previously
requested 30-day extension to the response period noted in your letter; the 30-day extension
expires June 8, 1994. While there continue to be limited economically or logistically feasible
options for modifying the trail, we would like to make every effort to find an equitable and
reasonable modification of the proposed project to address the DEM's concerns. We anticipate
submittal of our response to your office by no later than August 8, 1994.

PROJECT NARRATIVE
The applicant proposes to provide for construction of a single-family residential subdivision on
168 acres adjacent to McDowell Creek in northern Mecklenburg County. Construction of all
units within the subdivision will require filling 0.10 acre of floodplain wetlands along the east
side of McDowell Creek. In addition to this impact to jurisdictional wetlands, the applicant
proposes to construct sewer lines (Action ID No. 199304305), fill a 0.83-acre isolated wetland
(Action ID No. 199304306), and construct a pit-gravel or similar nature trail in the floodplain,
including wetlands, of McDowell Creek. Authorization for the nature trail has been applied for
under separate Individual Permit Application procedures (Action ID No. 199304304).
The extent of jurisdictional wetlands was determined by the applicant's agent and reviewed in
the field and confirmed by a representative of the Corps of Engineers' Asheville field office
(Steve Lund) on November 16, 1992. Wetland vegetation is described in the attached Routine
On-site Determination Data Forms.
To minimize impacts to wetland, Lot #131 is the only lot to be partially located in wetlands of
the floodplain of McDowell Creek. Restricting construction to non-wetland areas reduces the
number of potential lots available for development, and substantially reduces the economic
benefits of using the property. This is done specifically in the interest of minimizing impacts
to wetlands of McDowell Creek.
As partial mitigation for impacts associated with filling the isolated wetland, the applicant
proposes to donate the McDowell Creek wetlands and floodplain area of the property to the
Mecklenburg County Park and Recreation Department for its Greenway Program.
The applicant's agent has met with the SHPO (represented by Susan Myers) and has reviewed
the SHPO records regarding presence of archaeological and/or historical resources. No cultural
resources are known to be present anywhere on the subject property, nor have any surveys to
determine the presence of such resources been performed.
The applicant's agent has reviewed the records of the U. S. Fish and Wildlife Service, as well
as met with Mike Schafale and reviewed the Natural Heritage Program records regarding
presence of listed threatened and/or endangered species of plants and/or animals, or those
proposed for listing. There are no records of such species occuring anywhere on the subject
property, nor have any surveys to determine the presence of such resources been performed.
Further, field review by the applicant's agent has not resulted in identification of any protected
species of plants or animals.
