The North Carolina State Ports Authority's request for a modification to Permit #47-87,
issued under the Coastal Area Management Act (CAMA) and the state dredge and fill law for
maintenance excavation at your property located on the Cape Fear River at the State Ports
Terminal has been reviewed by interested State and Federal agencies, several of which have
objected to your proposal. Specifically, your request was to change your authorized method of
dredging from "bucket and barge" to "scour jet."
We must apologize for the unusually long time that it has taken to process your request.
After circulating to the other agencies, it was necessary to review compliance by your
contractor, Almont Shipping Company, with the conditions of their permit for the scour jet
system. The system that you propose to use was authorized under CAMA/Dredge and Fill
Permit #20-88 issued to Almont Shipping for maintenance dredging at their facility on the Cape
Fear River. The permit was originally denied, but was subsequently issued by order of the
Coastal Resources Commission after they granted Almont a variance from their rules. The
variance was approved with conditions for monitoring that would provide information about the
impacts of this dredging method so that we could determine if it is acceptable to use in other
areas. We have found that the monitoring requirements of that permit have not yet been fulfilled.
We are currently working with Almont on this omission.
It is likely that your request to modify your permit to utilize Almont's system would be denied
on the same basis that Almont's was originally denied. However, you would also have the
opportunity to seek a variance to that denial. The purpose of this letter is to inform you of these
options before we make a final decision. If you would like to modify your request to propose
another method of dredging, or if you would like to pursue your request to utilize the scour jet
system, please notify this office of such at your earliest convenience. We will take prompt and

DEM has received your request for comment on the proposal by
NC State Ports Authority to use a scour jet to conduct
maintenance dredging at the Port facility in Wilmington. As the
1 March 1993 memo from James Gregson to myself states, Almont
Shipping was supposed to report turbidity data from the operation
of the scour jet before and after use of the jet and from top,
mid and bottom of the water column. This requirement was
apparently a condition of the CAMA Permit. These data on top,
mid and bottom water column water quality were never provided to
our knowledge. Therefore, I agree with Jim that DEM cannot make
a favorable recommendation on the environmental impact of this
device until all required data are provided. Therefore I
recommend that DCM do not approve the modification to the Port
Authority's permit until they or Almont Shipping provide all
required data to demonstrate the environmental impact of this
technology.

PROJECT DESCRIPTION: The NC State Ports Authority has requested
authorization to use Almont Shipping's barge mounted scour jet to
conduct maintenance dredging at the NC State Ports facility in
Wilmington. Use of the scour jet by Almont Shipping was
authorized under CAM.A Permit #20-88 after a variance decision by
the Coastal Resources Commission; and was modified in 1992 to
allow the use of a single barge mounted scour jet instead of a
fixed array scour jet.
A proposed monitoring program, based on an on-site meeting
with Preston Howard and Trish MacPherson, submitted by Henry Von
Oesen and Associates on June 21, 1988, stated that water column
turbidity samples (top, mid, and near bottom) would be collected
before during and after activation of the scour jets. The
monitoring plan also contained a proposal for benthic sampling at
four locations. This monitoring program was established per
condition (2) in CAMA Permit #20-88, issued on January 27, 1988.
Please find attached, our earlier comments dated December 5,
1991 on Almont's proposal to use a single barge mounted scour
jet. This Office still has not received the turbidity analysis
as mentioned in the attached letter from Almont to Preston Howard
dated January 28, 1991. The turbidity analysis referred to in
this letter does not appear to agree with the monitoring proposal
submitted by Henry Von Oesen and Associates and agreed to by this
Division, i.e., turbidity samples would be collected before
during and after dredging at top, mid-column and near bottom
depths.
This Office can not make favorable recommendations
concerning the proposed modification request until all monitoring
data as required by the CAMA Permit is collected, submitted to
this Division and reviewed by this Office.

Expansion of such a system, originally permitted under a
variance, should at the very least warrant a closer review of the
required monitoring program to allow the review agencies to
determine what, if any, environmental impacts have been
associated with this project and what, if any, changes should be
made in the monitoring program.

Regional Office File on the subject project. Should you have any

SUBJECT: Request to modify CAMA/Dredge & Fill Permit #47-87 to authorize use of the
"scour jet" method of depth maintenance
Attached you will find a request from the N. C. State Ports Authority (SPA) to modify
the above-referenced permit to allow use of the "scour jet" system now being used by Almont
Shipping. The letter of request from the SPA actually stated that Almont had solicited their
business. Because of the eventful history of Almont Shipping's current permit, I felt this request
may merit closer examination by the review agencies, as authorization of this request may set
a precedent of more widespread use of this technology.
To refresh your memory, the scour jet system is basically a series of water jets. Periodic
jets of water from this system presumably resuspend accumulated sediment back into the water
column and then currents remove the material from the site.
The original permit application from Almont Shipping was initially denied by our office,
but a permit was later issued by order of a variance from the Coastal Resources Commission.
The original proposal was to mount this stationary system on the face of their dock. The permit
was later modified to authorize Almont to mount this system on a barge to allow for movement
along their dock. Now it appears that there were other reasons to request a mobile system.
If the requested modification of the SPA's permit is approved, other facilities may follow
suit. In your review of this request, please consider the potential cumulative impacts that may
result from this decision, and whether specific before/after analyses should be required.

This represents a request by State Ports to utilize by contractual arrangements
the Barge Mounted Scour Jet array now permitted to Almont Shipping Company by
State Permit #20-88.
This particular methodology while still relatively untested in our area has come
to us with several reports of its dependability and relatively non-impacting nature.
Provided that all review agencies concur. I recommend that a minor
modification be issued to North Carolina State Ports Authority to utilize this
methodology.
A check for $50.00 was presented with the original request and was deposited
by our office. The record of this fact was obscured to me and thus the delay in
processing the request.

In accordance with reference above, it is requested that we be
authorized to conduct maintenance dredging by barge scour jet
system. This system is now being used at Almont Shipping Company
and authorized by their Permit Number 20-88. If authorized, this
maintenance would be performed at our facility by Almont Shipping
Company equipment and personnel. An illustration of their scour
jet barge and letter of solicitation to perform our maintenance is
enclosed. In addition, I am enclosing 2 sets of charts showing our
berth layout and depth survey along same. We are experiencing
shoaling along the berths in certain areas at the rate of 1 foot
per month. We assume the regulations and conditions stipulated in
Almont's permit would apply at our facility along with any others
you deem necessary.
In order to maintain our service to the ships that visit this
terminal, we look forward to your authorization.

We have reviewed Almont Shipping's request to modify the
existing CAMA Permit to include the use of a single barge mounted
scour jet. This moveable jet would allow concentration of
scouring activities in isolated areas when the need arises. Such
a proposal should reduce bottom disturbance. This Office has no
objections to the proposed amendment.
We have received and reviewed the report (The Benthic
Community in the Vicinity of Almont Shipping Company, January
1990) prepared by CZR, Incorporated, however we have not received
copies of the turbidity analysis certificates from oxford
Laboratories mentioned in the attached letter from Almont to
Preston Howard on January 28, 1991.
Additionally, in CAMA Permit #20-88 condition #4 states that
turbidity should not exceed 50 NTUs. This should actually be 25
NTUs.
If you have questions concerning this matter, please advise.

entitled "Benthic Community in the Vicinity of Almont Shipping
Co."
(3) Turbidity Analysis Certificates from Oxford Laboratories:
1. Before dredging December 17, 1990.
2. Before dredging January 2, 1991.
3. After dredging operation January 2, 1991.
Based on our review of this initial data, we note minimum environmental
impact. Our Scour Jet Dredging is an ongoing project and we are working

As you may remember, Almont Shipping Company was issued a CAMA and Dredge
and Fill Permit for maintenance dredging at their basin on the Northeast Cape
Fear River. The permit was issued after a variance decision by the Coastal
Resources Commission to allow them to use the scour jet dredging system
similar to that being used at Military Ocean Terminal, Sunny Point. To
refresh your memory of this project, I have attached copies of the original
application, plats, and permit, as well as correspondence concerning required
water quality monitoring.
Almont Shipping is now requesting a modification of their permit that
would allow them to affix a single mounted scour jet to a moveable barge,
allowing sweeps and concentration of water flow along the pier frontage
(proposal also attached). Also, permission for additional dredging is
requested.

In response to the meeting of September 10, 1991 we are submitting this
letter as Almont Shipping's official request for a modification
consideration and an extension on the current scour jet system, "permit
#20-88," which expires December, 1991.
As discussed, the present permit allows for a static scour jet system
with multiple water heads. Almont's proposed and functioning
modification consists of a single mounted scour jet affixed to a moveable
barge allowing sweeps and concentration of water flow along the pier
frontage.
Changes were made to the original plan in order to provide better economy
and efficiency of use. As an example, should sounds indicate that only
one section of the pier frontage required maintenance, the proposed
system could be placed in position and concentrate on the location
pinpointed by the soundings. In so doing, less effort and less
disturbance to the bottom has taken place.
As always, a back up system may be required in the form of dredging and
Almont request this consideration as well.
Enclosed are renderings of the modification and should any further
information be required please do not hesitate to contact us.

Dear Mr. Hohnerlein:
Bruce Bolick related to me the context of the meetings with you; Dean
Morton, Vice President; and Bric Higgins, Operations Manager, of Almont Shipping
Company. We are very pleased that CZR can be of service to you in a timely and
responsive manner on this project, and hope we can serve you on future projects
as well.
On Monday morning (December 17), CZR biologists will establish the four
benthic sample stations designated (see attached sheet) adjacent to your docks
on the Northeast Cape Fear River and collect three replicate grab samples at each
sample station location. Samples will be collected with a standard Ponar grab.
Collected sediments will be sieved in the field (mesh size 0.5mm) and preserved.
Subsequently all organisms will be removed and later microscopically examined
in the laboratory, keyed to the smallest taxonomic category feasible, enumerated,
and tabulated. A tabulated list of organisms will be provided to you as soon
as it is available, as you requested, so you can discuss the initial findings
with the State.
While on-site for the benthic sampling, CZR will collect water column
samples (top, mid-depth, and near bottom) at each station in sample bottles
provided by Almont Shipping for subsequent analysis by Roger Oxford. Subsequent
turbidity samples during dredging will be taken by Almont Shipping.
Based on your planned discussion with the State on the data from the
initial samples, CZR will be prepared to conduct the benthic sampling (and
turbidity collection, if requested) at your direction after dredging is complete.
This work will be specified under a separate letter contract after you have
advised us of the State's response on numbers and locations of samples. Data
analysis and comparisons and report preparation will also be included in this
separate contract.
Attached is a list of estimated costs based on the work items and hourly
rates discussed with you and your staff on 10 and 14 December. CZR will proceed
with the work on a time-and-materials basis with an upset limit of
Personnel costs and actual expense costs will be invoiced monthly, and payment
is due upon receipt of invoice. If this arrangement is acceptable to you, your
endorsement below and return of one copy of the letter along with a retainer of

In accordance with our contract with Almont Shipping Company dated 14 December 1990, CM
Incorporated has completed collection, sieving, sorting, and identification of the benthic samples taken
during the 17 December 1990 field trip. Also during the field trip, the collection of water column
samples for turbidity analysis was conducted. Lists of the benthos collected and their densities have
been tabulated. Enclosed please find:
(1) Benthic species list
(2) Number of benthos per m'
(3) Map showing sampling locations
(4) Twelve lab data sheets
. To briefly summarize the data, it appears that both diversity and densities are low. This is not
surprising considering the Northeast Cape Fear River system and the type of substrate sampled.
The numbers reported on the lab sheet are raw numbers, Le. the number of organisms found
in one grab (area sampled = 81 in2). For reporting purposes, the numbers have been expanded to
numbers per m2. This standardization allows for reviewers to compare between sites.
After you have discussed these findings with the State, CZR is prepared to assist you in
sucessfully fulfilling their recommendations. We appreciate this opportunity to serve you and if we can

re-suspend sediment bedding on the floor of the Almont mooring
berth. The jet array is designed to alleviate the need for

Cape Fear River, classified SA.
The project has been reviewed to determine impacts to water
quality. The project will not require a 401 Water Quality
Certification. The project should not raise the turbidity levels
of the waters above 25 N.T.U.s.
This office has no objection to the project as proposed.

8. Project Summary Applicants propose to employ a scour-jet array to re-suspend
sediment layers along their existing ships berth.
9. PROJECT DESCRIPTION
The project site is located on the east bank of the Northeast Cape Fear River
in Wilmington. There is a shipping facility located on the site which receives
various products including chrome ore and numerous salt based products used by
several local industries. A tendency in this area for rapid bottom shoaling
results in the interference of off-loading operations at the facility. The
shoaling is most troublesome along the face of the existing dock. The existing
ships berth is approximately 600' x 100' x -33 mean low water (mlw). The
waters are classified as SC but are also a designated primary nursery area for
marine species. Yearly climatic conditions dictate the use of the general area
by these species.

One's first thoughts on the above operation is an anticipated adverse increase
in turbidity and siltation problems. However, based on personal conversations
with Corps personnel involved with a similar project at MOTSU the above concern
may be unfounded. Their information is that when the system was operated there
was no detected increase above existing background turbidity in the river. The
literature provided on the subject has all been of an engineering slant with no
biological interpretation or information. Due to the existing depths at which
the jets would operate, there may not be an over abundance of juvenile
organisms to be impacted. This of course would also depend on how far up in
the water column the re-suspended material would rise.

The Almont ship berth and loading facility dock has had a problem
of rapid shoaling for a number of years. The shoaling process begins
immediately following annual (or semi-annual) dredging cycles
with accumulations of between 2 to 4 feet of material deposits,
depending upon the frequency of dredging operations. This accumu-
lation of material can cause difficulties with ship berthing at
lower tide ranges when ships arrive at the dock drawing 33 or
more feet of water. Frequent dredging of the shoal materials
indicates that for the most part they are relatively light sand
and/or suspended silts with a high fluid consistency. Nevertheless,
after long-term accumulations these materials begin to consolidate,
thus interfering with ship berthing operations as mentioned above.
It is felt that the nature of the shoaling process, character
of the materials and relatively high ebb tide water velocities
all lend themselves to removal of these materials by scour jetting
to a degree that will either eliminate or greatly reduce the dredging
frequency and material volume, should occasional dredging be required.
The hard rock bottom underlying the general shoaling area also
compliments this proposed method.
The basic design and layout of the proposed scour jet dredging
system is based on successful studies and tests by the U. S. Navy
at Mare Island Naval Shipyard in California and at Kings Bay,
Georgia, and the U. S. Army Corps of Engineers installation of
a scour jet test system at Sunny Point Ocean Terminal near Southport,

North Carolina. These prior test installations have been highly
successful in maintaining constant ship berthing depths without
periodic dredging and have produced no reported operating or environ-
mental problems.
Preliminary Design Discussion
The basic principle of the scour jet system is to mount a
horizontal water jet nozzle close to the harbor or ship berth
bottom to agitate sediment in the water and thus prevent shoaling
from occurring. The materials put back in suspension in a moving
water body (river) rejoin the normal bed load materials moving
along with channel currents. The scour pattern achieved by a
jet of this type is tear drop in shape, approximately one-third
as wide as it is long. For a berthing facility, an array of nozzles
is generally placed along the pier face with a 10 percent overlap
of the scour patterns to insure that no intermediate shoaling
will occur. For the Almont dock the existing pier piles provide
a good point of support for the nozzles and are spaced at 20-foot
centers. Preliminary design sketches showing the overall project
concept and layout are appended to the permit application.
With this information and formulas obtained from previous
studies and tests by the Navy and Corps of Engineers, a preliminary
system was analyzed which would provide a minimum 66-foot scour
from the face of the pier. Each nozzle will be 4-inch diameter
and shall be provided with a flow of 2500 GPM. A total of 26
nozzles is used in the proposed system.
The piping system which feeds the nozzles in the preliminary
design consists of a 10-inch diameter PVC manifold suspended below
the pier deck with an 8-inch diameter PVC branch pipe with an

electronic controlled valve feeding each nozzle. A single 100
horsepower, 2500 GPM (110 THD) vertical turbine pump mounted on
a platform with its suction drawing water directly from the harbor,
supplies each nozzle individually. An electronic time controller
provides sequencing of the electric operated valves on a prepro-
grammed schedule. Previous test results indicate that each nozzle
with a single jet operating at a time, cyclinjg from north to
south with the south-moving ebb tide, should be operated for about
7 minutes at the peak falling tide as required. Thus, the single
jet cyclical operation would be completed in approximately 3 hours
during peak ebb flows along the face of the dock. The system
would be operated only during the period of peak ebb tide when
current velocities are high, thus moving the small amount of material
that would be placed in suspension along with the normal bed load
in transport in the river system.
Exact operating frequency requirements for the system cannot
be predetermined; however, it is proposed that the system be operated
initially on about a weekly basis. The annual shoaling rate at
the dock is well known (based on years of surveys and annual mainte-
nance dredging exercises). Based on this, it can be roughly esti-
mated that only 1 to 2 inches of materials would accumulate during
the one-week period (naturally, this could vary depending on seasonal
rainfall and flow conditions, but the accumulations would be minimal).
Therefore, it can be reasonably be estimated that only approximately
100 to a maximum of 400 cubic yards of material would be disturbed
at any one time. This would represent only a minute fraction
of the normal bed load and ambient turbidity of the river system
in its normal state. Operating cycles would be adjusted as experience
dictates it should.

Conclusions
Extensive prior research and test installations indicate
that a water jet scour dredging system as described herein could
be used effectively to eliminate or greatly minimize annual mainte-
nance dredging requirements of the Almont ship berth on the North-
east Cape Fear River. Initial capital costs of such a system
would be high, but long-term operating and maintenance costs will
be relatively low, soon offsetting the high annual cost of mainte-
nance dredging. It is felt that with the very minimum of material
that is placed in suspension in the river system at each scour
jet cycle environmental effects would be negligible.

or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for coml•;:_nn ce.

A monitoring program is being established for the above
project to comply with CAMA permit requirements for the project..
The project location and specific monitoring stations and re-
quirements are as shown on ttie attached sheet. Scheduling and
sampling requirements are as follow:
Benthos Sampling: Benthic (grab) samples will be collected at
four (4) locations (shown on the attached project location sheet)
for quantitative analysis according to the following schedule:

Three replicate grab samples will be collected at each location.
A quantitative analysis will be Blade of each sampling unit and a
report of findings will be submitted (tabulated by numbered
location).
Turbidity Sampling: Water column samples (top, mid-column and
near bottom) will be collected just prior to initiation of scour
pit operation at locations shown on the attached sheet. Repeat
sampling tests will be made at each location approximately midway
through the scour jet operation cycle (approximate 1 to 1.1/2
hours after activation of scour jets). Comparative turbidity
counts will be reported for each location in tabular form
referenced to test. site numbers.
Turbidity testing will be conducted during ebb tide cycles
only. All testing will be on an on-call basis and will be con-
ducted only during daylight hours. Three days' notice will be
given,. specifying test dates and times. it is anticipated that
three to four complete test cycles will be required to establish
the data base desired; however, additional sampling cycles
(benthic and/or turbidity) may be added to complete the testing
program. Attempts will be made to coordinate benthic and tur-
bidity sampling where feasible.. Plan sheet test site locations
are approximate (according to map scale and reference points;
however, each test cycle should be conducted as nearly as pos-
sible to prior site test locations.
Proposals will be submitted on a "per-test-cycle" basis for
complete benthic and turbidity tests and report sequence.

Almont shipping was issued a cAMA and Dredge and Fill Permit for
maintenance dredging at their basin on the Northeast Cape Fear
River. The permit was issued after a variance decision by the
coastal Resources commission to allow them to use the scour jet
dredging system similar to that being used at Military Ocean
Terminal, Sunny Point. A condition of the permit required them
to develop a system for monitoring impacts on water quality and
benefit communities upstream and downstream of the basin. The
monitoring program was to be approved by the Department prior to
any work being undertaken.
Paul Denison of Henry Von Oesen and Associates has submitted the
monitoring program for our consideration. Paul indicates in his
submittal letter that the monitoring program was developed after
an vnsite meeting with you and Trish MacPherson. The program
supposedly incorporates your recommendations.
I would appreciate your review of the attached monitoring
proposal to determine if it is adequate to assess the potential
impacts from the approved dredging project. We will need to
officially accept their proposal and give final approval for the
project.

have reviewed the proposed water quality monitoring program for
Almont Shipping Company. As Paul Denison acknowledged in his
letter to you, Trish MacPherson and I met with Paul at the Almont
site on 3 June 1988. Based on my review of the proposed monitoring
program, I believe it is consistent ,with the recommendations which
Trish and. I provided to Paul during our discussions on the site. T
believe that the proposed monitoring program will provide the data
necessary to determine whether or not the scour jet dredging system
is adversely effecting water quality or the benthic community in
the vicinity of the Almont Shipping Company site.
Since the extent of the turbidity plume cannot be ascertained until
the scour jet system is placed in operation, changes in the
monitoring station locations and or the number of monitoring
stations may be necessary. Therefore, T would suggest that you
condition your approval of the monitoring program in such a way
that the program can be adjusted at some future date if required.

that its review can be coordinated with DEM staff. Data should
be submitted as it is collected so that we may judge the need to
adjust the number or locations of sampling stations. The data
will also be used to judge the need to implement seasonal
controls of the scour jet operation to avoid adverse impacts to
aquatic organisms as noted in condition #3 of Almont Shipping's
permit.

This represents a request by State Ports to utilize by contractual arrangements
the Barge Mounted Scour Jet array now permitted to Almont Shipping Company by
State Permit #20-88.
This particular methodology while still relatively untested in our area has come
to us with several reports of its dependability and relatively non-impacting nature.
Provided that all review agencies concur. I recommend that a minor
modification be issued to North Carolina State Ports Authority to utilize this
methodology.
A check for $50.00 was presented with the original request and was deposited
by our office. The record of this fact was obscured to me and thus the delay in
processing the request.
