PROJECT SUMMARY: The applicant proposes to add to an existing dock in Fodrey Creek by constructing a 6' wide by 400' long dock parallel and adjacent to the existing bank. 7. HABITAT DESCRIPTION: Tommy Newman Hyde County Project setting The applicant's property is located adjacent SR 1136 in Swanquarter on Fodrey Creek in Hyde County, North Carolina. The overall tract of property is approximately 36 acres and is dominated by Juncus roemerianus marsh. The eastern edge of the property is separated from SR 1136 by an existing manmade canal and basin. The western end of the project site terminates with a highground area containing a 15' by 30' shelter and a parking area. An existing 6' wide by 400' long commercial dock begins at the west end of the site, adjacent the highground area, and runs in an easterly direction parallel and adjacent to the existing shoreline of Fodrey Creek. 5 Mooring pilings are located adjacent the existing dock. The site averages 1.5 feet above mean sea level by the Environmental Management Commission. designated the area as a Primary Nursery Area. . Fodrey Creek is classified as SA-ORW The Division of Marine Fisheries has Project description The applicant proposes to construct a 6' wide by 400' long dock parallel and adjacent to the shoreline of Fodrey Creek. The proposed dock will be connected at the eastern end of the existing dock. Construction will be accomplished by matting over the marsh along the shoreline beginning at the intersection with the highground on the west end of the site. A pile driver will be walked across the mats to the project site. The adjacent shoreline is J. Roemerianus marsh and the dock will be elevated to match the existing dock which is t3' above the marsh. No steps or ramps into the adjacent marsh are proposed. Two 'No Sewage Discharge' signs are proposed, one at each end of the dock. Anticipated impacts The project as proposed will result in localized turbidity associated with the driving of the dock pilings. The marsh adjacent to the creek will be subject to short term impact from matting the equipment over it. The average water depth at the proposed dock site averages -4' below the NWL so no excavation is proposed. The dock width of 6' and height of 3' should not adversely shade the adjacent marsh. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule W.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. Edward Newman Hyde County Project setting The applicant's property is located on SR 1101 on the south side of Far Creek at Engelhard in Hyde County, North Carolina. The project site is within the Engelhard harbor area of Far Creek and varies from 1' to 5' above mean sea level. The property is bordered on the north by Far Creek. The area adjacent Far Creek has the foundation remains of an old concrete block building. The shoreline in this area is littered with debris including concrete block, brick and metal debris. The east side of the site borders coastal wetlands which is a mix of Distichlis s i? cata, Snartina patens, S. cpnosuroides, and Juncus roemerianus. Several other species of wetland plants and woody herbaceous shrubs are also present in this area. The coastal wetland on the east side of the property averages ±40' and intersects an existing canal. A manmade canal divides the project site from the property on the west side. This canal averages ±2.5' in water depth. The adjacent property on the west side is developed and bulkheaded along Far Creek and is the site of a grain storage bin operation. State Road 1101 is adjacent the applicant's site to the south. The majority of the site is highground vegetated with upland grasses and several shrubs. A coastal wetland pocket ± 954 ft2 exists at the head of the canal on the west side and appears to be the result of that area being historically used as a crude haulout facility for wooden boats. This area is predominately vegetated with S. patens, S. alterniflora and some J. roemerianus. Project description The applicant proposes to construct ±433' of bulkhead adjacent Far Creek, the manmade canal on the west side and to separate the highground from the existing coastal wetlands on the east side of the property. The average distance waterward of the NWL for the bulkhead in Far Creek and the manmade canal will be 2' with a maximum of 5' in any one place. The applicant proposes to undertake maintenance excavation in the manmade canal on the west side of the property. The excavation will be limited to the area shown on the plat within the applicants property lines. The excavation will be to a maximum depth of -5' below the NWL. The proposed excavation includes the removal of ±605 ft2 of highground and ±180 ft2 of coastal wetland. The average connecting depth at this location is 7' below the NWL. A 12' by 103' dock is proposed along Far Creek including a 13' by 30' loading dock over the land. A 6' wide by 145' long dock is proposed in the manmade canal and it will be constructed so that half is over the canal and half is on land. The applicant proposes to place the excavated material on the highground portion of his property and allow it to dry out. This material will then be spread over the entire site and will result in the filling of the ±954 ft2 area of coastal wetland that was the old haulout site. Oyster shell is proposed to upgrade the existing driveway. Anticipated impacts The project as proposed will result in the filling of approximately 954 ft2 of coastal wetland. The proposed maintenance excavation will result in the dredging of; ± 180 ft2 of coastal wetland, ±2,520 ft2 of canal bottom, and ±605 ft2 of highground. Localized turbidity is expected as a result of the bulkhead and dock construction. This section of Far Creek is a commercial harbor of refuge and the proposed project will offer increased space for mooring of commercial fishing boats and their associated impacts. David W. Mr. Newman and Mr. F.G. Gibbs (co-owner of property-see attached letter of consent) propose to open a commercial seafood business on a lot previously used for a similar venture, but has since degraded to an eyesore because of neglect. The remnants of a block building, the remains of an old dock, scattered debris, wax myrtles, upland grasses, and some coastal wetlands characterize the site at present. Mr. Newman would like to excavate portions of Jarvis ditch, install bulkheading with backfill, provide mooring facilities, stabilize the shoreline on Far Creek, and improve an existing driveway. First, the lot will be cleared of all the debris that has collected over the years. This will be burned (incombustible materials will be taken to the county landfill). The remnants of the existing block building will be broken up and stockpiled to be used as backfill behind a wood bulkhead in an effort to stabilize the shoreline along Far Creek. The coastal wetlands along Jarvis ditch have resulted from the efforts of a former owner of the property to dig out (by hand) two small boat launching areas. Over the years, the inundation of adjacent areas to these shallow launches have provided an environment conducive to localized spreading of these wetlands. A portion of Jarvis ditch (Newman/Gibbs property), some high grounds and a very small amount of coastal wetlands will be excavated to a depth of 5' below the NWL with a backhoe. The material (sand and muck) will be placed on the lot to dry out. A treated wood bulkhead will be constructed along this side of the lot for 156' (142' along Jarvis ditch and a 14' "L" section, see drawing). A 6" high x 29' long wood bulkhead will join the "L" portion. The excavated fill, when settled, will be used as fill to be spread over the lot. Approximately 954 square feet of coastal wetlands is proposed to be filled in this process. A 6" high treated wood bulkhead will be installed on the southern side of lot just upland of the C.A.M.A. coastal wetland line (see drawing). This will contain the fill that will be spread over the property (south side) and keep it from eroding into the wetland. The east side of the property is subject to erosion from large vessels traveling on Far Creek To stabilize this more heavily eroding section, a 3' high x 103' treated wood bulkhead will be constructed roughly following the existing shoreline (maximum of 5' off the shore) and "L" along the southern property line for 15' (taper to high ground). The stockpiled cinder blocks will be used with topsoil as backfill behind the bulkhead.
