After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Pen-nit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application, For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicator`, hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. The project site is on the rapidly growing W.T. Harris Boulevard corridor. The majority of the site is a forested upland in early succession with some areas of extreme overgrowth of blackberry, honeysuckle, Eleagnus, black cherry, sweet gum, and smilax. The soils on the site are Mecklenburg fine sandy loam (MeB) & MeD) with a small area of Davidson sandy clay loam (DaB), both typi- cal upland and well drained soil types. The site is near the very top of a small drainage area of a minor tributary of Mallard Creek. The total area of Jurisdictional Waters on the the site is ± 0.15 Acres based on my site review. These consist of a small pond and a small "bank to bank" channel. There were no seepage wetland areas below the dam. The development plans call for the areas to be removed or modified depending on the final development plans. I have informed my client that application to NCDEM will be required if the project impacts 1/3 Acre or greater of Jurisdictional Waters.
