4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
Existing conditions consist of wooded land, an open field and grassed yards with residential structures and driveways. An existing 24" CPP for a driveway is located adjacent to Green
Level West Road, in addition to a utility and pipeline easement along the road frontage. Two stream systems are located the properties. One intermittent stream on the western side of
the property that bisects the southwest corner, and one intermittent stream with adjacent wetlands that bisects the southeast corner from the northern portion of the property, and then
again cuts across the northeast corner of the property. The general land use in the vicinity of the project is residential.

The purpose of the proposed project is to construct a residential development and the infrastructure necessary to access the residential development.

The overall project consists of a single family residential development comprising of 50 residential lots and the construction of roadway infrastructure including a turn -lane off Green
Level West Road, utilities (onsite & offsite), pump station, greenvay trails, single-family lots and stormwater stormwater control measures. Specifically, there are stream impacts
associated with a turn lane construction off Green Level West Road, stream and wetland impacts associated with two (2) internal road crossings, stream and wetland impacts associated
with five (5) utility (i.e. sanitary sever/force main) crossings, and wetland impacts associated with a stormwater outfall/bypass. Equipment typically used for construction and earthwork
such as backhoes, bulldozers, excavators, graders, pavers etc. will be utilized for this project.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
S&EC completed a wetland delineation and Jordan Lake Watershed Buffer evaluation for the entire property in order to identify natural resources so
that impacts could be avoided & minimized to the maximum extent practicable. Proposed impacts include one (1) culvert extension, two (2) road
crossings, five (5) utility crossings, and one (1) impact associated With a stormwater bypass. Jordan Lake Watershed buffer impacts will be submitted
to the Town of Cary for a No Practical Alternatives review. Impact 1 is a proposed culvert extension necessary to provide a turn lane for the proposed
development. Proposed impacts include permanent intermittent stream impacts for the culvert extension and headwalls. The turn lane is a requirement
by the NCDOT for traffic safety to provide a left turn lane into the project. Town of Cary (Town) was initially requiring a full road widening along the
frontage of the proposed development, however Tasha Alexander determined that there was no "purpose & need" for the full road widening at this
time. Impact 2B is a proposed utility crossing necessary to bring sanitary sewer and a force main from the pump station to the property. Proposed
impacts include temporary intermittent stream impacts for an open -cut construction. Stream impacts have been minimized by crossing the stream at a
near perpendicular angle. Temporary stream impacts Will be brought back to pre -construction elevations and the stream banks Will be stabilized.
Impact 4A is a proposed road crossing necessary to access the property. Proposed impacts include permanent intermittent stream and wetland
impacts for proposed culverts, headwalls and retaining walls, and temporary stream and wetland impacts for construction activities. This development
entrance and stream crossing location was determined by a requirement by the Town to line up with the subdivision entrance on the south side of
Green Level West Road. The extent of the impact is required due to the placement of the retaining walls for the culverts. According to the Town's
specifications, the walls and associated grid and structure may not be placed in the zone of influence for the structural support of the road. Stream
and wetland impacts have been minimized by utiliang headwalls and retaining walls. Stream and wetland compensatory mitigation is being proposed
for the permanent loss impacts. Impact 4B is a proposed stormwater outfall and riprap dissipater. Proposed impacts include permanent wetland
impacts. This impact is necessary to drain the stormwater and to dissipate the velocities from the stormwater control measure. Impact 5 is a proposed
utility crossing necessary to bring sanitary sewer to the east side of the property. Proposed impacts include temporary intermittent stream impacts for
an open -cut construction. Stream impacts have been minimized by crossing the stream at a near perpendicular angle. Temporary stream impacts will
be brought back to pre -construction elevations and the stream banks Will be stabilized. Impact 7A is a proposed road crossing necessary to access
the southeast area of property. Proposed impacts include permanent intermittent stream and wetland impacts for proposed culverts, headwalls and
retaining walls, and temporary stream and wetland impacts for construction activities. This stream crossing is necessary to access the proposed lots
and land Within the southeast corner of the property. Due to NCDOT and the Town's restriction of road connections near intersections, there are no
access points for these lots off Green Level West Road or White Oak Church Road. The extent of the impact is required due to the placement of the
retaining walls for the culverts. According to the Town's specifications, the walls and associated grid and structure may not be placed in the zone of
influence for the structural support of the road. Stream and wetland impacts have been minimized by utilizing headwalls and retaining walls, and by
crossing in between the wetland areas. Stream and wetland compensatory mitigation is being proposed for the permanent loss impacts. Impact 7B is a
proposed wetland impact for road fill. Proposed impacts include permanent and temporary wetland impacts. This impact is necessary because of the
road alignment necessary to access the southeast area of the property. By crossing at the adjacent 7A location, overall wetland impacts were
minimized. A retaining wall has been proposed to minimized wetland impacts in this location. Wetland compensatory mitigation is being proposed for
the permanent loss impacts. Impact 8 is a proposed utility crossing necessary to bring a sanitary sewer stub to the northern property boundary.
Proposed impacts include permanent -no permanent loss wetland impacts for the permanent maintenance corridor. Wetland compensatory mitigation
is proposed for the change of wetland function. Impact 10 is a proposed offsite utility crossing necessary to connect a force main to an existing
manhole off White Oak Church Road (see sheet CWI-0.2). Proposed impacts include temporary intermittent stream impacts for an open -cut
construction. Stream impacts have been minimized by crossing the stream at a near perpendicular angle. Temporary stream impacts Will be brought
back to pre -construction elevations and the stream banks will be stabilized. Impact 11 is a proposed offsite utility crossing necessary to connect a
force main to an existing manhole off White Oak Church Road (see sheet CWI-0.2). Proposed impacts include temporary intermittent stream impacts
for an open -cut construction and permanent -no permanent loss wetland impacts for the permanent maintenance corridor. Stream and wetland impacts
have been minimized by crossing the stream at a near perpendicular angle. Temporary stream impacts will be brought back to pre -construction
elevations and the stream banks will be stabilized. Wetland compensatory mitigation is proposed for the change of wetland function. At impacts 213, 5
and 8, Bore and Jack or Directional Drill was not proposed because the Town requires a permanent maintenance easement. At offsite impacts 10 &
11, Bore and Jack or Directional Drill was not proposed because it is the applicants understanding that these crossing locations Will be Within a future
Right-of-way for a future subdivision to the north that is being designed and developed by others.

S&EC conducted NCSAM at the three permanent stream impact areas 1, 4A and 7A. A summary and request for reduced mitigation ratios were sent to
James Lastinger with the USAGE. James agreed to no stream mitigation at Impact 1 (46 LF) and a 1:1 mitigation ratio at Impacts 4A and 7A (113 LF
and 74 LF).

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs' document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The Dominion Estates project is a residential development. The property is located within the Town of Cary, therefore the
adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Water Supply,
Watershed Protection Program which limits development densities as well as requires protective riparian buffers; 2) the Jordan Watershed Riparian
Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow' requirements
and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; and finally 3) the Phase II NPDES Stormwater
Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction
stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

Re Project: Dominion Estates
This document confirms that the DR Horton-Terramor, LLC (Applicant) for the Dominion Estates
(Project) has expressed an interest to utilize 187.00 Stream Mitigation Credits from the EBX sponsored
RES Cape Fear 02 Umbrella Mitigation Bank, specifically 187.00 stream credits from the Dairyland Site,
in the Cape Fear HUC 03030002. As the official Bank Sponsor, Environmental Banc & Exchange, LLC,
attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
