Box 2017 Smithfield, N.C. 27577 Dear Mr. Dees: F L E COPY You have our approval to place fill material in up to 0.1 acres of wetlands or waters for the purpose of ditch reconstruction at Daniels Ferry Road, as you described in your application dated 12 August 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. An additional condition is that wetlands adjacent to the creek along Daniel Ferry Road should be avoided and not ditched. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Owner's Signatu Date ffi z DESCRIPTION OF PROPOSED WORK Work proposed by Applicant and Wife would include the attempt to restore to the natural, pre-existing conditions of the land before the sub-division was developed and trees removed from the lot shown as Reserved by Owner. 'The actual work would be the addition of less than a foot of soil matter to an area depicted on the map from an area shown as approximately from point A to point B. The amount ached would vary from a couple of inches to less than a foot. PURPOSE OF PROPOSED WORK During construction of Cypress Point sub-division around 1991 a road, Daniels Ferry Road, was constructed under the guidelines of the Corps of Engineers. In 1992 Applicant and wife purchased Lot Number One as depicted on the attached map. In 1993 Applicant and Wife purchased approximately two acres of land that is sfown on the attached plat map as being reserved for Owner. This land includes land that would appear to be an extension of Daniels Ferry Road that is shown as being next to Lot Number One and the area Reserved by Vwner. There have been several pine trees and sweet gum trees removed from the area labeled as Reserved by Owner, C,OTderin, the shoulder of Daniels Ferry Road and the land in question has been marked by ruts made by tires as the trees were removed. 1t is the intention of Applicant and Wife to re- establish, as much as possible, the natural elevation, the natural water tlow, and appearance of this Lana to its original, pre-existing condition. It is also the intention of Applicant and Wife to repair the shoulder of Daniels Ferry Road to the condition before the trees were removed. The area to be affected by the addition and removal of dirt would be very small, less than one tenth of an acre total, and would not in any way damage the overall condition and appearance of the wetlands under consideration. It is a beliet by Applicant that activity proposed would in fact add to the condition and appearance of the wetlands area and would not be detrimental in any way. The proposed activities would only be at the border of Lot Number One and down the shoulder/border of Daniels Ferry Road to Black Creek. Applicant Project Perm it No County Fred J. Dees restore to natural (residential development) 0000754 Johnston Mr. Dees wishes to grad the ditch which parallels the road along edge of his property. (In order to eliminate the "pooling" of water adjacent to his proposed driveway). As indicated on the attached map he wanted to continue the ditching to the creek. I was able to explain to Mr.Dees that we had no problem with the grading along the proposed driveway and along apart of Daniel Ferry Road. However, I recommended that he avoid impacting the wetlands adjacent to the Creek. I explained, that the grading of a ditch to divert water from pooling up near the-proposed driveway and continuing this grade approximately 2/3 of the length of the property is reasonable. However, the wetlands adjacent to the creek along Daniel Ferry Road should be avoided. As a result, Mr. Dees could eliminate the "pooling" of water adjacent to driveway and would largely retain the available wetland function and better protect the water quality of Holts Lake. Mr. Dees was very receptive to this compromise. Based on the site inspection and conversation with Mr. Dees I recommend issuance of this 401 Certification. J. Dees, Johnston County Biologists from the Wildlife Resources Commission (NCWRC) have reviewed the subject permit application and are familiar with the habitat values of the project area. An onsite investigation was conducted on August 23, 1994 for the purpose of further assessing project impacts on wildlife and fisheries resources. Our comments are provided in accordance with provisions of the F=ish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq. ), and the Clean Water Act of 1977 (33 U. S. C. 466 et seq. ) It is Mr. Dees stated intention to "reestablish .... the natural elevation.... water flow, and appearance of the land to it's original condition" in the subject area. The subject area consists of less than one--tenth acre of wetlands, all of which has been impacted previously by logging equipment, and possibly other activities. The Wildlife Resources Commission feels that the proposed fill and "restoration" of the subject area will not have significant impacts to the wetland itself, it's function, nor water quality. There is a possibility that drainage will be enhanced, which could result in an increase in nutrient and sediment runoff into the creek, and subsequently Holt Lake. This scenario would be likely only if the "reserved" area was developed. In 1992 Applicant and wife purchased Lot Number One as depicted on the attached neap. In 1993 Applicant and Wife purchased approximately two acres of land that is shown on the attached plat map as being reserved for Owner. This land includes land that would appear to be an extension of Daniels F=erry Road that is shown as being next to Lot Number One and the area Reserved by owner. There have been several pine trees and sweet gum trees removed from the area labeled as Reserved by owner, borderinn the shoulder of Daniels Ferry Road and the land in question has been mar Red by ruts made by tires as the trees were removed. it is the intention of Applicant and Wife to re- establish, as much as possible, the natural elevation, the natural water flow, and appearance of this land to its original, pre-existing condition. It is also the intention of Applicant and Wife to repair the shoulder of Daniels Ferry Road to the condition before the trees were removed. 1"he area to be affected by the addition and removal of dirt would be very small, less than one tenth of an acre total, and would not in any way damage the overall condition and appearance of the wetlands under consideration. it is a belief by Applicant that activity proposed would in fact add to the condition and appearance of the wetiands area and wouid not be detrimental in any way.
