Dear Mr. DuMond,
We have received your application to impact 75 feet of intermittent stream and 0.13 acres of
wetlands by way of filling and flooding to facilitate the construction of a pond at your residence
located off of Hicks Road, northeast of Cool Springs Road, near Camel Creek, east of Broadway,
arri County, North Carolina.
As proposed, the impact to wetlands is greater than a tenth of an acre and does not qualify
for Nationwide Permit 18: However, the pond construction is an attendant feature associated
with your residential development and the project will qualify for a Nationwide Permit 39. I
suggest that you withdraw the Nationwide Permit 18 application and re-submit under a
Nationwide Permit 39. -
We need additional information regarding the pond design and the spillway mechanism to
ensure that the degradation of downstream areas is minimized. The additional information should
include the following:
a) Detailed drawings of the pond design. The pond design should include plans for an
emergency overflow spillway.
b) Across-section of the proposed dam.
c) A description of the size and type of pipe used for the inflow and outflow of the
spillway.
d) Details for an energy dissipation mechanism to be used at the base of the spillway. If
rip-rap is proposed to dissipate energy at the base of the spillway, please describe the
size, type, and amount of rip-rap.
