We have reviewed your request for 401 Water Quality Certification
to place fill material in 0.10 acres of wetlands or waters which are
tributary to Mingo Swamp for Water Main Extension located at N.C 27
near Benson in Johnston County as described in your submittal dated 14
February 1994. Based on this review, we have determined that the
proposed fill is covered by General Water Quality Certification No.
2664. A copy of the General Certification is attached. This
Certification-is necessary for coverage under Corps of Engineers'
Nationwide Permit No. 12. This action completes DEM's review under
Section 401 of the Clean Water Act.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Jean:
By this letter, we are hereby requesting to construct a 12 inch water main within the
Mingo Swamp Creek along NC 27 approximately 1 mile west of the Town of
Benson. You will find attached a site plan of the proposed construction activity, an
executed joint form application, an executed nationwide permit verification, and a
copy of the conditions of the Nationwide Permit #12.
We met on site to discuss particulars about this project last Wednesday, February 9,
1994. As discussed during our field meeting, our intent is to cross the referenced
creek as close to the headwall as practical. Upon crossing the creek, construction of
the water main will divert back to the roadway shoulder and be located
approximately 5 feet from the edge of pavement.
Installation of the water main within the creek will be by track mounted backhoe
operating from each side of the creek. The trench will be approximately 36" wide
X 48" deep with the top of pipe approximately 3 feet below the creek bottom. To
the extent possible, excavated material will be segregated between organic and
inorganic material such that during backf:illing the organic material may be placed
near the surface of the creek bottom. The excavated trench will be located within
NCDOT right-of-way throughout. It is anticipated that the width of the construction
SUITE 117 corridor will be approximately 20 feet.

INFORMATION:

DOES NOT AUTHORIZE UTILITY LINES THAT ARE NOT COMPLETELY BURIED.
2. THIS NATIONWIDE PERMIT DOES NOT AUTHORIZE USE OF FILL MATERIAL FOR
PERMANENT ACCESS CORRIDORS.
NATIONWIDE CONDITIONS: STANDARD GENERAL CONDITIONS AND THE FOLLOWING SPECIFIC
CONDITIONS:
1. MATERIAL RESULTING FROM TRENCH EXCAVATION AND MAY BE TEMPORARILY
SIDECAST INTO WATERS OF THE U.S. PROVIDED THAT THE MATERIAL IS NOT PLACED
IN SUCH A MANNER THAT IT IS DISPERSED BY CURRENTS OR OTHER FORCES AND MUST
BE REMOVED WITHIN THREE MONTHS.
2. THE AREA OF WATERS OF THE U.S. THAT IS DISTURBED MUST BE LIMITED TO
THE MINIMUM NECESSARY TO CONSTRUCT THE UTILITY LINE.
3. IN WETLANDS, THE TOP 6" TO 12" OF THE TRENCH SHOULD GENERALLY BE
BACKFILLED WITH TOPSOIL FROM THE TRENCH.
4. EXCESS MATERIAL MUST BE REMOVED TO UPLAND AREAS IMMEDIATELY UPON
COMPLETION OF CONSTRUCTION.
5. ANY EXPOSED SLOPES AND STREAMBANKS MUST BE STABILIZED IMMEDIATELY UPON
COMPLETION OF THE UTILITY LINE.
REGIONAL CONDITIONS:
1. APPLICANTS MUST NOTIFY THE DISTRICT ENGINEER AND RECEIVE FROM THE
DISTRICT ENGINEER WRITTEN APPROVAL PRIOR TO STARTING WORK.
2. THE TEMPORARY PLACEMENT OF EXCAVATED OR FILL MATERIAL IN WATERS OR
WETLANDS WILL BE FOR THE ABSOLUTE MINIMUM PERIOD OF TIME NECESSARY TO
ACCOMPLISH THE WORK.
3. STABILIZATION IS REQUIRED IMMEDIATELY ON COMPLETION OF EACH INDIVIDUAL
CROSSING.
4. WORK PLANS MUST BE PROVIDED AND MUST BE SIZED TO 8 1/2 BY 11 INCHES.
5. RESTORATION PLANS MUST BE SUBMITTED TO THE DISTRICT ENGINEER
DESIGNATING A TIME TABLE FOR RESTORATION.
401 CERTIFICATION DETERMINATION: GENERAL CERTIFICATION ISSUED, BUT
CONDITIONED AS FOLLOWS:
1. WRITTEN CONCURRENCE IS REQUIRED FROM NCDEM.
2. THE CONSTRUCTION CORRIDOR IS LIMITED TO 40 FEET IN WIDTH AND MUST BE
MINIMIZED TO THE MAXIMUM EXTENT PRACTICABLE.
3. PERMANENTLY MAINTAINED ACCESS CORRIDORS SHALL BE RESTRICTED TO THE
MINIMUM WIDTH PRACTICABLE AND MAY NOT EXCEED 10 FEET IN WIDTH EXCEPT IN
LOCATIONS SPECIFIED ON MAPS FOR VEHICULAR ACCESS PURPOSES OR AT MANHOLE
LOCATIONS.
