Box 638 Benson, N.C. 27504 Dear Mr. Parker: Subject: Proposed fill in Wetlands or Waters North Park at I-40 Johnston County DEM Project #94022 We have reviewed your request for 401 Water Quality Certification to place fill material in 3.72 acres of wetlands or waters which are tributary to Hannah Creek for industrial park development located at I-40 exit 325 in Johnston County as described in your submittal dated 15 December 1994. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2671. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 26. This action completes DEM's review under Section 401 of the Clean Water Act. An additional condition is that a stormwater plan for the entire site including wet detention ponds must. receive written DEM approval. Deed restrictions must be placed on all remaining jurisdictional wetlands on the site. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. Specifically, your property is located at the northwestern end of S.R. 1380, west of Exit 325 off Interstate-40 and east of the Rest Area, northwest of Benson, adjacent and above the headwaters of an unnamed tributary to Stony Fork, Johnston County, North Carolina. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. Jernigan, Jr. Location I-40 East to Exit 325 - Turn right at top of exit ramp and turn right on first State Road (1380), property near end of SR 1380. -see site plan map "A" - the planned use of a large portion of wetlands on this site map have not been clearly shown. The lots that I have crossed out (1,2,3) are not going to be developed as per Mr. Jernigan's explanation. The other lots proposed for development (except 8, 10. and 17) will not impact wetlands. It is important to understand that the bulk of the non-wetland terrestrial habitat on site map A has been altered (this area has been used for road fill during construction of I-40). The borrow area, as shown on the site map "A", generally follows jurisdictional wetlands and has resulted in the filling of only a small amount of wetlands (I have circle these previously impacted wetlands on site map "A"). -see site plan map "B" - the rating sheet sites are designated on this map (1,2,3,). Note: Site map "A" connects to Site map "B". Use the isolated wetland marked K on site map "B" to match up the two site maps. The wetlands at the southern end of site map "B" were high quality bottom lands (see rating sheets). Wetlands in the northern portions of the property were significantly lower quality. I recommend that storm water controls be required in order to prevent severe alterations to the current wetland function as a result of storm water runoff. This should include wet retention ponds with riser basins and possibly the frequent use of rip-rapped storm water conveyances. Also, some sort of covenants should be required that would prohibitIM home or lot owners from further development of wetlands. recommendation - issue/condition If you have any questions are would like to meet me regarding this project please call me at the RRO. Box 638 Benson, N.C. 27504 Project #94022 Dear Mr. Parker The Division of Environmental Management, Water Quality Section has reviewed your plans for wetland fill for 3.72 acres of wetlands at I-40 exit 325 (North Park at I-40) in Johnston County for industrial park development. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal, streambank stabilization, wildlife habitat and aquatic life habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in wetlands. Therefore, we are moving toward denial of your 401 Certification. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal_ Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to fill of these wetlands. Specifically can you construct your industrial park with less wetland fill on nearby uplands or prior converted farmland? In addition, a complete stormwater plan including wet detention ponds will be required for the site. Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401. Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to our Mr. Danny Smith at the Raleigh Regional Office at 3800 Barrette Drive, P.O. Based on pre-application meetings/phone conversations with you and an on-site meeting with Karl Shaffer of the Water Quality Section of the Division of Environmental Management (DEM), several modifications have been made to the original plan for the project. Each of you were given a copy of the original plan at the pre- application meetings. A similar-sized copy of the revised plan has been included in the permit package to facilitate comparison with the original plan. Changes to note include: 1) road crossing of wetland "B" has been deleted and replaced with a cul-de-sac on the south side; 2) client no longer proposes to fill wetland "J"; 3) the proposed ditch associated with the filling of wetland "I" has been shortened and no longer extends beyond boundary between lots # 25 and 24. Tract "A" of the property was cleared and used as a borrow area during the construction of Interstate 40 (I-40). Three wetland areas, "L", "M", and "N" (0.0580 acre, 0.2491 acre, and 0.3099 acre respectively), were previously filled on this tract and are included in the total wetland acreage impact of the proposed project. No further wetland impacts are proposed on tract "A". Tract "B" is presently forested but in various stages of succession (see enclosed data sheets). Most of the wetlands on this tract, with the exception of wetland "D" would not be considered high quality wetlands. Mr. Shaffer (DEM) verbally concurred with this assessment during his on-site visit. 00/44 The property is bounded by I-40 and the Rest Stop on its eastern border, most of the western and northern boundaries are bordered primarily by agriculture, and the narrow southern boundary is forested. Construction of I-40 bisected S.R. 1362 resulting in a dead-end road at the northern end of tract "B". Federal Road Extension (S.R. 1380) is a dead-end road at the southern end of tract "A". The primary road of the North Park at Forty Industrial Park will connect these two dead-end roads and will provide access to I-40 as well as Hwy. 50. The proximity of the proposed project to two major interstate highways (I-40 and I-95) make it an attractive site for industrial development. Johnston county and the State of North Carolina have recognized this area as a prime site for industrial development. Industries locating in the proposed industrial park would enhance the local economy through new jobs as well as adding to the tax base.
