Upon review of your request for 401 Water Quality Certification
to place fill material in 1.41 acres of wetlands or waters which are
tributary to Fourmile Creek for apartment complex development located
at NC 51 between Rea Road and Elm Lane W. in Mecklenburg County as
described in your submittal dated 7 January 1994, we have determined
that the proposed fill can be covered by General Water Quality
Certification No. 2671. A copy of the General Certification is
attached. This Certification may be used in qualifying for coverage
under Corps of Engineers' Nationwide Permit No. 26. An additional
condition is that stormwater shall be directed into the wetland
directly south of the new road which crosses the site.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Mr. Dorney:
The purpose of this letter is to provide a brief history of this
project and the most revisions that have been made so that a 401
Water Quality Certification will be issued. The property was
previously traversed on foot and the soils, vegetation and
hydrology evaluated and wetland areas examined by current
procedures described in the 1987 Corps Manual for Identifying and
Delineating Wetlands by Law Environmental and approved by Steve
Lund of the U.S. Army Corps Asheville Regional Office. The
approved wetland delineation is shown on the attached plans
prepared by Land Design.
This information was utilized in a permit application to the Corks
for a Nationwide 26 permit and the N.C. Division of Environmental
Management for a 401 Water Quality Certification. The initial
application submitted by Law Environmental was not acceptable tc
the Corps but it is our understanding that Mr. Tony Browder of
Burnell Associates in Charlotte coordinated plan revisions with
Mr. Lund to reduce wetland impacts to the point that Mr. Lund and
USF&WS verbally agreed to approve.
DEM also had some concerns over the impacts so I met you in your
Raleigh office to discuss the project on 12/21/93. After that we
arranged a site meeting with Samar in your Mooresville office cn-
site on 12/28/93. Based on that meeting and a follow up meetinj
in your Raleigh office with you on 12/30/93 it was determined that
impacts could be reduced further by relocating one additional
Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits
On-Site Waste Treatment Systems, Evaluation and Design
parking lot. Based on this you and I prepared a sketch of what
was acceptable. That sketch along with a few minor storm drainage
relocations was provided to Tony Browder of Burnell Associates
that he and Land Design could revise plans accordingly. As
requested two copies of these revisions are enclosed.
Based on these changes, you felt DEM could approve the required
401 Water Quality Certification. As we discussed the client needs
written approval prior to 1/21/93. As soon as this approval is
ready please call me at 846-5900 so we can arrange to pick it up
in order to save "mail time".
As shown on the plans originally, 1.82 of the 1.90 acres of
jurisdictional wetlands on-site were to be impacted.
Approximately 0.41 acres of impacts have been omitted (see plans).
In reality total impacts are less than tote 1.414cres indicated
since much (about 50 to 70%) of the area is currently open water
and will remain open water after project completion. Also the
major culvert under the road has been moved so that the discharge
will be directly into the pond and not thru the preserved wetland
in order to avoid its destruction by erosion. Stormwater will be
discharged from the retaining wall in the parking area adjacent to
the preserved wetland in order to "keep it wet" without eroding it
away.

14. The proposed Bevington Apartments project is located on a 25.003--acre site in
Mecklenburg County, North Carolina. The site contains 23.103 acres of uplands and 1.90
acres of jurisdictional wetlands. Development of the upland portions of the site will
necessitate a stormwater management plan. Plans for stormwater ponds for this site include
enlarging the existing pond by excavating 0.77-acres of wetlands and construction of a new
sedimentation pond by excavating 0.15-acres of wetlands. These ponds will satisfy
stormwater requirements.
The additional 0.90 acres of wetland impacts are associated with a road crossing and parking
space. In order to provide adequate stormwater management for development of the upland
portions on site and road access to the entire site, impacts to wetlands was unavoidable.
To compensate for impacts to wetlands on site Fairfield Residential has proposed
construction of a littoral shelf around 75 percent of the pond. This littoral shelf will extend
from the shore on a 1 foot rise to a 10 foot run. This littoral shelf is expected to have a
minimum vegetated width of ten feet. At normal water elevation the shelf will be
submerged by approximately one foot of water. This shelf will be suitable for numerous
aquatic plant species and aid in maintaining suitable water quality for the pond and waters
downstream.

On behalf of Fairfield Residential, Inc., Law Environmental, Inc. is pleased to provide you
with the following information concerning the Bevington Place Apartments development
plan for your consideration and-.approval under Nationwide Permit No: 26. The project site
is located in Mecklenburg County, North Carolina near Pineville, North Carolina (Sheet 1).
The proposed project includes the construction of a 0.93-acre stormwater pond, road
crossing and parking, and sedimentation pond which will impact a total of 1.82 acres of
jurisdictional waters of the U,S. including wetlands,
The jurisdictional wetland boundaries on the subject site were delineated by Law
Environmental using the 1987 "Corps of Engineers Wetlands Delineation Manual."' The
jurisdictional areas on the site are contained within the stream bed and bank, adjacent
floodplain, and existing pond (wetland plat attached). The total area of wetlands delineated
by Law Environmental and field verified by the Asheville Office of the Wilmington District
'Environmental Laboratory. 1987. "Corps of Engineers Wetlands Delineation Manual,"
Technical Report Y-87-1, US Army Engineer Waterways Experiment Station, Vicksburg,
Mississippi.

of the U.S. Army Corps of Engineers on the subject property is 1.90 acres. The total
amount of wetlands within the limits that is expected to be impacted is 1.82 acres. The
wetland impacts associated with filling for the road crossing and parking total 0.90 acres and
impacts associated with the excavation of the proposed stormwater ponds total 0.92 acres.
Fairfield Residential has designed the new ponds for suitable stormwater management
(plans attached) as required by the local government and the State of North Carolina. The
pond has also been designed with a littoral shelf with an approximate average width of 10
feet around 75 percent of pond's shoreline (0.15 acres) to compensate for the wetland
impacts on site.
