You have our approval to place fill material in 0.69 acres of wetlands or waters for the
purpose of school construction at SR 1705, as you described in your application dated 4 April, 1994.
After reviewing your, application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number
26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application.
If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in. the attached
certification. In addition, you should get any other federal, state or local permits before you go
ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to
the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

Reference your application of April 4, 1994 submitted by you -a nt,
Mr. Kevin Martin with Soil & Environmental Consultant, Inc., for Department of
the Army (DA) authorization to discharge fill material into .69 acres of
wetlands on your property located north of N.C. Highway 42, as of S.R. 1705,
about 4-5 miles northeast of Clayton, Johnston County, North Carolina.
Specifically, the requested activity is located adjacent and above the
headwaters of an unnamed tributary to the Neuse River. The proposed fill
material will allow the construction of the school, roadways, and parking for
cars and busses.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code
of Federal Regulations (CFR), Part 330.6, published in the Federal Register on
November 22, 1991, lists nationwide permits. Authorization was provided,
pursuant to Section 404 of the Clean Water Act, for discharges of dredged or
fill material into headwaters and isolated waters.
Your proposed work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM). You should contact Mr. John
Dorney, telephone (919) 733-1786, regarding water quality certification. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid for two years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the two years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the two years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within twelve months of the date
of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Dear Mr. Martin:
The purpose of this letter is to provide additional information pertaining to
the proposed nationwide Permit No. 26 for Clayton Elementary School in
Johnston County.
The sedimentation and erosion control plan for the site employs catch basin
protection, sediment pits at pipe discharge points, and a strict required
sequence of construction activities.
Due to the topography of the site, a large riser basin will be required during
grading operations in order to adequately protect the downstream wetlands
and watercourses. The only effective location for such a measure requires
limited encroachment into wetlands, adjacent to the toe of the proposed fill
for the school's parking lot. The configuration of the proposed basin is
shown on the accompanying grading plan.
It is the intention of the school to convert the area occupied by the riser basin
to an observation and performance platform. This platform would be used
for passive observation of the surrounding natural habitat as well as outdoor
congregation of students.
As you know, the sedimentation and erosion control plan has been approved
by John Holley. The proposed Nationwide 26 has been approved by the Corps
of Engineers contingent upon receipts of a 401 Water Quality Certification
from the State. 2

I have performed a site evaluation with Larry Sink of S&EC for
this project. Mr. Sink performed wetland delineations, but was not
in a position to discuss site planning or alterations.
There is a large area of jurisdictional wetlands with
significant uses on the western edge of the tract. These wetlands
are shown on the map legend as impacted. Yet, the plans do not show
justification for this fill. Revised plans must be submitted to
show this area with no impacts, with an impacted acreage change
accordingly. It is also suggested that the proposed bus parking lot
be realigned. The traffic island separating the bus lot from the
school is a suitable place to cease wetland impacts.
Another wetland adjacent to N.C. Route 42 also shows
significant uses. Currently, there are no proposed impacts to this
wetland. In any possible realignment of the proposed facilities,
avoidance of impacts to this area is also recommended.
The applicant must also address stormwater plans from the
proposed school and associated impervious areas. If I can offer

The purpose of this letter is to request a to Nationwide Permit 26 and a 401 Water
Quality Certification for the project known as the Clayton Elementary School on NC 42.
The project is to the east of Clayton, located north of NC 42 and east of SR 1705 in
Johnston County, as shown on the enclosed plans and vicinity map.
Jean Benton Manuele of the US Army Corps reviewed the site on January 26, 1994 and
approved the wetland delineation. Fill in Waters of the US will be required to develop
the site for an elementary school, including roadways and parking for cars and busses.
It will necessary to fill 0.69 acres of jurisdictional Waters of the US above headwaters
for placement of the proposed facilities.
To expedite the permitting process and to ease the process for everyone involved, the
following individuals/ agencies have been provided with a complete copy of this entire
application package: Karl Schafer (DEM Raleigh Regional Office) and David Franklin
(Wilmington Corps).
