The Division has determined that your application is incomplete and cannot be processed. The application is on hold until the following items are addressed: 1. Title 15A NCAC 02H .0502(a)(3) requires that a corporation that is an applicant for a water quality certification must be registered with the NC Secretary of State's Office. A review of the NC Secretary of State's database indicates Spano & Associates Haywood, LLC is not registered. Please provide proof that Spano & Associates Haywood, LLC is registered with the NC Secretary of State's Office. How will wetland D be filled/graded without causing a violation of state wetland standards in the remaining portion of the wetland? Note that the Initial Erosion Control Plan (Sheet C-102) does not appear to depict any measures to prevent sedimentation to the wetland. The Stormwater and Grading Plan (Sheet C-103) and Final Erosion Control Plan (Sheet C-104) do not depict wetland WD at all. It's difficult to understand how contractors will know to avoid this area if it is not depicted on plan sheets. [15A NCAC 02H .0506(c) and 15A NCAC 02B .0231] Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received, the Division will be unable to approve the application and it will be returned.
