Box 16279 Winston-Salem N.C. 27115-6279 Dear Mr. Burnell: Subject: Proposed fill in Wetlands or Waters Demolition landfill and parking lot Guilford County DEM Project *931059 We have reviewed your request for 401 Water Quality Certification to place fill material in 0.62 acres of wetlands or waters which are tributary to Richland Creek for demolition landfill and parking lot expansion located at Old Jackson Lake Road in Guilford County as described in your submittal dated 21 December 1994. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2671. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 26. This action completes DEM's review under Section 401 of the Clean Water Act. An additional condition is that written.approval for a stormwater management plan must be obtained from DEM. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. The purpose of this letter is to respond to your letter dated 2/22/94 to Mr. Chuck Burnell of Larco Construction Company concerning their Old Jackson Lake Road Asphalt Plant Expansion. You and I discussed this project briefly in a meeting at your office. I met Mr. Ron Linville of your staff to review the proposed project and based on the following conditions, was under the assumption that the project as proposed could utilize a General Water Quality Certification. 1. The wetland area to be impacted is beneath a powerline for the most part and is routinely mowed. 2. This wetland is upstream of the existing plant and the watershed upstream of the wetland for at least one half mile is sparsely populated mostly with scattered single family homes. The stream has at least a 100' wooded buffer on both sides until the-upper part of the watershed where one metal shell commercial building is being constructed with poor sediment and erosion control. 3. Currently there is no stormwater treatment for runoff from the existing plant site which is adjacent to Richland Creek. If the plant expands it will have to install stormwater ponds on the down gradient parts of its property. In doing so their should be an improvement in water quality of Richland Creek but these ponds will occupy areas currently utilized for stockpiling, roadways and other plant operations. Therefore there is a need not only to create larger stockpile areas upgradient for the expansion but also to replace existing areas that will be lost due to the creation of stormwater ponds. 4. Because of setback buffers from property lines and the fact that our client cannot excavate under the aerial sewerline or powerline, filling this area is the only option available. Had the wetland in question been down gradient from the existing facility it probably Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design could have been avoided. 5. Mr. Linville noted a concern that you may not be able to get N.C. Solid Waste to permit the proposed demolition landfill for various reasons. Our client,will go through the appropriate procedures for permitting such a facility but I do not see how this is your concern. Our client did not wish to go through the expense of pursuing a landfill permit until they knew the wetlands issues had been resolved. If such a permit cannot be obtained our client would fill the area for the expansion any way but not with demolition landfill material. We felt that utilizing this area for anon-hazardous material (stumps, concrete, fill dirt, etc.) landfill as well as a stockpile area would be an efficient use of the land which could result in other areas not being used for landfilling activities. In other words you could minimize impacts by building the new stockpile areas with demolition landfill material, instead of using twice the area to accomplish each goal in two different locations. 6. Finally we agreed that once the stormwater pond was designed adjacent to Richland Creek, we could vegetate the area between the creek and the pond's outlet with black willow and juncus sp. from the area to be impacted under the powerline. However, until designed we cannot be sure of the area that could be enhanced/created. Our client is willing to have this be a condition.of his certification which we can work out the details of when the ponds are designed. There is also the possibility of vegetating shelves along the ponds edges to offset the impacts. I hope this addresses your concerns adequately. Please call me to discuss this further if necessary. Based on this review, we have identified significant uses which would be removed by this project. These are water storage, streambank stabilization, pollutant removal and aquatic life habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned. Therefore, we are moving toward denial of your 401 Certification. Please provide us with information supporting your position that your project must be constructed in wetlands. Specifically can you construct your landfill and/or parking area on nearby upland? In addition, stormwater controls will be needed for this entire site in order to allow wetland fill for site expansion. Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. Generally these are: 1. Richland Creek is in need of additional water quality protection due to obvious potential impacts from the asphalt facility and steep creek banks. The intermittent tributary to Richland Creek is gravel filled and devoid of vegetation on the worksite. 2. Larco needs to submit a complete set of plans for the proposed construction (expansion) and the stormwater retention pond. This plan should indicate how the company will treat the intermittent stream flowing through the site. It would be preferred that this streamflow enter into the stormwater pond. This would provide for a somewhat seasonal wet stormwater retention pond. 3. Turbidity was observed upstream and in the wetlands. This turbidity was completely removed by the existing upslope hardwood wetlands. The loss of this wetland should not be underestimated. This wetland loss should be offset by constructing (mitigating) a wetland below the stormwater pond. As the site is somewhat restrictive, it is doubtful that this could occur on a 1:1 basis; however, the stormwater pond should make up the difference providing it is a wet retention pond with adequate freeboard. 4. A solid waste permit or review may be required for this site prior to any use of the wetland area for demolition landfill purposes. Clean fill may be preferred since the proposed construction area is in a functioning wetland. 5. Please note that wetlands have not been surveyed, so the wetland map is approximate. Out client hopes to minimize expenses by foregoing survey costs. Mr. Thomas indicated that surveying would not be necessary when we met on-site. Fill in the.wetlands will be required to build parking and a demolition landfill (see attached map). Available uplands have been utilized as much as possible. It will be necessary to impact .62 acres (see map) of jurisdictional wetlands above headwaters for placement of the proposed facilities. To meet the conditions of a sedimentation/ stormwater provision with the City of High Point, one stormwater retention pond will be built (on an upland area), and another will be created from an existing processing pond. Since the processing pond does not qualify as jurisdictional waters of the U.S. (this has been verified by Mr. Thomas), it is not included as an area to be impacted. The two ponds will prevent run--off from flowing directly into Richland Creek. Currently no such protection. exists. The wetlands to be impacted on-site are up gradient.from the plant area and therefore do not filter runoff from this area. Therefore, their impact will allow for continued operation of the existing plant while allowing for runoff from the plant to be "treated". Since the processing pond does not qualify as jurisdictional waters of the U.S. (this has been verified by Mr. Thomas), it is not included as an area to be impacted. The two ponds will prevent run-off from flowing directly into Richland Creek. Currently no such protection exists. The wetlands to be impacted on-site are up gradient from the plant area and therefore do not filter runoff from this area. Therefore, their impact will allow for continued operation of the existing plant while allowing for runoff from the plant to be "treated".
