Reference the application of Mr. Warren Everhart for a Department of the
Army permit to construct a timber span bridge to span Southward Creek, off
Pamlico Sound, Ocracoke village,'Hyde`County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
C. If the display of lights and signals on the authorized structure is
not otherwise provided for by law, such lights and signals as may be
prescribed by the U.S. Coast Guard will be installed and maintained by and at
the expense of the permittee.
d. The permittee will maintain-the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons.the permitted activity without
having it transferred to a third party.
e. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or

construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.

This office placed the above subject CAMA Major application on hold for
information on 6 July 1993; information concerning the mean high water (MHW)
line around the site. On 31 August 1993, Mr. Everhart submitted information,
but it was determined to be incomplete again. Division of Coastal Management
staff established a MHW line and submitted it to this office for review. This
office will accept the DCM's designation of MHW. If the applicant is not in
agreement with the MHW line established by DCM, he can submit a surveyed line
himself, and we will review it upon receipt.
A thorough review of the project will be performed when the
aforementioned information is received. If you have.any questions or

PROJECT SETTING
The applicant owns a six-acre tracf of land that is bordered to the north by the Pamlico Sound,
to the west by a creek locally called "Southward" or "Tolson's Creek", to the east by an
unnamed creek, and to the south by an extensive intertidal marsh. There is a deeded easement
or right-of-way on the mainland. The project is located in the Upland Trent Subdivision of
Ocracoke Village in Hyde County, North Carolina at the end of SR 1356. The project site is
located approximately 0.25 miles upstream from the mouth of "Southward Creek". The creek
is approximately 200' in width at the mouth, 170' at the project site, and quickly narrows down
to 30'-40' wide at its upper end. A 200' long by 25' wide by -4.5' deep channel was recently
dredged through a natural sand shoal near the mouth of the creek thus connecting it through
another channel to the deeper waters of the Pamlico Sound. Water depth averages between 2.5'
and 3.5' below MHW along the remainder of the creek. On the mainland side of the creek there
is a 10'-20' fringe of coastal wetlands dominated by black needlerush Juncus roemerianus. Salt
meadow grass SSpartina patens, smooth cordgrass S. alterniflora, salt grass Distichlis spicata, and
glasswort Salicornia spp. are also present. Bordering the island on the east side of the creek is
a narrow fringe (6'-8') of black needlerush, salt meadow grass, and smooth cordgrass. The
natural upland vegetation on the mainland as well as the island is typical of a maritime shrub
thicket with various grasses and red cedar JuniMrus vir ing iana dominant. Around most of the
island, between high ground and Coastal Wetlands is a narrow 404 jurisdictional wetland area
dominated by groundsel tree Baccharis halimifolia. The mainland side is semi-developed with
several houses adjacent the 40' access easement. The island is currently in its natural and
undeveloped state. "Southward Creek" is classified SA by the Division of Environmental
Management. The area is closed to shellfishing by Shellfish Sanitation and is not classified as
a Primary Nursery Area.
PROJECT DESCRIPTION
The applicant proposes to provide access to an island by constructing a 202' long by 17' wide
salt-treated timber bridge over Southward Creek. The proposal calls for an 18-foot wide center
span bridge with a 12' vertical clearance at mean high tide. The bridge is to be located at the `
end of an existing deeded private right-of-way and will cross "Southward Creek" to a 40'
easement on the island. Four 3-pile dolphin clusters will be placed adjacent the bridge
protecting the center span. Additional upland development outside the estuarine shoreline
involves construction of a 910' long X 20' wide road, installation of a central collection system
involving three nitrification fields measuring 50' X 70', 40' X 90', and 30' X 130'. The 6-acre
tract has been subdivided into nine residential lots. No dredging either prior to or during
construction of the bridge is proposed.

ANTICIPATED IMPACTS
The project as proposed would span approximately 3466 fe of Public Trust Area/Estuarine
Waters. Navigability previously restricted primarily by shallow water ranging from -2.5' to
3.5' MHW upstream of the bridge area will now have the additional physical limitation of an
18' wide by 12' high opening. All filling activities will occur outside coastal and 404 wetlands.
The narrow fringe of coastal wetlands along both approaches are to be bridged, thus there will
be no direct impact and only limited indirect impacts due to shading. Temporary construction
impacts would be associated with the driving of the pilings and would result in a localized,
short-term increase in turbidity. Since the proposed construction technique is from barge based
equipment, the greater impact although limited in duration to the construction period, may be
from bringing equipment (i.e. barges and tugs) into the small creek. Ancillary activities
including the construction of the road bed and nitrification fields will be outside the 75'
Estuarine Shoreline.

3a. The proposed development activities will include constructing a
202' long 17' wide salt-treated timber bridge with a center span
18' wide and 12' off the water at high tide. The center span will
be protected by four 3-pile dolphin clusters, consisting of three
12"x30' slat-treated pilings located 3' off both sides of the
bridge 18' apart. The dolphin clusters will be illuminated according
to Coast Guard recommendations. The bridge will be built to NCDOT
18,000 lb. axle load specifications.
The bridge and associated utilities and road will be built with
pilings and lumber transported via the Hatteras Ferry on flat-bed
trucks. Clay,stone, and marl will be trucked from Martin Marietta
in New Bern,.NC via the Cedar Island Ferry. Material and land-
based equipment will be parked and stored on a lot owned by the
project owner and located adjacent to the right-of-way designated
on the attached plat.
All construction and fill activity will occur outside of the ACOE
404 and CAMA wetlands and will be serarated by a silt fence. All
land based construction will be from existing right-of-way and
span fringe wetlands using a rubber tire crane. Pile driving will
be done from a barge anchored in Southward Creek off shore of the
fringe wetlands. At no time will equipment or material be located
within the ACOE 404 or CAMA wetlands. No dredging will be required
to facilitate construction of this bridge.
The bridge will be located at the end of an existing deeded private
right-of-way in use at this time(referenced in the attached deeds
and shown on the attached plat) and continue across Southward Creek
to a private 40' easement which will be surfaced with river rock
over clay to provide access to the subject property.
The subject property is approximately 6 acres which has been sub-
divided into 9 single family residential lots varying in size from
12,000to 42,000 sq.ft. This 9 lot subdivision will be known as
Egret's Nest and has received septic approval from the Hyde County
Health Department for 9 four-bedroom residences serviced by 3 1440
GPD LPP Systems. Water service will be provided by the Ocracoke
Sanitary District via 9 meters which have been purchased.
4g. The detail of the Ocracoke Land Classification Map is not of such precision and/or scale to take
into consideration high ground or upland areas that are surrounded by "wetlands" designated as
conservation. Therefore, the high ground area for planned development is shown in the conser-
vation class. However, based upon the definition of "Rural Class" on page 2 section III of the
Hyde County Land Use Plan, I conclude that the proposed upland development is consistent with
their definition of "Rural Class."

I have reviewed the information on the subject project sent to you by Mr. Warren
Everhart. The information submitted by Mr. Everhart does not adequately address the issues
raised in my letter to Mr. Everhart dated July 28, 1993 (attached). Specifically the map
submitted by Mr. Everhart does not identify the mean high water line or the landward limit of
Spartina alterniflora. Also, the submittal does not include a statement from the Hyde County
Departmental of Health that the proposed wastewater treatment system complies with all state
and county regulations.
The Division cannot issue a statement concerning the impact of this project on water
quality until the above information has been submitted and reviewed. Therefore I request that
the project remain "on hold" until the information has been submitted. If you have any
questions concerning this matter please contact me or Deborah Sawyer in the Washington
Regional Office.

information.
1) A map showing the location of the mean high water line.
This line can be determined by locating the landward limit
of Spartina alternaflora. All wastewater disposal fields
including repair areas must be a minimum of 100 feet from
this.line.
2) A statement from the Hyde County Department of Environmental
Health that the wastewater treatment systems meet all state
and county regulations.
3) A Stormwater Management Plan. This Plan should be submitted
to Bill Moore in the Washington Regional office.

Subdivisio on 15 June 1993. Although both areas of higher ground (island and
mainland) e fringed by high marsh (Juncus roemerianus) the high marsh quickly
gives way t a larger exposure of Spartina alterniflora interspersed with smaller
concentrat' ns of Salicornia. S ap rtina a. is a low marsh plant species, the
vegetative indicator of mean high water and considered as Section 10 waters,
waters of a U.S. by the Army Corps of Engineers. The greater percentage of the
marsh bet en the two areas of higher ground is vegetated with Spartina
Alterniflo ' There was a series of tidal pools or ponds in the alterniflora
marsh, mor or less in a meandering line between the headwaters of the two
creeks, on on each side of the island. Marsh species and marine life such as
Fiddler cr s, marsh snails, etc. indicate this marsh is being inundated on a

disturbanc such as roads, piers, docks, etc. in this estuary.

PROJECT SETTING
The applicant owns a six-acre tract of land that is bordered to the north by the Pamlico Sound,
to the west by a creek locally called "Southward" or "Tolson's Creek", to the east by an
unnamed creek, and to the south by an extensive intertidal marsh. There is a deeded easement
or right-of-way on the mainland. The project is located in the Upland Trent Subdivision of
Ocracoke Village in Hyde County, North Carolina at the end of SR 1356. The project site is
located approximately 0.25 miles upstream from the mouth of "Southward Creek". The creek
is approximately 200' in width at the mouth, 170' at the project site, and quickly narrows down
to 30'-40' wide at its" upper end. A 200' long by 25' wide by -4.5' deep channel was recently
dredged through a natural sand shoal near the mouth of the creek thus connecting it through
another channel to the deeper waters of the Pamlico Sound. Water depth averages between 2.5'
and 3.5' below MHW along the remainder of the creek. On the mainland side of the creek there
is a 10'-20' fringe of coastal wetlands dominated by black needlerush Juncus roemerianus. Salt
meadow grass SSpartina a? tens, smooth cordgrass S. alterniflora, salt grass Distichlis s in cats, and
glasswort alicornia spp. are also present. Bordering the island on the east side of the creek is
a narrow fringe (6'-8') of black needlerush, salt meadow grass, and smooth cordgrass. The
natural upland vegetation on the mainland as well as the island is typical of a maritime shrub
thicket with various grasses and red cedar uni rus vir ing ian a dominant. Around most of the
island, between high ground and Coastal Wetlands is a narrow 404 jurisdictional wetland area
dominated by groundsel tree Baccharis halimifolia. The mainland side is semi-developed with
several houses adjacent the 40' access easement. The island is currently in its natural and
undeveloped state. "Southward Creek" is classified SA by the Division of Environmental
Management. The area is closed to shellfishing by Shellfish Sanitation and is not classified as
a Primary Nursery Area.
PROJECT DESCRIPTION
The applicant proposes to provide access to an island by constructing a 202' long by 17' wide
salt-treated timber bridge over Southward Creek. The proposal calls for an 18-foot wide center
span bridge with a 12' vertical clearance at mean high tide. The bridge is to be located at the
end of an existing deeded private right-of-way and will cross "Southward Creek" to a 40'
easement on the island. Four 3-pile dolphin clusters will be placed adjacent the bridge
protecting the center span. Additional upland development outside the estuarine shoreline
involves construction of a 910' long X 20' wide road, installation of a central collection system
involving three nitrification fields measuring 50' X 70', 40' X 90', and 30' X 130'. The 6-acre
tract has been subdivided into nine residential lots. No dredging either prior to or during
construction of the bridge is proposed.

ANTICIPATED IMPACTS
The project as proposed would span approximately 3466 fe of Public Trust Area/Estuarine
Waters. Navigability previously restricted primarily by shallow water ranging from -2.5' to -
3.5' MHW upstream of the bridge area will now have the additional physical limitation of an
18' wide by 12' high opening. All filling activities will occur outside coastal and 404 wetlands.
The narrow fringe of coastal wetlands along both approaches are to be bridged, thus there will
be no direct impact and only limited indirect impacts due to shading. Temporary construction
impacts would be associated with the driving of the pilings and would result in a localized,
short-term increase in turbidity. Since the proposed construction technique is from barge based
equipment, the greater impact although limited in duration to the construction period, may be
from bringing equipment (i.e. barges and tugs) into the small creek. Ancillary activities
including the construction of the road bed and nitrification fields will be outside the 75'
Estuarine Shoreline.

3a. The proposed development activities will include constructing a
202' long 17' wide salt-treated timber bridge with a center span
18' wide and 12' off the water at high tide. The center span will
be protected by four 3-pile dolphin clusters, consisting of three
12"x30' slat-treated pilings located 3' off both sides of the
bridge 18' apart. The dolphin clusters will be illuminated according
to Coast Guard recommendations. The bridge will be built to NCDOT
18,000 lb. axle load specifications.
The bridge and associated utilities and road will be built with
pilings and lumber transported via the Hatteras Ferry on flat-bed
trucks. Clay,stone, and marl will be trucked from Martin Marietta
in New Bern, NC via the Cedar Island Ferry. Material and land-
based equipment will be parked and stored on a lot owned by the
project owner and located adjacent to the right-of-way designated
on the attached plat.
All construction and fill activity will occur outside of the ACOE
404 and CAMA wetlands and will be serarated by a silt fence. All
land based construction will be from existing right-of-way and
span fringe wetlands using a rubber tire crane. Pile driving will
be done from a barge anchored in Southward Creek off shore of the
fringe wetlands. At no time will equipment or material be located
within the ACOE 404 or CAMA wetlands. No dredging will be required
to facilitate construction of this bridge.
The bridge will be located at the end of an existing deeded private
right-of-way in use at this time(referenced in the attached deeds
