Preston Howard, Jr., RE., Director ILF.WMA ?EHNR August 26, 1994 Forsyth County DEM Project # 94707 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS TPI Restaurants, Inc. 2091 Peters Creek Parkway Winston-Salem, N.C. 27107 Dear Sirs: FILE COPY You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of bank stabilization and dredging at 2091 Peters Creek Parkway, as you described in your application dated 1 August 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2665 and 2733. These certifications allow you to use Nationwide Permit Numbers 13 and 18 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional conditions are that 1) the City of Winston-Salem and DOT shall be contacted prior to construction to be sure that this work will not affect the Peters Creek Parkway bridge, 2) the stream should be widened and deepened as much as feasible without creating unstable slopes and 3) edges of the new channel shall be planted with native tree species such as black willow and sycamore. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733- 1786. The northern portion will require removal of a sand bar and the southern portion will require hardening of the steep bank next to the parking lot with geotextile fabric and Class I riprap. In addition, 3' diameter boulders will be placed at the base of the slope below the parking lot in the stream. The parking lot is in danger of significant failure due to previous filling with unsuitable materials, severe slope and flood water dynamics. The following conditions should be considered for this site: 1. The site should be thoroughly reviewed with City of Winston-Salem utilities/inspections departments. All other public utilities having influences within the scope of this site should also be consulted. C,,'2. Both City and NC DOT should agree that this project does not cause any unacceptable risk for the bridge immediately downstream on Peters Creek Parkway. (3) The stream should be widened (and possibly deepened) as much as possible without creating steep slopes in .? order to provide for high water flow dispersion. 4. All bank slopes should be no greater than 50% v (less preferred) in order to reduce erosion and enhance flood water dispersion. (Present slope is about 90% and may have been about 80% prior to slope failure. Stream appears to have been previously impacted.) 0 The edges on each side of the stream should receive heavy plantings of native species (black willow and/or sycamore). Transplanting 12' trees from the sandbar to the opposite bank is possible and probably feasible. 6. Riprap wing walls could be beneficial and should be considered and provided, if appropriate. 7. A complete plan should be submitted to the Division prior to work commencing. 8. Standard NWP conditions should be incorporated in the site plan and sediment control measures. ew 6?- Y?
