The purpose of this Public Notice is outlined below. This notice is available electronically at

I. Public Notice and Notice of Public Hearing on September 5, 2019 for Cashiers Canoe Club
Development LLC — Cashiers Canoe Club Development Water Quality Certification; DWR

PUBLIC NOTICE is hereby given that on April 12, 2019, Cashiers Canoe Club Development,
LLC (PO Box 300849, Austin TX 78703) applied to the N.C. Division of Water Resources
(DWR) for a 401 Water Quality Certification, pursuant to Section 401 of the Federal Clean
Water Act and Title 15A NCAC 02H .0500. A public notice was previously issued by the U.S.
Army Corps of Engineers on May 9, 2018; the project has been revised since that notice was
published. The activity for which this certification is sought is to permanently impact 7.13
acres of 404 jurisdictional wetlands and 4.73 acres of open waters, associated with the
Cashiers Lake Dredge and Development Project in Cashiers, Jackson County. DWR must
take final action on the application prior to December 6, 2019.
The public is hereby notified that DWR will hold a public hearing at 6 p.m. on Thursday,
September 5, 2019 at the Albert Carlton -Cashiers Community Library at 249 Frank Allen
Road, Cashiers, NC. Sign -in and speaker registration will begin at 5:30 p.m. The purpose of
this public hearing is to allow interested persons to submit oral and/or written comments
regarding the 401 Water Quality Certification application submitted to DWR.

The public is also invited to comment in writing on the application. Written comments must
be received by DWR no later than 5 p.m. on Monday, October 7, 2019. Mail written
comments to: 401 Permitting, 1617 Mail Service Center, Raleigh, NC, 27699-1617. Written
comments may also be submitted via email to: PublicComments@ncdenr.gov, (include
"Cashiers Canoe Club" in the email's subject line).
The application is available online at:

application is also available at the DWR Asheville Regional Office (2090 U.S. 70 Highway
Swannanoa, NC 28778) and may be inspected with an appointment between 8 am and 5
pm, Monday through Friday, excluding State holidays. For questions or to schedule an

from any DWR office; copy machines are available for use upon payment of the cost thereof
to DWR pursuant to G.S. 132-6.2.
II. Bynum Hydroelectric Project FERC No. P-14858; McMahan Hydroelectric, LLC; DWR #2015-
0124; Chatham County
PUBLIC NOTICE is hereby given that McMahan Hydroelectric, LLC has applied to DWR for a
401 Water Quality Certification, pursuant to Section 401 of the Federal Clean Water Act and
Title 15A NCAC 02H .0500. The certification is required as part of the Federal Energy
Regulatory Commission (FERC) relicensing process for license No. P-14858. The DWR must
take final action on the application prior to September 21, 2019.
The public is invited to comment in writing on the application. Written comments must be
received by DWR no later than 5 p.m. on August 28, 2019. Mail written comments to: 401
Permitting, Attn: Chonticha McDaniel, 1617 Mail Service Center, Raleigh, NC 27669-1617.

III. Adopted Water Quality Certification and Isolated Wetlands/Waters Rules
Updates to the Water Quality Certification Rules [15A NCAC 02H .0501,.0502Y .0503, .05041
.0507] and the Isolated Wetlands/Waters Rules [15A NCAC 02H .13011.13021.1303Y .1304]
became effective June 1, 2019. These rules are available online:
