Dear Mr. Hollis:
In accordance with your application received August 18, 2017, we are forwarding herewith Permit No.
WQ0028587 dated September 12, 2017 to the Town of Leland (Permittee) for the construction and
operation upon certification of the subject wastewater collection system extension. This permit shall be
effective from the date of issuance until rescinded, shall void Permit No. WQ0028587 issued January 19,
2017, and shall be subject to the conditions and limitations as specified therein. This cover letter shall be
considered a part of this permit and is therefore incorporated therein by reference.
This modification adds gravity sewer to serve 75 three -bedroom residences in Phase 9 Section 5.
Please pay particular attention to the following conditions contained within this permit:
Special Conditions:
Condition 1.1: This permit shall become voidable unless the agreement between the Town of Leland
and Brunswick County forthe collection and final treatment of wastewater is in full force
and effect. [15A NCAC 02T.0304(h)]
Condition 1.2: Each pump station shall be clearly and conspicuously posted using a weatherproof sign
with a pump station identifying name/number, address, 24-Hour Emergency telephone
number, and name of the owner/operator of the sewer system/pump station and
instructions to call the number in the event of alarm activation or other emergency.
Simplex pump stations or vacuum sewer pits serving a single-family residence may have
a placard or sticker on the control panel in lieu of a sign. [15A NCAC 02T .0305(h)(2)]

Standard Conditions:
Condition 11.1: This permit shall not be automatically transferable; a request must be made and
approved.
Condition 11.4: Requires that the wastewater collection facilities be properly operated and maintained
in accordance with 15A NCAC 2T .0403 or any individual system -wide collection system
permit issued to the Permittee.
It shall be responsibility of the Permittee to ensure that the as -constructed project meets the appropriate
design criteria and rules. Failure to comply may result in penalties in accordance with North Carolina
General Statute §143-215.6A through §143-215.6C, construction of additional or replacement
wastewater collection facilities, and/or referral of the North Carolina -licensed Professional Engineer to
the licensing board.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150E of North Carolina General
Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. Unless such demands are made, this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations, permission is hereby granted to the
TOWN OF LELAND
BRUNSWICK COUNTY
for the construction and operation upon certification of approximately 3,599 linear feet of 8-inch gravity
to serve 75 three -bedroom residences as part of the Phase 9 Section 5 project, and the discharge of 15,750
gallons per day of collected domestic wastewater into the Town of Leland's existing sewerage system,
pursuant to the application August 18, 2017 and in conformity with 15A NCAC 2T; the Division's Gravity
Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design
Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as
applicable; and other supporting data subsequently filed and approved by the Department of
Environmental Quality and considered a part of this permit.

For the continued construction and operation upon certification of approximately 4,124 linear feet of 8-
inch and 1,195 linear feet of 10-inch gravity sewer; a 372—gallon per minute pump station (#7) with duplex
pumps, on -site audible and visual high water alarms, telemetry, and a permanent generator with
automatic transfer switch or an automatically activated stand-by bypass pump as well as approximately
2,210 linear feet of 6-inch force main to directly serve 88 three -bedroom residences and the discharge of
18,480 gallons per day of collected domestic wastewater plus flow from the system below and future
service areas;
For the continued construction and operation upon certification of approximately 4,815 linear feet of 8-
inch gravity sewer; a 53—gallon per minute pump station (#8) with duplex pumps, on -site audible and
visual high water alarms, telemetry, and a permanent generator with automatic transfer switch or an
automatically activated stand-by bypass pump as well as approximately 1,350 linear feet of 3-inch force
main to serve 112 three -bedroom residences and the discharge of 23,520 gallons per day of collected
domestic wastewater;
Both systems described above are associated with the Phase 9 Section 3 project discharging into the Town
of Leland's existing sewerage system, pursuant to the application received December 19, 2016 and
additional information received on January 11" and 181", 2017.

September 14, 2016 Modification (Version 4.2)
For the continued operation of approximately 1,560 linear feet of 8-inch to serve 28 three -bedroom
single-family residences as part of the Phase 1 Section 5 project, and the discharge of 5,880 gallons per
day of collected domestic wastewater into the Town of Leland's existing sewerage system, pursuant to
the application received August 10, 2016. This system was certified complete on January 5, 2017.
April 14, 2016 Modification (Version 4.1)
For the continued construction and operation upon certification of approximately 4,423 linear feet of fl-
inch and 154 linear feet of 12-inch gravity sewer to serve 80 three -bedroom single-family residences as
part of the Phase 3 Section 3 project, and the discharge of 16,800 gallons per day of collected domestic
wastewater into the Town of Leland's existing sewerage system, pursuant to the application received
March 11, 2016.
October 26, 2015 Modification (Version 4.0)
For the continued construction and operation upon certification of approximately 5,390 linear feet of 8-
inch gravity sewer; a 52-gallon per minute pump station with 1,210 linear feet of 4-inch force main to
serve 119 three -bedroom single-family residences as part of the Phase 5 Section B-1 project, and the
discharge of 24,990 gallons per day of collected domestic wastewater into the Town of Leland's existing
sewerage system, pursuant to the application received September 10, 2015. Pump station and force
main certified complete on May 24, 2016.
August 3, 2015 Modification (Version 3.9)
For the continued construction and operation upon certification of approximately 6,147 linear feet of 8-
inch, 1,201 linear feet of 10-inch, and 538 linear feet of 12-inch gravity sewer; a 108-gallon per minute
pump station with 722 linear feet of 6-inch force main to serve 220 three -bedroom single-family
residences as part of the Phase 2 Section 4 project, and the discharge of 46,200 gallons per day of
collected domestic wastewater into the Town of Leland's existing sewerage system, pursuant to the
application received July 9, 2015.
June 2, 2015 Modification (Version 3.8)
For the continued operation of approximately 4,534 linear feet of 8-inch and 1,326 linear feet of 12-inch
gravity sewer to serve 101 three -bedroom single-family residences and 30 duplex units as part of the
Phase 2 Section 3 project, and the discharge of 27,510 gallons per day of collected domestic wastewater
into the Town of Leland's existing sewerage system, pursuant to the application received April 22, 2015
and additional information received on June 1, 2015. This system was certified as complete on February
11, 2016.
January 15, 2015 Modification (Version 3.7)
For the continued construction and operation upon certification of approximately 3,217 linear feet of 8-
inch gravity sewer to serve 44 three -bedroom homes as part of the Phase 2 Section 5 (Tennyson Village)
project, and the discharge of 9,240 gallons per day of collected domestic wastewater into the Town of
Leland's existing sewerage system, pursuant to the application received December 11, 2014. This system
was certified as complete on June 15, 2017.

For the continued operation of approximately 4,965 linear feet of 8-inch gravity sewer; a 90—gallon per
minute pump station with duplex pumps, on -site audible and visual high water alarms, telemetry, and a
permanent generator with automatic transfer switch as well as approximately 2,090 linear feet of 4-inch
force main to serve 96 three -bedroom single—family residences as part of the Brunswick Forest Phase 1
Section 4 project, and the discharge of 20,160 gallons per day of collected domestic wastewater into the
Town of Leland's existing sewerage system, pursuant to the application received April 15, 2014. This
system was certified as complete on March 17, 2015.
December 19, 2013 Modification (Version 3.5)
For the continued operation of approximately 1,766 linear feet of 8-inch gravity sewer to serve 43 three -
bedroom single-family residences as part of the Brunswick Forest Phase 1 Section 6B project, and the
discharge of 9,030-gallons per day of collected domestic wastewater into the Town of Leland's existing
sewerage system, pursuant to the application received November 21, 2013. This system was certified as
complete on August 6, 2014. -
October 9, 2013 Modification (Version 3.4)
For the continued operation of approximately 5,685 linear feet of 8-inch gravity sewer to serve 101 three -
bedroom single-family residences and 22 three -bedroom duplex units as part of the Brunswick Forest
Phase 2 Section 2 project, and the discharge of 25,830 gallons per day of collected domestic wastewater
into the Town of Leland's existing sewerage system, pursuant to the application received August 29, 2013
and additional information received on September 4, 2013. This system was certified as complete on
August 19, 2014.
March 6, 2013 Modification (Version 3.3)
For the continued construction and operation upon certification of approximately 208 linear feet of 8-inch
gravity sewer to serve a medical office on Lot 10 of the South Village commercial area as part of the South
Village Lot 10 project, and the discharge of 750 gallons per day of collected domestic wastewater into the
Town of Leland's existing sewerage system, pursuant to the application received January 24, 2013, and
additional information received on January 30, 2013.
March 21, 2012 Modification (Version 3.2)
For the continued operation of approximately 4,411 linear feet of 8-inch gravity sewer, to serve 87 three -
bedroom residences (18,270 gpd), 32 three -bedroom townhomes (6,720 gpd), and 4 buildings with a total
of 16 multi -family units (3,360 gpd) as part of the Brunswick Forest Phase 2B Section 1 project, and the
discharge of 28,350 gallons per day of collected domestic wastewater into the Town of Leland's existing
sewerage system, pursuant to the applications received March 5, 2012. This system was certified as
complete on March 24, 2014.
April 21, 2011 Modification (Version 3.1)
For the continued operation of approximately 679 linear feet of 8-inch gravity sewer, to serve 13 three -
bedroom residences (70 gpd/bedroom), as part of the Brunswick Forest Phase 1 Section 6A project, and
the discharge of 1,820 gallons per day of collected domestic wastewater into the Town of Leland's existing
sewerage system, pursuant to the applications received March 30, 2011. This system was certified as
complete on June 30, 2011.

For the continued operation of approximately 4,765linear feet of 12-inch gravity sewer, 13,696linear feet
of 8-inch gravity sewer; a 450—gallon per minute pump station with duplex pumps, on -site audible and
visual high water alarms, telemetry, and on -site generator with automatic transfer switch with
approximately 9,805 linear feet of 8-inch force main to serve 193 three -bedroom residences, maintenance
shed with wash bay (1,650 gpd), golf course restrooms (1,000 gpd), and a country club with food service
(7,440 gpd) as part of the Brunswick Forest Phase 3B & Country Club project, and the discharge of 50,620
(reduced from 79,570) gallons per day of collected domestic wastewater into the Town of Leland's existing
sewerage system, pursuant to the applications received January 26, and 27, 2009. This system was
certified complete on August 30, 2016.
February 6, 2009 Modification (Version 2.8)
For the continued operation of approximately 3,988 linear feet of 8-inch gravity sewer to 48 three -
bedroom residences and 72 two -bedroom residences as part of the Brunswick Forest Phase 1 Section 2
Village 2-A Sewer project, and the discharge of 20,160 (reduced from 34,560) gallons per day of collected
domestic wastewater into the Town of Leland's existing sewerage system, pursuant to the application
received January 9, 2009. This system was certified as complete on Mayo, 2009.
January 30, 2009 Modification (Version 2.7)
For the continued operation of approximately 13,192 linear feet of 8-inch gravity sewer, approximately
1,564 linear feet of 10-inch gravity sewer, approximately 2,531 linear feet of 12-inch gravity sewer; a 550—
gallon per minute pump station with duplex pumps, on -site audible and visual high water alarms,
telemetry, on -site generator with automatic transfer switch with approximately 10,325 linear feet of 10-
inch force main to serve 324 single-family three -bedroom lots as part of the Brunswick Forest Phase SA
and Phase 5 project, and the discharge of 68,040 (reduced from 116,640) gallons per day of collected
domestic wastewater into the Town of Leland's existing sewerage system, pursuant to the application
received December 22, 2008. This system was certified as complete on July 13, 2015.
October 17, 2008 Modification (Version 2.6)
For the continued operation of approximately 4,607 linear feet of 8-inch gravity sewer to serve as a gravity
sewer outfall or interceptor line for future upstream or tributary sewer systems as part of The Villages at
Brunswick Forest project with no additional discharge of collected domestic wastewater into Town of
Leland's existing sewerage system, pursuant to the application received September 26, 2008. This system
was certified as complete on December 8, 2008 & updated May 4, 2009.
August 1, 2008 Modification (Version 2.5)
For the continued operation of approximately 599 linear feet of 8-inch gravity sewer to serve a 3,511
gallons per day medical office building as part of the South Village Phase-1 project, and the discharge of
3,511 gallons per day of collected domestic wastewater into the Town of Leland's existing sewerage
system, pursuant to the application received June 19, 2008. This system was certified as complete on
May4, 2009.
July 18, 2008 Modification (Version 2.4)
For the continued operation of approximately 1,630 linear feet of 8-inch gravity sewer to serve a 49,170
sf Grocery Store (4,920 gpd), 84,370 sf of Retail Space with no food services (8,437 gpd), a 13,225 sf
Pharmacy (1,325 gpd), a 30 space Restaurant Drive-Thru (1,500 gpd) and a 50 seat Restaurant (2,000 gpd)
as part of the East Village Phase-1 project, and the discharge of 18,182 gallon per day of collected
domestic wastewater into the Town of Leland's existing sewerage system, pursuant to the application
received June 19, 2008. This system was certified as complete on September27, 2011.

For the continued operation of approximately 1,174 linear feet of 8-inch gravity sewer to serve 62 three -
bedroom and 10 two -bedroom residences as part of the Phase 1 Section 2 Village 4-A project, and the
discharge of 14,420 (reduced from 24,720) gallons per day of collected domestic wastewater into the
Town of Leland's existing sewerage system, pursuant to the application received September 18, 2007.
This system was certified as complete on July 31, 2008 and updated May 8, 2009.

For the continued operation of approximately 2,952 linear feet of 8-inch gravity sewer to serve 72 three -
bedroom residences as part of the Phase 1 Section 2 Village 1-A project, and the discharge of 15,120

sewerage system, pursuant to the application received July 25, 2007. This system was certified complete
on July 31, 2008.
June 8, 2007 Modification (Version 2.1)
For the continued operation of approximately 1,393 linear feet of 8-inch gravity sewer to serve Lots 1 & 2
for a bank with 10 employees (250 gpd) and an unspecified development on the other (will require
allocation to be added prior to connection) as part of the East Village Commercial Center project, and the
discharge of 250 gallons per day of collected domestic wastewater into the Town of Leland's existing
sewerage system, pursuant to the application received May 16, 2007. This system was certified as
complete on December 6, 2007.
April 20, 2007 Modification (Version 2.0)
For the continued operation of approximately 5,065 linear feet of 8-inch gravity sewer to serve 94 three -
bedroom single-family residences as part of the Brunswick Forest. Phase 1 Section 3 project, and the
discharge of 19,470 (reduced from 33,840) gallons per day of collected domestic wastewater into the
Town of. Leland's existing sewerage system, pursuant to the application received March 29, 2007. This
system was certified as complete on August 6, 2008.
April 13, 2007 Modification (Version 1.9)
For the continued operation of approximately 5,126 linear feet of 8-inch gravity sewer to serve 56 three -
bedroom single-family residences and 30 three -bedroom & 30 two -bedroom townhomes as part of the
Brunswick Forest Phase 6 Sections 1-B & 2 project, and the discharge of 22,260 (reduced from 38,610)
gallons per day of collected domestic wastewater into the Town of Leland's existing sewerage system,
pursuant to the application received March 9, 2007. This system was certified as complete on iVovember
30, 2007.
December 22, 2006 Modification (Version 1.8)
For the continued operation of approximately 13,874 linear feet of 8-inch gravity sewer; a 387—gallon per
minute pump station with duplex pumps, on -site audible and visual high water alarms, telemetry, and on -
site generator with automatic transfer switch; as well as approximately 3,520 linear feet of 6-inch force
main to serve 193 three -bedroom residences as part of the Brunswick Forest Phase 1 Section 2 project,
and the discharge of 40,530 (reduced from 69,480) gallons per day of collected domestic wastewater into
the Town of Leland's existing sewerage system, pursuant to the application received December 1, 2006.

For the continued operation of approximately 1,008 linear feet of 8-inch gravity sewer to serve future
development including a sales center & wellness facility in Brunswick Forest Phase 6 Section 1-A as part
of the Brunswick Forest project and the discharge of 800 gallons per day of collected domestic wastewater
into the Town of Leland's existing sewerage system, pursuant to the application received September 15,
2006. This system was certified as complete on June 15, 2007.
May 26, 2006 Modification (Version 1.5)
For the continued operation of approximately 5,926 linear feet of 8-inch gravity sewer; a 380—gallon per
minute pump station with duplex pumps, on -site audible and visual high water alarms, telemetry, and on -
site generator with automatic transfer switch; as well as approximately 3,915 (increased from 2,821 feet
Per modification issued November 3, 2006) linear feet of 6-inch force main to serve 149 three -bedroom
residences as part of the Jefferson Landing at Brunswick Forest Phase 2 (aka Phase 1 Section 1-B) project,
and the discharge of 31,290 (reduced from 53,640) gallons per day of collected domestic wastewater into
the Town of Leland's existing sewerage system, pursuant to the application originally received April 24,
2006 and subsequent modification request received September 25, 2006. This system was certified as
complete on March 27, 1007.
April 7, 2006 Modification (Version 1.4)
For the continued operation of approximately 793 linear feet of 10-inch, and 2,329 (reduced from 3,830)
linear feet of 12-inch gravity sewer to serve as a gravity sewer outfall or interceptor line for future
upstream or tributary sewer systems as part of the Brunswick Forest Phase 3A project with no additional
discharge of collected domestic wastewater into the Town of Leland's existing sewerage system, pursuant
to the application received February 16, 2006. This system was certified as complete on March 15, 2007.
March 10, 2006 Modification (Version 1.3)
For the continued operation of approximately 6,741 linear feet of 8-inch gravity sewer to serve 131 three -
bedroom residences as part of the Jefferson Landing at Brunswick Forest Phase 1 (aka Phase 1 Section
1-A) project, and the discharge of 27,510 (reduced from 47,160) gallons per day of collected domestic
wastewater into the Town of Leland's existing sewerage system, pursuant to the application received
February 14, 2006. This system was certified as complete on December22, 2006.
July 21, 2005 Modification (Version 1.2)
For the continued operation of approximately 25 linear feet of 8-inch and 3,290 linear feet of 12-inch
gravity sewer to serve as a gravity sewer outfall or interceptor line for future development upstream of
the previously approved sewer listed below as part of the Brunswick Forest Phase 2 project, and with no
additional discharge of collected wastewater into the Town of Leland's existing sewerage system,
pursuant to the application received June 15, 2005. This system was certified as complete on December
8, 2008.
March 24, 2005 Original Permit (Versions 1.0 & 1.1)
For the continued operation of approximately 868 linear feet of 8-inch, 3,414 linear feet of 10-inch, and
3,141 linear feet of 12-inch gravity sewer; a 1500—gallon per minute pump station with duplex pumps, on -
site audible and visual high water alarms, telemetry/autodialer, and on -site generator with automatic
transfer switch; as well as approximately 20,650 total linear feet of 10-inch force main (dual force mains)
to serve this large residential and commercial development as part of the Brunswick Forest Phase 1
project with no discharge of wastewater into the Town of Leland's existing sewerage system, pursuant to
the application received March 11, 2005. This system was certified as complete on March 15, 2007.

From the original permit 25,257 gpd of commercial flow allocation remains in reserve from the October
17, 2008 modification.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the specified
conditions and limitations contained therein.

SUPPLEMENT TO PERMIT COVER SHEET
TOWN OF LELAND is hereby authorized to:
Construct, and then operate upon certification the aforementioned wastewater collection extension. The
sewage and wastewater collected by this system shall be treated in the NE Brunswick Regional
Wastewater Treatment Facility in accordance with Permit Number NC0086819.
Permitting of this project does not constitute an acceptance of any part of the project that does not meet
15A NCAC 2T; the Division of Water Resources' (Division) Gravity Sewer Minimum Design Criteria adopted
February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast -Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically mentioned
herein. Division approval is based on acceptance of the certification provided by a North Carolina -licensed
Professional Engineer in the application. It shall be the Permittee's responsibility to ensure that the as -
constructed project meets the appropriate design criteria and rules.
Construction and operation is contingent upon compliance with the Standard Conditions and any Special
Conditions identified below.
SPECIAL CONDITIONS

Il. STANDARD CONDITIONS
This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be considered
on its merits and may or may not be approved. [15A NCAC 02T.0104; G.S 143-215.1(d3)]
2. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T; the Division's Gravity Sewer Minimum
Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for
the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and

3. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data. [15A NCAC 02T .0110]
4. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system -wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required, the following performance criteria shall be met: [15A NCAC 02T .0108(b)]
a. The sewer system shall be effectively maintained and operated at all times to prevent discharge
to land or surface waters, and to prevent any contravention of groundwater standards or surface
water standards.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency, preventative
maintenance schedule, spare parts inventory and overflow response has been developed and
implemented.
d. Pump stations that are not connected to a telemetry system shall be inspected every day (i.e. 365
days per year). Pump stations that are connected to a telemetry system shall be inspected at
least once per week.
e. High -priority sewer lines shall be inspected at least once per every six -months and inspections are
documented.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance
with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina
General Statute §143-215.1C.
h. A Grease Control Program is in place as follows:
1. For public owned collection systems, the Grease Control Program shall include at least
biannual distribution of educational materials for both commercial and residential users and
the legal means to require grease interceptors at existing establishments. The plan shall also
include legal means for inspections of the grease interceptors, enforcement for violators and
the legal means to control grease entering the system from other public and private satellite
sewer systems.
2. For privately owned collection systems, the Grease Control Program shall include at least bi-
annual distribution of grease education materials to users of the collection system by the
permittee or its representative.
3. Grease education materials shall be distributed more often than required in Parts (1) and (2)
of this Subparagraph if necessary to prevent grease -related sanitary sewer overflows.
i. Right-of-ways and easements shall be maintained in the full easement width for personnel and
equipment accessibility.
j. Documentation shall be kept for Subparagraphs (a) through (i) of this Rule for a minimum of three
years with exception of the map, which shall be maintained for the life of the system.

5. Noncompliance Notification:
The Permittee shall report by telephone to a water resources staff member at the Wilmington
Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than 24
hours or on the next working day, following the occurrence or first knowledge of the occurrence of
either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any SSO and/or spill over 1,000 gallons; or
c. Any SSO and/or spill, regardless of volume, that reaches surface water
Voice mail messages or faxed information is permissible, but this shall not be considered as the initial
verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number (800) 858-0368 or (919) 733-3300.
Persons reporting any of the above occurrences shall file a spill report by completing and submitting
Part I of Form CS-SSO (or the most current Division approved form) within five days following first
knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to
ensure that the problem does not recur. Part II of Form CS-SSO (orthe most current Division approved
form) can also be completed to show that the SSO was beyond control. [G.S. 143-215.1C(al)]
6. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State. [15A NCAC 02T.0108(b)]
Upon completion of construction and prior to operation of these permitted facilities, the completed
Engineering Certification form attached to this permit shall be submitted with the required supporting
documents to the address provided on the form. A complete certification is one where the form is
fully executed and the supporting documents are provided as applicable. Any wastewater flow made
tributary to the wastewater collection system extension prior to completion of this Engineer's
Certification shall be considered a violation of the permit and shall subject the Permittee to
appropriate enforcement actions.
If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles
of Incorporation, Declarations/Covenants/Restrictions, and Bylaws that have been appropriately
filed with the applicable County's Register of Deeds office shall be submitted with the certification.
A complete certification is one where the form is fully executed and the supporting documents are
provided as applicable. Supporting documentation shall include the following:
a. One copy of the project construction record drawings (plan & profile views of sewer lines & force
mains) of the wastewater collection system extension. Final record drawings should be clear on
the plans or on digital media (CD or DVD disk) and are defined as the design drawings that are
marked up or annotated with after construction information and show required buffers,
separation distances, material changes, etc.
One copy of the supporting pump station design calculations (selected pumps, system curve,
operating point, buoyancy calculations, and available storage if portable generator(s) or storage
greater than longest past three year outage reliability option selected) for any pump stations
permitted as part of this project.

c. Changes to the project that do not result in non-compliance with this permit, regulations, or the
Minimum Design Criteria should be clearly identified on the record drawings, on the certification
in the space provided, or in written summary form.
Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (including pipe length increases of 10% or greater, increased flow,
pump station design capacity design increases of 5% or greater, and increases in the number/type of
connections), regulations, or the Minimum Design Criteria. Requested modifications or variances to
the Minimum Design Criteria will be reviewed on a case -by -case basis and each on its own merit.
Please note that variances to the Minimum Design Criteria should be requested and approved during
the permitting process prior to construction. After -construction requests are discouraged by the
Division and may not be approved, thus requiring replacement or repair prior to certification &
activation. [15A NCAC 02T .0116]
Gravity sewers installed greater than ten percent below the minimum required slope perthe Division's
Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until
corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting documentation.
This shall be done through a permit modification with fee. Such variance requests will be evaluated
on a case -by -case basis. Resolution of such request shall be evident prior to completing and submitting
the construction certification. [ 15A NCAC 02T.0105(n)]
9. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of
the wastewater collection facilities. [15A NCAC 02T .0116]
10. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the Division's
Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design
Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as
applicable; and other supporting materials may subject the Permittee to an'enforcement action by
the Division, in accordance with North Carolina General Statutes §143-215.6A through §143-215.6C,
construction of additional or replacement wastewater collection facilities, and/or referral of the North
Carolina -licensed Professional Engineer to the licensing board. [15A NCAC 02T .0104; 15A NCAC 02T
.0108(b-c)]
11. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement facilities.

12. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by the Division any other Federal, State, or Local

b. The rate of activation of this obligated, not yet tributary capacity is currently approximately
0.035 MGD per year; and that
c. A funded Capital Project that will provide the required planned capacity, namely
US 17 Corridor Force Main is in design or under construction with
planned completion in 2016/2017 Budget ; and/or
d. The following applies:
The Town of Leland has a 5 year capital project plan which contains the
recommended plan's and funding for the project. This plan is designed to
take the current and furthure flow from Lift Station # 18 and pump directly
into the Towns Lift Station # 10 which will bypass Lift Station #1
and Lift Station # 3 and flow directly to the Northeast Regional Treatment Plant.
The permit has been received and the bidding process has taken place and the bids received
has been rejected and are going out for rebid.
The construction is projected to begin around August 2017
Therefore:
Given reasonably expected conditions and planning information, there is sufficient justification to
allow this flow to be permitted, without a significant likelihood of over -allocating capacity in the
system infrastructure.
I understand that this does not relieve the collection system owner from complying with G.S. 143-
215.67(a) which prohibits the introduction of any waste in excess of the capacity of the waste
disposal system.

This project is for the construction of a new residential community of 75 single-family
homes (an additional development Phase) on an existing tract in the previously approved
development of "Brunswick Forest" off of proposed Colony Pines Drive in the Town of
Leland, Brunswick County, NC. The proposed subdivision has been designed and
planned to comply with all the Town's required setbacks and technical standards for
construction.
Sewer flows will drain into an existing public 10" gravity collector in Colony Pines
Drive. All runoff will drain into proposed storm sewers and into proposed wet retention /
detention ponds within the limits of the project or to an existing permitted and certified
stormwater wet retention / detention pond. Water will be provided by connection to the
existing 12" public main also in Colony Pines Drive.
