Box 13358 Research Triangle Park, N.C. 27707 Dear Sirs: You have our approval to place fill material in 0.1 acres of wetlands or waters for the purpose of Modifications to existing pond at Southern High School renovation/Glaxo, as you described in your application dated 11 May, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter.. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dear Mr. Dorney: This transmits a revised plan for the referenced site. As you will recall, we previously requested a 401 Water Quality Certification for fill in 0.6 acres of wetlands and waters in order to reconstruct a small pond at the site. Upon further consideration, the pond will remain as part of the finished site plan, with some modifications to the dam and spillway. The planned modifications will upgrade the structural and functional quality of the dam and spillway but will not affect the normal pool elevation or the horizontal configuration of the pond. We believe that the planned work can be accomplished under a Nationwide Permit No. 3: Maintenance. Please reference the accompanying plan and comments from Heery International, Inc., the site planners. Inasmuch as the total planned impact to wetland and waters is now < 1/3 acre and involves a Nationwide No. 3 permit, we understand that there is not a present need for written concurrence from your office. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2671. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 26. This action completes DEM's review under Section 401 of the Clean Water Act. Final written approval for the stormwater pond design must be obtained from DEM. If this Certification-is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. Alsmeyer and Dorney: 13;R , 9 j5 i% The purpose of this letter is to request a Sect' Quality Certification for a project known as th High School Renovation/Glaxo site. This also s ves as notification to the Corps of Engineers (COE) of the client's intent to fill/impact <1 acre under a Nationwide 26 general authorizaton. The site is in southern Durham County, North Carolina, southwest of the intersection of Ellis Road and SO- HI Drive. The site is the old Southern High School property, now being renovated and developed as part of the Glaxo complex, located south of this site. The COE approved wetland delineation accompanies this letter. Wetland delineations were reviewed by Mr. Eric Alsmeyer of the Army Corps of Engineers. The area to be impacted is an old retention pond constructed primarily in upland and a portion of the channel of an intermittent drain which is an outfall of this pond. Fill in wetlands/waters will be required in order to construct an access road and detention basin (see accompanying plans). The pond will be drained and the area reconstructed, resulting in an impact of 0.60 acres of jurisdictional wetlands/waters. This impact is in addition to a 0.31 acre impact on Glaxo property, a result of the development of the nearby Glaxo child care facility. The total cumulative impact, after this project is complete, would therefore be 0.91 acres. Since this impact is greater than 1/3 acre but less than 1.0 acre we are requesting the required 401 Water Quality Certification and notifying the Corps of the client's intent.
