Hanes Mill Rd, Suite 300 Winston Salem, North Carolina 27105 Re: Request for Additional Information - Publix Distribution Center - (DWR: 20190289 & USACE: SAW-2018-00240) Mr. Bailey & Ms. Homewood, Please find responses to the items requested by the North Carolina Division of Water Resources (DWR) in an Additional Information Request Letter dated March 28, 2019 and by the U.S. Army Corps of Engineers (USACE) in an email dated April 22, 2019 in association with a Request for Additional Information for the Individual Permit issuance for the Publix Distribution Center project located in Guilford County, North Carolina. Comments below from the DWR (in black) with responses (in red): 1) In accordance with 15A NCAC 02H .0502(c), if the U.S. Army Corps of Engineers requests a response to any comments received as a result of the Public Notice, please provide the Division with a copy of your response to the USACE. A copy of the responses to the USACE is provided herein to the North Carolina Division of Water Resources (DWR). A copy of any additional comments received as a result of the Public Notice and associated responses will be provided to the Division. 2) In accordance with 15A NCAC 02H .0506(b)(4), please provide a qualitative indirect and cumulative impact analysis for the project. A detailed qualitative indirect and cumulative impact (ICI) analysis as outlined in the DWQ Cumulative Impact Policy guidance (April 10, 2004) is included as Attachment 4. 3) In accordance with 15A NCAC 02H .0502(b), please provide detailed site plans at a scale of no smaller than 1” =50’ with topographic contours shown. These drawings must include clear impact drawings and/or insets that include all permanent fill and any temporary fill shown as hatching or color coded. Detailed site plans are included as Attachment 1. Wetland Impacts Exhibits at a scale of Page 2 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES no smaller than 1” = 50’ with topographic contours are included in Attachment 2. 4) It is unclear from the scale of the drawings and lack of comparable information on the exhibits as to whether the applicant ’s On-Site Alternative Analysis provides similarly size alternatives and therefore demonstrates adequate Avoidance and Minimization. Please provide more clarity regarding the On-Site Alternatives. In particular, please clearly show that each alternative is of similar size/capacity of warehouse space, parking, and associate features as proposed in the preferred alternative. Please see Alternative 1 and Alternative 2 in Attachment 5 for the applicant’s on-site alternatives analysis. Due to the fact that all facilities need to be located on the same campus to reduce the infrastructure required, assure operational efficiencies, and operational safety the facility layout is fixed. Based on these constraints two on-site alternatives are feasible. 1. Alternative 1 (East/West Configuration): This alternative depicts an east to west orientation with 3 access locations along NC RT 70, Burlington Road. This orientation would require permanent impacts to 7,154 lf of stream and 5.1 acres of wetland impacts. This represents an increase in impacts to the preferred alternative of 2.5 acres of wetlands and 2,672 lf of stream. Therefore, this alternative cannot be characterized as the least environmentally damaging practical alternative (see Attachment 5). 2. Alternative 2 (North/South Configuration): In an effort to exhaust the exploration of on-site alternatives, a North/South facility orientation was considered. While this orientation would represent a reduction in overall wetland impacts by 1.9 acres, most of the reduction would consist of the man- made open water pond located on the adjacent property that was formerly a golf course. This feature has minimal ecological value. Additionally, this alternative represents an increase of 236 lf of stream impacts as compared to the preferred alternative. Furthermore, this orientation is not feasible because it does not fit within the parcel boundaries and would necessitate multiple property transactions with adjacent landowners (see Attachment 5). 5) In accordance with 15A NCAC 02H .0506(f) and (g), please clarify whether the Division of Energy, Mineral and Land Resources will require any temporary impacts (riprap stabilization, basins, etc) to streams or wetlands as part of the Erosion & Sedimentation Control Plan approval. If any impacts are required, please enumerate and clearly label the temporary and permanent impacts on the site plan and submit a restoration details for any temporary impact areas shown. Temporary impacts to streams and riparian buffers will be required as part of the Erosion and Sedimentation Control Plan approval. Temporary impacts are clearly labeled on the Wetland Impacts Mapping included in Attachment 2. Temporary stream impact areas will be returned to pre-existing contours and stabilized with a riparian seed mix under the EC-2 matting to increase slope stability while providing a variety of native herbaceous species that propagate at varying times throughout the year including spring, summer, fall and winter. Riparian Buffer seed mix shall consist of ERNMX-179 from Ernst Seeds or equivalent at a rate of 20lbs/ac. 6) In accordance with 15A NCAC 02H.0506(a), a 401 Water Quality Certification may only be issued upon determining that existing uses are not removed or degraded by a Page 3 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES discharge to classified surface waters. Based on the information provided in the application and associated documents, all surface flow from the project is proposed to be rerouted through multiple stormwater wet detention basin. Please note that the rerouting of any drainage and surface flow has the potential to remove existing hydrology from feature adjacent to this project and therefore remove existing uses of the stream channels or wetlands. Upon further review of the information provided in response to this Item, the Division may require a more thorough analysis and/or more information for particular portions of this project. Additional information will be provided upon request from the Division. Please see attached Indirect and Cummulative Impact Analysis, included as Attachment 4, as well as sheets C-100 through C-315 of Attachment 1. The stormwater outfall locations demonstrate that downstream reaches will maintain hydrology. 7) Since the road improvements are for the Publix private development, can any portion of the stormwater from the road improvements be treated by the SCM’s treating the Publix site runoff? A portion of the US 70 widening will be treated by one of the stormwater ponds. Most of the road that is being widened drains away from the Site, so NCDOT is maintaining the drainage that flows away from the Site. Per NCDOT requirements they are not allowed to divert stormwater in a different direction from pre-development drainage patterns. The NCDOT term for this is “hydraulic Trespass”. Therefore, no stormwater from the road improvements can be treated by the SCM’s treating the Publix site runoff. Comments below from the USACE (in black) with responses (in red): A) Permits for the work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. A detailed review was performed to effectively exhaust all off-site and on-site alternatives and provide justification that the preferred alternative is the least damaging practicable alternative. A summary of all off-site and on-site alternatives considered is provided below: Off-site: In addition to the three off-site alternatives discussed in the permit application, and depicted in the siting criteria matrix, an additional parcel of sufficient size (405 acres) was identified using a targeted GIS parcel search to identify all developable parcels larger than 300 acres located in Guilford County. The targeted search identified this parcel as the only other viable option in Guilford County to the preferred alternative. Although this site is located within the preferred 3-5 mile range from I-40/I-85 corridor, it is not within the preferable range of the I40/I85 interchange and was therefore not included in the alternatives discussed in the permit application. This additional alternative parcel, located at 2207 Guilford College Rd, consists of 405 acres of residentially zoned property approximately 4 miles west of the I73/I85 Page 4 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES interchange. This property is approximately 13.7 miles west of the I40/I85 interchange. While of sufficient size, this property does not meet the preferred criteria based on the following reasons: -The parcel is currently residentially zoned and surrounded by highly developed residential communities. Because of this, the increased tractor trailer traffic along NCDOT secondary roads in the vicinity would create safety concerns for citizens in the area. -The parcel is not located within the eastern portion of Guilford County. Because of this, trucking routes would be exposed to additional traffic concerns, potentially causing delivery delays and increased fuel costs. Please refer to the traffic study in Attachment 7. -Due to the oddly configured orientation of the parcel, and the anticipated 250-acre pad areas required for facility development, the distribution facility would need to be located within the eastern half of the parcel. Based on desktop review of the national wetlands inventory (NWI), National Hydrography Datasets (NHD), and NRCS hydric soils, it appears impacts to jurisdictional waters would significantly exceed those of the preferred alternative. Please see enclosed exhibit attachment 6. On-site: Based on the required facility layout, multiple alternatives were examined with regards to on-site placement. See response to DWR comment #4 above for description of the onsite alternatives considered. A.i.) The Corps disagrees with your stated Purpose and Need, given that it precludes a reasonable range of alternatives through specifying individual proposed project components. Please note that the Corps makes the final determination regarding Basic and Overall Purpose and Need for a project. The stated Purpose and Need in the initial permit application is “to establish a secure corporate campus which: (1) includes the following components arranged in a contiguous, functional, efficient manner: refrigerated warehouse, dry warehouse, return center, food manufacturing facility, parking and staging for tractor trailers, parking for associates and ancillary support facilities; and (2) is located at a site that will efficiently serve its current and future grocery stores within North Carolina, South Carolina, and Virginia.” Operational food production and distribution facilities need to be located on a secured, unified campus to reduce the infrastructure required and to assure operational efficiencies and operational safety. All of the project components stated in the project purpose and need work in conjunction with each other and are required to support the operation of the facility. It is impracticable for any project component to be separated in the food production process as each time a product is moved outside an enclosed and controlled facility it leaves the food products susceptible to biological contaminants or adulteration prior to packaging and distribution. The refrigerated building anchors the site. This building houses all site management and oversight for the operations. In addition, this building also has in-house maintenance, Page 5 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES computer-based training, forklift maintenance, battery charging and changing, meeting rooms, cafeteria, and employee training. Each buildings operation within this facility will tie back to one or more buildings for support functions. For these reasons the components need to be located on the same campus to assure efficiency and safety of the operations. Furthermore, combining buildings on the same campus reduces the overall footprint of the development by sharing resources. The efficiency and reliability of operations is increased due to removing the requirement of offsite tractor trailer and associated product moves. This arrangement promotes all tractor trailer, and associate travel paths and product moves to happen within a controlled environment with minimal travel paths and no vehicle trips on public roads until time to distribute to the retail locations. Examples of how the current layout supports these adjacency requirements are stated below. Refrigerated Warehouse to: • Provide a reliable and efficient source of refrigerated materials for production. • Provide reliable and efficient space for warehousing and distributing products once manufactured. • Cafeteria services to provide lunch for all associates working within the manufacturing building. • Provide in-house maintenance services for building maintenance. • Space for department meetings. • Employment and associated onboarding services through the management offices. • Maintain required rolling equipment such as forklifts, carts, double jacks, etc. Dry Warehouse to: • Provide a steady and stable source of materials for production and packaging. Dispatch Office to: • Provide and assign site yard management tractors to move products / materials via tractor trailers to and from the manufacturing building, and to dry and refrigerated warehouses. Return Center to: • Manage recyclable waste from the production process: paper, cardboard, plastics, and pallets. Security Posts: • Secure site to assure that no unauthorized personnel or vehicles enter the food production site and that all incoming and outgoing traffic is regulated and directed to the proper destinations within the industrial complex. A.ii.) For the off-site alternatives analysis, several siting criteria presented are not adequately justified in the application. The term “center of gravity solution” is used several times but not adequately explained, and it is unclear how this term relates to or justifies Guilford County as a reasonable geographic limit of alternative site selection. Publix is the biggest employee-owned company in the Nation, currently employing almost 200,000 people across it’s approximately 1,200 stores. Currently there are 46 stores located in North Carolina and 16 stores located in VA, as opposed to almost 800 stores in the state of Florida. Because of its saturation in the southeast market, Publix has decided that further growth will be best achieved by expanding its presence up the east coast, most notably throughout Virginia and the Carolinas. Page 6 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES In order to meet the goals for projected growth, Publix determined a need to design and construct a distribution center that could safely and efficiently support the stores along the outer reaches of its range. Currently, the closest distribution center servicing Publix’s North Carolina stores is located in a suburb of Atlanta, Georgia. Therefore, siting a new distribution center at the proposed location would shift the Publix “center of gravity” north from its current base of operations and range. Centroid analysis based on the geographic distributions of markets and proximity to established transportation corridors was conducted showing a location near Greensboro would be ideal to support Publix’s planned growth. By locating a new distribution center in Guilford County, Publix will be able to serve its North Carolina and Virginia markets most effectively, while setting itself up for future expansion into Maryland, Pennsylvania, and beyond. Furthermore, locating the facility on the eastern side of Greensboro is the most viable option to support transportation of goods eastward into Virginia and other coastal areas. Locations west or south of Greensboro would require distribution trucks to cross through Greensboro’s urban center compromising delivery service, especially during periods of peak traffic. Therefore, Gilford County was determined to be the most reasonable geographic limit for alternative site selection. See pages 8,9, & 10 of the Centroid Map and page 2 of the transportation study (Attachment 7). A.ii.b) “Sufficient labor force” is not adequately described as a siting criteria, given that all of the off-site alternatives presented are within the same County. It seems reasonable to presume that all alternatives presented are within the same general labor force commuting area. Publix proposes a logistics operation requiring approximately 1,000 new positions. Therefore, proximity to a sufficient labor force is an important siting criterion for the proposed facility. From a workforce standpoint, the preferred alternative scored highly based on its proximity to a large workforce in Guilford County, Alamance County, and the western Triangle region of North Carolina (specifically Orange County). The combined workforce of these three counties totals 423,864. • Guilford: 262,798 • Alamance: 81,898 • Orange: 79,168 The preferred alternative is situated in eastern Guilford County, just off Interstates 40 and 85. This location is highly accessible and is within a 22-minute commute time (regional average) of Alamance County and 30-minute commute time to Orange County, which are two of the fastest growing areas of North Carolina. In addition, according to the Greensboro Chamber of Commerce eastern Guilford County is a traditionally underserved employment area, particularly since the exit of the textiles industry over the past one and a half decades. Although offsite alternatives are all located within Gilford County, not all locations with the County have equal access to the labor markets presented above. Due to the large size of Gilford County, commute times from eastern portions of the County to western portions can be 50 minutes of greater during peak traffic. Therefore, locations westward of the preferred alternative significantly increase commute times from the labor markets resulting in reduced access to a sufficient employee pool. For these reasons, we believe that the preferred alternative offers the best near and long- term workforce opportunity, for not only Publix but also those seeking full time careers Page 7 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES offering quality benefits for their families. A.ii.c) “Infrastructure improvements completed prior to occupancy” appears to be an obvious requirement for all development projects, and thus is not a useful siting criterion. We agree that the siting criteria as it appears in the matrix is too general to adequately explain what Publix is looking for with regards to infrastructure improvements completed prior to occupancy. That siting criteria should read “Acceptable cost and timeline for Infrastructure improvements competed prior to occupancy”. Regarding Infrastructure Improvements and off-site alternatives: The Reedy Fork Corporate park alternative is located over ten miles from a reliable interstate system (i.e. I-40/I-85). Access to the Reedy Fork Corporate Site is limited to Chickasha Drive, a secondary road that is currently, only partially maintained by the NCDOT. Based on the current condition of Chickasha Drive, significant upgrades would be required to accommodate the tractor trailer traffic anticipated for the proposed distribution center. These upgrades would represent a significant cost and extended timeline to the project. The Youngs Mill site is located immediately south of I-85, multiple access roads routes are available to the site including Youngs Mill Road, Hickory Valley Road, Mill Point Road, and Presbyterian Road. All access roads are classified as secondary roads, currently maintained by NCDOT. However, based on characteristics of the access roads, considerable upgrades would be needed to accommodate the tractor trailer traffic anticipated for the proposed distribution center. Based on recent construction activities, Triad Business Park is no longer a viable option for development as the parcel has been fully built out. The preferred alternative represents minimal cost and an expedited timeline to Publix, since the NCDOT has already planned and is permitting for the road improvements to I-70, leading to the site. This fact, accompanied by the cost and extended timeline for infrastructure development to Reedy Fork and Youngs Mill sites, make the preferred alternative the best choice with regards to infrastructure improvements. A.ii.d) “Limited ingress/egress (e.g. fencing, natural buffers) to ensure security” and “Availability of Alternate Routes (in the event of disruption of the primary route)” appear to be competing and opposing criteria and are not adequately explained/evaluated in the off- site alternatives analysis. The “Limited ingress/egress” (e.g. fencing, natural buffers) to ensure security, listed in the site criteria is specifically referring to ingress/egress and security immediately local to the site. This ingress/egress is referring to characteristics that help facility control and not roadways/travel arteries to get to the site itself. This is solely referring to controlled access once on-site. As per FDA recommendations, physical security measures (fencing, etc.) at the facility help prevent the intentional alteration of food products. In addition to constructed security measures such as fences and gates on-site, natural features also provide enhanced security to food distribution facilities. Features such as streams and forested buffers, like those bounding the east and west sides of the preferred alternative, help reduce the threat of Page 8 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES vehicular access prior to arriving at any constructed security feature such as fences or walls. Thus, it is important to utilize sites that allow for a combination of both natural and constructed security measures that allow for better control of ingress/egress to the facility itself. “Availability of Alternate Routes” as mentioned in the siting criteria is referring to transportation routes to and from the distribution facility with regards to intended destinations. It is important to Publix that multiple routes from the distribution facility to their stores are available. Should the primary route become temporarily disrupted for any reason (construction, accident, etc.), it is important that secondary routes be available to meet the scheduled delivery times. Thus, the siting criteria above are not competing or opposing as one is specifically related to security of the site, while the other refers to delivery routes once outside of the site’s security measures. A.ii.e) “Access to connecting roads that can support tractor trailer traffic” does not appear to be a limiting siting criterion, given that NCDOT upgrades are proposed as a necessary component of the Preferred Alternative. Regardless of site selection, traffic control improvements will be necessary, including intersections, stop lights and additional turn lanes to allow vehicular traffic access in and out of the facility for all alternatives considered. Of primary importance is selection of access roads immediately leaving the facility, that will support tractor trailer traffic to major highway infrastructure and only require minimal improvements of acceptable costs and timeline to access the facility. A.ii.f) “Compatible land uses on adjacent land to ensure food safety” is not adequately described in the off-site alternatives analysis to determine practicability of one alternative versus another. There are certain food safety regulatory obligations Publix must meet, including the Preventive Controls for Human Foods food safety requirements as defined in 21 CFR Part 117 of the Food Safety Modernization Act (FSMA). Within this rule, food companies are required to implement preventive controls to help protect the food from unintentional contamination. The US Food and Drug Administration (FDA) also updated requirements under the Federal Food, Drug, and Cosmetic (FD&C) Act that require food companies to implement Mitigation Strategies to Protect Food Against Intentional Adulteration. With these new regulatory requirements in mind, we have conducted an evaluation of the proposed property in addition to the adjacent land that would help maintain food safety for the facilities owned and operated by Publix. Because the properties surrounding the site are zoned for agricultural or residential use, with the exception of one property proposed as a future data center site, there is a relatively low vulnerability to both food safety and food defense as evaluated through our threat assessment. A.ii.g) Please quantify a reasonable “Proximity to a high-quality truck stop” for comparison purposes. Within a 3-mile radius of the proposed site, four (4) gas stations are located south of the site, including Stoney Creek CITGO, Pilot Travel Center, McConnell CITGO, and CITGO. The Pilot Travel Center, located at 907 Knox Road, McLeansville, NC, is most suitable for large trucks and is located approximate 1.4 miles south of the proposed site. The Pilot Page 9 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES Travel Center has amenities such as food, showers, gas, restrooms, and parking for truck drivers. A.ii.h) If 250 acres of construction pad is required for the proposed project, why were off-site areas that offered less than 250 acres analyzed? This basic requirement should be met for all alternatives for them to be considered reasonable. Several other site criteria were analyzed in the siting criteria matrix outside of the construction pad size alone, which is why alternatives were considered that were less than 250 acres. Sites smaller than 250 acres were considered because they were able to fulfill other siting criteria in the matrix. Options for Sites larger than 300 acres that could accommodate a buildable area of 250 acres to accommodate the project footprint are extremely limited in the geographic search area. A targeted search of other buildable properties larger than 300 acres in the County identified only one other viable option (see response to USACE Comment A (above) for full description of this offsite alternative). Due to the oddly configured shape of that parcel, site design constraints and anticipated surface water impacts, the preferred alternative remains the LEDPA. A.ii.i) If practicability cannot justify eliminating one or more off-site alternatives, please provide an estimate of impacts to waters of the U.S. to enable comparison with impacts proposed for the Preferred Alternative. Include also the methodology of estimating the extent of waters of the US for those properties. For all off-site alternatives considered, desktop resources evaluated included but were not limited to USGS topographic maps, Lidar Data, NWI, Hydric Soils and National Hydrography Datasets to quantify impacts to surface waters. Please see enclosed exhibit in Attachment 6. Reedy Fork Alternative: practicability could not be justified because of distance to I40/I85 transportation corridor, fell short of necessary available space for construction pad, 2 large perennial tributaries running through the site would require significant impacts to WOTUS due to the required grading associated with site development. Thus, this site wouldn’t satisfy LEDPA based on estimated impacts. Youngs Mill Road Alternative: practicability could not be justified because this site fell short of the necessary available space for construction pad, access to connecting roads supporting tractor trailer traffic, and several large tributaries that meander through the site would require impacts to WOTUS. Triad Business Park Alternative: This is no longer a viable option due to build out on the property of another project. Guilford College Road Alternative (405 acres): See response to USACE Comment A (above) for full description of this alternative. Practicality could not be justified for this site because the site is not property zoned, distance to I40/I85 transportation corridor, necessary available space for construction pad, and impacts to jurisdictional waters would significantly exceed those of the preferred alternative. A.iii) It is unclear from the narrative and the scale of the on-site alternative drawings and lack of comparable information on the exhibits as to whether your on-site alternatives analysis provides alternatives with similarly sized and types of components (i.e. “apples to apples” comparison). Please provide more clarity regarding the on-site alternatives and confirm that each alternative Page 10 of 5 CIVIL ENGINEERING | ENVIRONMENTAL | SURVEYING | GIS | LANDSCAPE ARCHITECTURE | CONSTRUCTION SERVICES is of similar size/capacity and includes the same features (i.e. warehouse space, parking, etc.) as the preferred alternative. Please see comment response No. 4 to DWR above. A. Cost is referenced in the on-site alternatives analysis as a practicability concern, however no quantitative information is given to justify this statement or enable comparison of on-site alternatives. The cost of on-site alternatives is a practicability concern for the development. The lifespan of the facility is anticipated to be approximately 75 years. Due to projected lifespan of the facility operational costs was of primary concern in the planning process and siting of this facility, including transportation costs (see siting and transportation considerations in response to USACE Comment A.ii). Furthermore, the preferred alternative was selected in an effort to reduce environmental impacts and be the most cost-effective solution in terms of the fixed layout of the facility, safety concerns and site constraints. Orientation in a north south configuration would require additional costs in securing additional properties to the south. Orientation shifting the site east or west would result in additional impacts and higher mitigation costs associated with the facility. Planning and careful site layout and design were considered to reduce impacts and save costs as much as practicable due to site constraints and safety concerns. B. It is necessary for you to have taken all appropriate and practicable steps to minimize losses of Waters of the U.S., including wetlands. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. Due to the fixed orientation of the layout, the proposed facility is centrally located between the topographic valleys of the two larger stream systems located east and west of the facility in order to minimize stream and wetland impacts to maximum extent practicable. Shifting the facility either in any direction east, or west, would direct impacts away from the upper headwater stream systems and further into the main perennial stream systems. Rotating the pad site in a north/south configuration to reduce impacts is not practicable as it does not fit within the confines of the property. Retaining walls were considered but determined to be not practicable design features given the existing site topography and required measures to ensure the stability and operational safety of the Site. C. The MOA requires that appropriate and practicable mitigation will be required for all unavoidable and adverse impacts remaining after the applicant has employed all appropriate and practicable minimization.
