Dunn, Coastal Coordinator �aA Habitat Conservation Division DATE: August 9, 2019 SUBJECT: CAMA Dredge/Fill Permit Application for Janice Olsen, Currituck County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 206 Waterside Drive in Harbinger, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act:, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to fill 5,616 W of Section 404 wetlands located landward an existing bulkhead, with approximately 2,302 ff of the wetlands within the CAMA 75' Estuarine Shoreline. Vegetation within the area includes Phragmites, Carolina Willow, and Bald Cypress. The reason for the fill is to create a more manageable yard. The applicant proposes to purchase 0.26 acre of wetland credits from The Great Dismal Swamp Restoration Bank Timberlake Farm The Albemarle Sound in this location is classified SB by the Environmental Management Commission_ The NCWRC has reviewed the permit application and has concern with the purpose and need of the project proposal. Wetlands provide important habitat opportunities for numerous wildlife species as well as serve as an important filtration system for stormwater runoff. Due to the importance of wetlands, the NCWRC does not support the fill of wetlands without a purpose and need that demonstrates avoidance and minimization of wetland impacts_ We understand that for some water dependent structures, access, utilities setback, or construction, wetland impacts may be necessary and can be allowed after demonstration of avoidance and minimization. Those parameters do not appear to be demonstrated within this permit application. Therefore, the NCWRC would not support the proposed wetland fill unless a purpose and need is provided and avoidance and minimization demonstrated.
