Fisher:ies for a Department of the Army permit and a State Water Quality
Certification. Your receipt of this letter verifies your acceptance of a
valid request for certification in accordance with Section 325.2(b)(ii) of
our administrative regulations.
We are considering authorization of the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification may be required under the provisions of Section40l of
the same law. No Department of the Army permit will be granted until the
certification has been obtained or waived.
In accordance with our adm{nistrative regulations, 60 days after receipt of
a request for certification is considered a reasonable time for State
action. In accordance with our regulations, if your agency has not acted on
the request by 13 February 1982, the District Engineer will deem that waiver
has occurred.

Members of the staff of the Wilmington Regional Office have reviewed the
application for the subject project. The applicant proposes to construct
a jetty of concrete block construction 50. in length into the waters of
Bogue Sound. This will result in the placement of about 15 cubic yards
of concrete material below MHW. Also, a floating dock and high ground
structures associated with the utilization of pontoon float airplanes
are to be constructed.
As indicated in a memo dated October 27, 1982, it is recommended that a
401 Certification be required. Since the project is not expected to
have an adverse impact on water quality, it is recommended that a certi-
fication be issued containing a turbidity limit of 25 NTU.

Narrative description
The N. C. Div. of Marine Fisheries is proposing to construct ,a new airplane hangar
at its main headquarters located in Morehead City south of Arendell and adjacent
to Bogue Sound. As a part of this overall project, the Division is requesting
permits which would authorize the relocation and enlargement of an existing float-
ing dock, the construction of a concrete block jetty into Bogue Sound, and the
construction of an additional concrete pad used for vehicle support in loading
and unloading the pontoon float airplanswhich the division utilizes.
Presently, an approximately 200' section of the division shoreline area is bulk-
headed, the majority of which is well above the MHW line. TIle remaining section
of the shoreline is sandy and is where the proposed developments will take place.
An existing approximately 16' wide by 17' long concrete pad has been constructed
at this site above the ~frlW line, and an existing approximately 90' long by 4'
wide floating dock extends into Bogue Sound.
The division is proposing to replace and relocate their existing airplane hangar
by constructing a new 120' long by 60' wide hangar facility. Waterward and ad-
jacent to the new hangar an approximately 50' long by 36' wide concrete pad is
also to be constructed. Along the shoreline area a new 20' wide by 18' long con-
crete pad is to be placed above the MEW line which will be adjacent to an exist-
ing one. The existing floating dock is to be removed and a new 110' long by 5'
wide floating dock is to be extended into Bogue Sound between the two concrete
pads.. Division is also requesting permits to place an approximately 50' long
by 4' wide by 5' high concrete block jetty into Bogue Sound which will be adja-
cent to their western property line.
10. Anticipated impacts
The project as proposed will result in the placement of about 15 cu.yds. of con-
crete material below the MEW line of Bogue Sound, with the filling in of about
200 sq. ft. of shallow water bottoms. An existing floating dock will also be re-
located and extended into Bogue Sound. The proposed 360 sq.ft. concrete pad will
be above the MEW line and will not impact any vegetated wetlands. The proposed
new hangar and adjacent co~crete pad will be located on high ground and outside
of the estuarine shoreline AEC.

Members of the staff of the Wilmington Regional Office have reviewed the
application for the subject project. The applicant proposes to create two
artificial fishing reefs within the Atlantic Ocean about 1.45 and 2.25 miles
offshore of Bogue Banks near Bogue Inlet. The reefs, which are to be 500 yards
by 1000 yards each, are to be formed by dumping tires, metal dumpsters, ship hulls
and other non-toxic materials. The project is to have little to no impact on
public navigation.
Since the project involves placement of material in waters, a 401 Certification
is required. Since the project is not expected to have an adverse impact on
water quality, it is recommended that a certification be issued containing a
turbidity limit of 25 NTU.

Inclosed is a copy of the application of the Lower Cape:Fear Water and Sewer
Authority for a Department of the Army permit and a State Water Quality
Certification. Your receipt of this letter verifies your acceptance of a
valid request for certification in accordance with Section 325.2(b)(ii) of
our administrative regulations.
We are considering authorization of the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification maybe 'required under the provisions of Section 401 of
the same law. No Department of the Army permit will be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days' after receipt of
a request for certification is considered a reasonable time for St'ate

EXCAVATED MATERIALS IN WOODED SWAMP WETLANDS AND CONSTRUCT AN AERIAL CROSSING OF LIVINGSTON CREEK TO EFFECT
INSTALLATION OF A RAW WATERLINE FROM KINGS BLUFF TO MALMO, Bladen, Columbus, and Brunswick Counties, North
Caro Ii na.
The fol lowing description of the work is taken from data provided by the applicant and from observations made
during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application
show the proposed installation of a 48-lnch dIameter, prestressed concrete cylinder raw waterline from a 45 MGD
pumping sTZltlon (under construction) at Kings Bluff to a 3-mlll ion-gallon raw water storage reservoir (partially.
completed) near Malmo. The appl icant proposes to span Livingston Creek, designated a,navlgable waterot the
United States, with the pipeline supported by piling and elevated 10 feet above mean high /~ter. The pipeline
w III be constructed msubaqueous I y through the wooded swamp, wet lands contiguous wi th Llv I ngs ton Creek and across
all other streams and conTiguous wetlands within the pipeline corridor. The proposed subaqueous pipeline
_~&i.nstallat/on through wetlands within the corridor will involve the construction of a Zo-foot-wlde temporary log
road approximately 20 feet downstream of the pipeline alignment. One backhoe, working off tImber construction
mats, wil I instal I a trench box and excavate a Io-toot-wlde, 10-foot-deep pipeline trench. The excavated
materials wll I be temporarily piaced In a 10-foot-wlde (average) area upstream of the trench with the remainder
of the materials placed In a 15-foot-wlde (average) area downstre.llm of the trench. A second backhoe, working
from the log road, will place the 20-foot-long, 15,OOO-pound sections of pipe within the trench, backfill the
trench, dress the area back to grade, and remove the log road. as the pipe Installation progresses. BackfIll of
the trench by the second backhoe wll I occur to within 40 feet of the trench box during trench excavation. The
excavated material in any 4o-foot-long section wi II -be placed In wetlands above ground for an anticipated time of
1 hour. In addition, the average creek and/or wetland crossing, Including complete restoration, should be
completed within an average time of 3 days. The purpose of the proposed work Is to provide Improved water

The applIcant has deTermined that the proposed work is consistent with the N.C. Coastal Zone Management Plan
and has submitted this determination to theN.C.OtflceofCoastaIManagement for their review and

c. The issuance of a permit under the N.C. Coastal Area Management Act (CAMA) by the N.C. Office of
Coastal Management or their delegates.

Statute 143-341(4), 146-6, 146-11, and 146-12 by the N.C. Department of Administration and the N.C. Council of
State.
The requested Department of the Army permit wi I I be denied if any required State or local authorization and/or
certification Is denied. No Department of the Army permit wll I be Issued untIl a State coordinated viewpoint
is received and reviewed by this agency. Recipients of this notice are encouraged to furnish cooroents on
factors of concern represented by the above agencies directly to the respective agency, with a copy furnished
to the Corps of Engineers.
This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403)
and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, In writing within the comment
period specifIed In this notice, that a public hearing be held to consider this appl ication. Requests for public
hearing shall state, with particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the National Register of Historic Places
for the presence or absence of registered properties, or properties listed as being eligible for Inclusion
therein, and this worksite Is not registered property or property listed as being ellglbie for Inclusion in the
Register. Consultation of the National Register constitutes the extent of cultural resource Investigations by the
District Engineer, and he Is otherwise unaware of the presence of such resources. Presently, unknown
archeological, scientific, prehlstorl~l, or historical data may be lost or destroyed by work under the requested
perm It.
The District Engineer has determined, based on a review of data furnished by the applicant and onslte
observations, that the activity will not affect species, or their critical habitat, designated as endangered or
threatened pursuant to the Endangered Species Act of 1973.
The decision whether to Issue a permit will be based on an evaluation of the probable Impact including the
cumulative Impacts of the proposed activity on the public Interest. That decision wll I reflect the national
concern for both protection and utll izatlon of Important resources. The benefit which reasonably may be expected
to accrue from the proposal must be balanced against Its reasonably foreseeable detriments. AI I factors which
may be relevant to the proposal will be considered; among those are conservation, economics, esthetics, genera!
environmental concerns, wetlands, cultural values, fish and wi Idllfe values, flood hazards, flood plain values,
land use, navigation, shorel ine erosion and accretion, recreatIon, water supply and conservation, water quality,
energy needs, safety, food production, and In general, the needs and welfare of the people. The evaluation of
the Impact of the activity on the public Interest wi I I also include application of the guidel ines promulgated by
the Administrator, U.S. Envlronme~tal Protection Agency, under the authority of Section 404(b) of the Clean Water
Act (40 CFR Part 320). No permit wll I be granted unless Its Issuance is found to be In the public Interest.
Generally, the decision whether to Issue this Department of the Army permit will not be made until the
N.C. DivisIon of Environmental Management (OEM), issues or denies State certification required by Section 401
of the Clean Water Act. The DEM considers whether or not the proposed activity wi I I comply with Sections 301,
302, 306, and 307 of the Clean Water Act. The application and this publ Ie notice for the Department of the
Army permit serves as application to the OEM for certification.

401 Certification Public Comments Period.
This office has no objection to the issuance of the permit(s) for the proposed

That the activity be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge (increases of 25 NTU's or less are not considered
significant).
That the instream turbidity not be increased by more than 50 NTU's as a
result of the proposed activity after a reasonable opportunity for dilution
and mixture.
That turbidity levels in shall not be increased

Dear Mr. Parker:
Reference the application of the Landing, Incorporated, represented by
Mr. T. Stockton Midgett for a Department of the Army permit to construct a
boat ramp on Kitty Hawk Bay near Kill Devil Hills in Dare County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report. We recommend that the
following condition(s) be included in the State authorization:
1. The fill material used to form the base for the ramp will be free from
any pollutants in other than trace quantities.
2. The fill material used to form the base for the ramp will be retained on
both shoreline sides by a permanent wooden or concrete wall.
3. The ramp, including base fill and containment walls, will be no wider
than 12 feet.
4. No marsh vegetation will be excavated or filled outside of the area to
be covered by the boat ramp.

The following determination has been made regarding the subject project:
ro A 401 \..rater Quality Certification will be required.

The subject application has been reviewed. The applicant proposes to construct
a boat ramp in a wetlands area. In talking with Nelson Paul, it was learned
that approximately 700 square feet of marsh would be filled. It is not antici-
pated that this Division would object to the proposed project. It is recommended
that a 401 certification be issued. The appropriate conditions listed in the
general certification should be included.
