A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. In accordance with your advice during our telephone conversation, 1 requested a measurement of the wetlands area to be actually covered by the proposed earthen dam site as indicated by the enclosed topo- graphical map, identified as Enclosure No. 2. This measurement was determined to be approximately 0.3 acre of wet- lands by Mr. Walter B. High and Mr. John Davis of the United States Department of Agriculture Soil Conservation Service. A copy of Mr. High's letter setting forth his findings is enclosed as Enclosure No. 3. The purpose of constructing this earthen dam is to impound an approx- imate six acre pond within the 28.6 acre property owned by Paradise Lake Farms, a North Carolina General Partnership, of which 1 am a partner together with Kenneth M. Hill and Joseph M. DeLamielleure. The pond would be used for irrigation, recreation and as a residential amenity. To the best of my knowledge, it would not affect any public water supply or constitute any detriment to downstream property. Morehead Street Suite 3A Charlotte, North Carolina 28204 Dear Mr. Kluth: Reference your request of August 25, 1987, for Department,of the Army authorization to place fill material in wetlands above the headwaters of Paradise Creek at S.R. 1455 near Ellerbe, Richmond County. Your proposed placement of this fill material may qualify for Federal authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)). Please complete the enclosed pre-discharge notification (PDN) form and submit it with a copy of your Section 401 Water Quality Certification from the North Carolina Division of Environmental Management. The Section 401 Certification is required to validate nationwide permit No. 26 in the State of North Carolina; and therefore, it must be submitted with the PDN application. We cannot proceed with the processing of your application until after we have received your completed PDN form and the 401 Certification. I felt it necessary to have Mr. Davis along to actually identify the outer boundaries of the wetland soils present where the actual pond dam is to be constructed. With your help, we measured the area in question and found the distance across the wetland area to be 162 feet long. This length, when put with a design height of the damn of 12 feet, a combined front and back slope ratio of 5.5 feet horizontal to 1 foot verticle, and a planned top width of 12 feet, computes to be approximately 0.3 acre of wetlands that will be covered destroyed by fill material. In addition to this, I would estimate that an additional area of 1.3 acres of wetlands will be permanently flooded by the project.
