BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 June 22, 1987 SUBJECT: Nationwide Permits Nos. 14 and 26 City of Raleigh ATTN: Mr. Jimmy Beckom, City Engineer Department of Central Engineering Post Office Box 590 Raleigh, North Carolina 27602 Dear Mr. Beckom: JUN 29 1987 WATER QUALITY SECTION OPERATIONS BRANCH Reference your application of June 2, 1987, for a Department of the Army permit to place fill material in and adjacent to Mine Creek and an unnamed tributary for the purpose of relocating the tributary and constructing a.portion of Millbrook Road in Raleigh, Wake County, North Carolina. According to your plans, the fill material to be placed on Mine Creek will be 165 feet long by 18 feet wide by 1.1 feet below original high water (OHW), having a total of 16.3 cubic yards below OHW. On the tributary to Mine Creek, the approximate amount of fill involved in the relocation of the creek and filling in of the old channel will be 1130 feet long by 6 feet wide by 1.1 feet below OHW, having a total of about 150 cubic yards of material below OHW. The average annual flow in this tributary is less than five cubic feet per second. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. A "minor road crossing fill" is defined as a crossing that involves the discharge of less than 200 cubic yards of fill material below the plane of ordinary high water. The crossing may require a permit from the U.S. Coast Guard if located in navigable waters of the United States. Authorization was provided for minor road crossing fills including all attendant features, both temporary and permanent, -2- that are part of a single and complete project for crossing of a non-tidal waterbody, provided that the crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand expected high flows and provided further that discharges into any wetlands adjacent to the waterbody do not extend beyond 100 feet on either side of the ordinary high water mark of that waterbody. Authorization was provided for discharges of dredged or fill material into non-tidal rivers, streams, and their lakes and impoundments, including adjacent wetlands, that are located above the headwaters and other non-tidal waters of the United States, including adjacent wetlands, that are not a part of a surface tributary system to interstate waters or navigable waters of the United States. For these nationwide permits to be valid, you must comply with the following condition: An individual State water quality certification must be obtained or waived. Conditions of certification will be considered to be special conditions of the Federal nationwide permit. By copy of this letter, we are forwarding your application to the North Carolina Division of Environmental Management to begin this process. The District Engineer has determined that the individual and cumulative adverse effects of your work on the environment will be minimal. The Mine Creek crossing is authorized by the minor road crossing Nationwide Permit Number 14, and the relocation of the tributary with associated fill material is authorized by Nationwide Permit Number 26 provided they are accomplished in strict accordance with the preceding condition. Please be aware that this authorization does not relieve you of the responsibility to obtain any required State or local approval.
