Messrs. Stephens and Hall,
Thank you for your PCN and attached information, dated and received 7/19/2019, for the above referenced project. I
have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit
(NWP) 12 (http://saw-reg.usace.army.mil/NWP2017/2017NWP12.pdf). Please submit the requested information below
(via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the
Nationwide Permit or consider your application withdrawn and close the file:
1) Future developable area and two speculative buildings were referenced on the PCN. Please submit the location
and building envelopes of the speculative buildings that Samet or related entities plan to develop that would tie
into the proposed sewer line. This information is necessary to ensure that the project presented is single and
complete/has independent utility, and should clearly show where this development would take place for remote
evaluation of potential impacts to waters of the US;
2) Please submit profile views of the proposed stream crossings. If rip rap is proposed to be placed below the
ordinary high water mark of these streams, ensure that the profile drawings clearly show that any rip rap placed
in the stream bed would not be placed above the existing stream bed grade (i.e. key into stream bed);
3) It appears that new manholes (D, N, O, P, and U) are proposed to be placed within wetlands. These impacts are
considered permanent discharges of fill material and permanent losses of waters of the US. Given that NWP 12
cannot be used to authorize permanent above -grade fill for utility lines, NWP 18 would be required to authorize
them. These impacts must also be itemized separately on the PCN form, along with valid reasons why they
cannot be located outside of wetlands (avoidance and minimization);
4) Please specify the plan to restore temporary wetland and stream impacts, including stockpiling and re -use of
wetland top soil, and specific seeding/planting species.
