Upon review of your request for Water Quality
Certification to place fill in waters and/or wetlands in
tributaries to Mill Creek, we have determined that the
proposed fill can be covered by General Water Quality
Certification No. 2177 issued November 4, 1987. A copy of
the General Certification is attached. This Certification
may beused in qualifying for coverage under Corps of
Engineers' Nationwide Permit No. 14.

Dear Mr. Upchurch:
On July 8, 1987, you met with Mr. Jeff Richter of my staff
concerning Mr. Don Westbrook's proposed Weymouth South
development, just south of Weymouth Park, on tributaries to Mill
Creek in Southern Pines, Moore County, North Carolina.
Mr. Richter determined that there are wetlands present on this
site, and pointed them out to you. You stated that all
development is to kept out of these wetlands and confined to high
ground, except for road and utility line crossings. Mr. Richter
explained that the Corps of Engineers has a nationwide permit
authorizing road crossings of wetlands, and a general permit
authorizing utility line crossings or wetlands. Both of these
permits are dependent on having several conditions met.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330,
published in the Federal Register on November 13, 1986, lists
nationwide permits. A "minor road crossing fill" is defined as a
crossing that involves the discharge of less than 200 cubic yards
of fill material below the plane of ordinary high water. The
crossing may require a permit from the U.S. Coast Guard if located
in navigable waters of the United States.
Authorization was provided for minor road crossing fills including
.all attendant features, both temporary and permanent, that are
part of a single and complete project for crossing of a non-tidal

waterbody, provided that the crossing is culverted, bridged or
otherwise designed to prevent the restriction of, and to withstand
expected high flows and provided further that discharges into any
wetlands adjacent to the waterbody do not extend beyond 100 feet
on either side of the ordinary high water mark of that waterbody.
For this nationwide permit to be valid, you must comply with
the following condition:
An individual State water qualit certification must be
obtained or waived. Conditions of certification will be
considered to be special conditions of the Federal nationwide
permit.
Please be aware that this authorization does not relieve you
of the responsibility to obtain any required State or local
approval.
On December 29 1982, we issued general permit No. SAWC081-N-
000-0049 (enclosed) that authorizes the installation of aerial and
subaqueous utility lines with attendant structures to span
navigable waters of the United States in North Carolina.
You also took Mr. Richter to property belonging to Mr. Frank
McNeil on Morganton Road, adjacent to a tributary to Watson's Lake
near Southern Pines. The owner wishes a wetland delineation to be
made on this property. Mr. Richter said that he was not equipped
properly to make a delineation at that time but will do this on
his return to.the county.
Should you have any questions regarding this matter, please
contact Mr. Richter at (919) 343-4636 and he will gladly assist
you in any way he can. Thank you for your cooperation with our
permits program.
Enclosed is a copy of this general permit for your use in
planning this part of your proposal. Please note.that this
general permit is not valid until plans of the utility line
crossing have been forwarded to this office for our review.

Sediment Control Plan

Dear Mr. Westbrook:
The review of the above referenced erosion control plan has been
completed. This revised plan was submitted by Hobbs, Upchurch and
Associates on November 4, 1987. The plan has been found to be
acceptable subject to the following stipulations:
1. In the event that accelerated erosion occurs between the storm drain
outlets and the property line on natural ground more substantial
erosion control measures will be required.
2. In order to ensure the early coordination and implementation of the
erosion control plan for this project, it is requested that a pre-
construction conference be held. As a minimum, representatives of
the owner, engineer, contractor and this office should attend,
subject to the availability of staff. Please notify Steve Cook of
this office #s to when this conference is scheduled.
3. Following the completion of the project, you should notify this
office to schedule a final inspection. The purpose of this
inspection is to ensure that all erosion control requirements
have been met.
