On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received November 18, 1985, for a
Department of the Army permit to excavate a channel, canal and
basin and construct bulkheads and docks to establish a commerical
marina on the Atlantic Intracoastal Waterway (AIWW), Scooner
Point, near Seaside, Brunswick County, North Carolina, indicates
it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your
app1ication,will be accomplished by the North Carolina Division of
Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC086-N-010-0057 and will be

Reference the application of T & T Development Company,
Incorporated, represented by Mr. William P. Taylor, for a
Department of the Army permit to excavate a channel, canal, and
basin and construct bulkheads and docks to establish marina
facilities on the Atlantic Intracoastal Waterway (AIWW), Scooner
Point, Seaside, Brunswick County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
By letters of December 11 and 16, 1985 (copies enclosed), the
National Marine Fisheries Service and the U.S. Fish and Wildlife
Service voiced serious concerns regarding anticipated adverse
affects on fishery resources and water quality. By letter of
January 21, 1986 (copy enclosed), the U.S. Environmental
Protection Agency recommended that the application be denied,
particularly, because of the most probable degradation of SA type
waters. We concur with this recommendation.
Also, please be aware that cultural resources reconnaissance
is not complete. A recommendation for inclusion in the National
Register of Historic Places could result, but investigations may
not continue after the application is denied.

Thi s 1 etter is in response to your request for a permit under the
Coast a 1 Area fv1anagernent Act and the State Dredge and Fi 11 Law to develop
a highground commercial marina with 176 slips and an access channel to
the Atlantic Intracoastal Waterway (AIWW) at Scooner Point near Seaside
in Brunswick County, N. C. Processing of your application under a joint
State and Federal review, including onsite investigation, is now complete.
In the course of this review, six State and four Federal agencies have
submitted objections or expressions of concern to the proposal.
Based on this review, the Division of Coastal Management has made
the following findings:
(1) The project, as proposed by app 1 i cat i on and work plats dated recei ved
October 22, 1985 wi 11 result in the loss of approximately 2640 square
feet of marsh wetlands and 8800 square feet of shallow water habitat.
Marsh wetlands of this nature provide nutrients, habitat, and water
qua 1 ity mai ntenance functions that are essenti a 1 for conti nued fi shery
production. Shallow water habitat in this area supports significant
shellfish resources, which are periodically harvested;

(2) The proposed marina 1S extremely large (4.1 acres) with a small entrance
channel width of only 40 feet. Adequate flushing of the basin with
tidal waters is highly unlikely which would result in stagnant water;
(3) The Shellfish Sanitation Section of the Division of Health Services
has demonstrated that mari nas have a negat i ve impact on water quality,
and that there is a high positive correlation between marinas and
closed she llfi shi ng waters. The proposed mari na is to be located in
an area of open SA waters and if constructed, wi 11 require closure
of water to the harvesting of shellfish;
(4) A Section 401 Water Quality Certification for the project was denied
on March 6, 1986. The denial was based on expected violations of
water qual i ty standards from stormwater runoff and poss i b 1 e overboard
sewage discharges and fuel spillage from boats docked at the marina;
(5) The project, as proposed, is i ncons i stent with the fo 11 owi ng part i a 1
listing of State Guidelines for Areas of Environmental Concern:
a) 15 NCAC 7H.0205(c). Management Objectives (for coastal wetlands).
This requires projects to give highest priority to the protection
and management of coastal wetlands so as to safeguard and perpetuate
their biological, social, economic, and aesthetic values; to
coordi nate and estab 1 i sh a management system capable of conservi ng
and utilizing coastal wetlands as a natural resource essential
to the functioning of the entire estuarine system;
b) 15 NCAC 7H.0206(c). Management Objectives (for estuarine waters).
This rule establishes, as the highest priority, the management
and conservation of the important features of estuarine waters,
so as to safeguarp, and perpetuate their biological values;
c) 15 NCAC 7H.0208(a)(2)(C). This standard states that development
shall not violate water and air quality standards;
d) 15 NCAC 7H.0208(a)(2)(F). This standard requires that development
shall not create stagnant water bodies;
e) 15 NCAC 7H.0208(b)(5)(B). Specific Use Standards for Marinas.
Marinas should be developed on non-wetland sites or in deep waters
and should not disturb valuable shallow water and wetland habitat.
f) 15 NCAC 7H.0209(e)(4). Development shall not have a significant
adverse impact on estuarine resources; and
g)
15 NCAC 7H.0602. Pollution of Waters. No development shall
be allowed in any AEC which would have a substantial likelihood
of causing po 11 ut i on of the waters of the State to the extent
that such waters wou 1 d be closed to the tak i ng of she 11 fi sh under
standards set by the Commission for health services pursuant
to G. S. 130-169.01.

Given the foregoing findings, your permit application must be denied.
This denial is made under NCGS 113:-229(e)(5), which provides for permit
denial upon finding a significant adverse impact on estuarine resources;
NCGS 113A-120(2), which requires CAMA permit denial when the project is
found to be i ncons i stent with the State Dredge and Fi 11 law; and and NCGS
ll3A:-120(8), which requires denial of projects inconsistent with the State
Gui de 1 i nes for Areas of Envi ronmenta 1 Concern or 1 oca 1 1 and use plans.
If you wish to appeal this denial, you are entitled to a quasi:-judicial
hearing before the Coastal Resources Commission as provided by the Coastal
Area Management Act. A request for a hearing must be submitted in writing
within twenty days of the date you receive this letter. Mr. Ralph Cantral,
Assistant Director of the Division of Coastal Management, at 733:-2293, is
available to discuss the appeal procedure with you.
In lieu of a hearing, you may wish to modify your proposal. Department
personnel are available to discuss alternatives with you. It is, of course,
the policy of this office to assist an applicant with his project while
protecting our vitally important coastal resources. Should you redesign
this project from the standpoint of water quality and wetland habitat loss
such that the review agency concerns are satisfied, this denial would be
reconsidered. It should also be noted that a cultural resources reconnais-
sance within the project area is not complete. A recommendation for inclu~
sion in the National Register of Historic Places could result, but investi:-
gations may not continue unless further actions required by a modification
of the project proposal are initiated.
A 1 so, you shoul d be advi sed that as long as thi s State permit deni a 1
stands, your project must be deemed i ncons i stent wit the North Carol i na
Coastal t4anagement Program, thereby precluding issuance of Federal permits
for this project. The Feqeral Coastal Zone Management Act of 1972 (CZMA)
gives you the right to appeal this finding to the U. S. Secretary of Com-
merce, within 30 days of receipt of this letter. Your appeal must be based
on the grounds that the propsed activity is (1) consistent with the objec-
tives or purposes of the CZMA, or (2) is necessary in the interest of .
national security, and thus, may be Federally approved. Mr. Cantral is

By copy of North Carolina Department of Natural Resources and
Community Development letter to you of March 27, 1986, we have
been informed that your application for State authorization to
excavate a channel, canal and basin and to construct bulkheads and
docks to establish marina facilities on the Atlantic Intracoastal
Waterway (AIWW), Scooner Point, Seaside, Brunswick County, North
Carolina, has been denied. Under the administrative rules of our
regulatory program, denial of required State authorization
precludes favorable consideration of a Federal permit.
Accordingly, your Department of the Army application is hereby
denied, and your file has been retired.
Additionally, we received unfavorable comments from Federal
review agencies (copies enclosed). Their reaction to your
proposal is the result of anticipated significant adverse impacts.
I have provided these Federal agencies' comments to alert you to
concerns in addition to those identified in the State's denial
letter. While appealing the State permit is the next step in
pursuing State authorization, you should be aware that Federal
agency comments will be unchanged by the outcome of that appeal.
Because of the Federal agencies' influence on Department of the
Army permit decisions, it is unlikely a Department of the Army
permit would be available unless your project can be modified to
lessen its impacts.

Your application dated October 21, 1985, for a Water Quality
Certification under Section 401 of the Federal 'Clean Water Act as
Amended has been reviewed by our staff. Your proposal is to develop a
12.5 acre tract of land by constructing a 176 slip marina, gravel roads,
gravel parking areas, office building and boat ramp adjacent to the
Atlantic Intracoastal Water Way near Seaside. The issuance of a Water
Quality Certification is a finding by this Division that the proposed
activity will not cause a violation of water quality standards or
discharge guidelines.
There is an aspect of the project which causes us considerable
concern as to the effect on water quality standards in these waters
which are classified SA. This is the fecal coliform levels which are
contained in the stormwater runoff. Information available to us at this
time indicates that a violation of fecal coliform standards for waters
classified SA will be expected to occur as a result of stormwater runoff
where effective impervious surface areas are in excess of 10% and a
30-foot natural buffer to MHW is not provided. Where effective
impervious areas are greater than 10%, diversion, treatment or
containment of the stormwater runoff up to the 10-year, 24-hour rainfall
event would be needed to assure protection of the water quality
standard. This project as proposed, would have 35.6% effective
impervious area.

Another aspect of the project which causes concern is boat
operation. Sewage discharged from boats in the boat basin is likely to
cause a violation of the fecal coliform standards. In order for us to
conclude that sewage discharge from boats will not occur, we would have
to be satisfied that the project can and will prevent sewage discharge
from boats on a long-term basis. Past experience has been that just
providing marine pump-out facilities is insufficient to prevent sewage
discharges from occurring. Also spill potential at the fueling docks is
an area where specific plans will need to be developed to assure that the
marina operation will not pose a threat to water quality.
Because the stormwater runoff from the proposed project is expected
to violate water quality standards and the operation of the boats could
cause a violation of water quality standards due to sewage from boats
and/or fuel spillage, I have concluded that the proposed project should
not be certified. Your application for a Water Quality Certification is
hereby denied. Should you redesign the project from the standpoint of
stormwater impacts and boat operation in such a manner as to satisfy our
concerns for water quality protection, I will reconsider this denial.
It is suggested that you work closely with our Wilmington Regional
Office in any redesign of the proposed project.
You do have the right to a review by the Environmental Management
Commission, if the denial is unacceptable to you. Your request for
Commission review must be in writing, identifying the specific items to
be contended, within 10 days of your receipt of this denial. If you have
any questions concerning this matter, please contact Mr. Bill Mills at

The applicant proposes to develop a 12.5 acre tract of land by
constructing a 176 slip marina basin, gravel roads, 328 gravel parking
spaces, office building, boat ramp, provide fueling facilities and
pump-out facilities, adjacent to the AIWWat Seaside, classified SA.
The project has been reviewed to determine impacts to water quality.
The following information is provided:
1. The project will require 401 certification.
2. After construction of the marina, the 12.5 acre site will be
reduced to 8.41 acres. The applicant is proposing to
construct gravel parking and an office, both having a total
effective impervious surface area of 130,360 square feet.
The effective impervious surface percentage would equate
to approximately 35.6% of the total site area, with no
provisions for stormwater control. It is expected that
fecal coliform violations will occur as a result of
sheet runoff from the project into waters classified SA.
3. The proposed 176 wet slip marina is expected to cause fecal
coliform violations in waters classified SA, regardless of
the proposal to install pump-out facilities.
Petroleum fueling within the basin will likely result in
fuel spills, thereby violating water quality standards.
4. A 30' buffer does not exist between areas considered to be
impervious surface areas and the MHW contour, nor is grading
or sloping demonstrated to divert stormwater runoff from
entering waters classified SA.

5. The project is located within an area that borders on being
open and temporarily closed to she11fishing. Fecal
coliform violations may cause closures of shellfish harvesting
areas, thereby removing the intended use of those waters, violating
the State's antidegredation standard 15 NCAC 2B .0201.

a 12 acre site at the end of S.R. 1568 at SeaSide, Brunswick County.

9(a) SITE DESCRIPTION:
The project site is comprised of a 12.5 acre tract located at the end of S.R. 1568
at Seaside just east of the "Old Brooks Fish House" building. An existing 1,000'
wooden :bulkhead runs the perimeter of the shoreline along the AIWW. A 30' -60' wide
fringe of cordgrass (Spartina alterniflora) marsh lies along the toe of the bulkhead.
A fine sand/silty intertidal bottom extends 100' out from the marsh out to the mean
low water (MLW) contour. The mean high water contour (MHW) runs along the bulkhead.
The upland area is relatively flat and is a large grassed yard area with a few live
oaks scattered throughout. The estuarine shoreline averages 7' above MSL and has a
.- gentle slope towards the AIWW. The site is classified secondary nursery with SA
waters.
9(b) PROJECT DESCRIPTION:
The applicant's propose to excavate a highground commercial marina having a total of
176 slips. A 40' wide by 120' long entrance channel is to be eut from the upland
basin through the existing wall and marsh fringe out to the AIWW. Two 100' long low
level entrance jetties are to be installed on either side of the dredge cut. A
1,900' long wooden bulkhead will be.. installed around the inside of the 685' by 265'
basin. It will be above MHW. Another 120' x 40' boat ramp access channel will also
be cut into highground through the marsh and wall. It will have approximately
25 cubic yards of concrete placed below the MHW contour measuring 40' in width by
30' in length. Two 100' jetties are to.be installed here as well. The boat basin
is to be dug by dragline starting at a landward depth of -6' (MLW) down to -8' (MLW)
at the AIWW. A 30' to 45' grassed buffer will.surround the basin as well as a 6'
wide wooden boardwalk. An office building is proposed near the center of the tract
surrounded by a 268 space gravel parking lot. A 60 space gravel car and trailer
parking area 1s..a1so.proposed adjacent to the public boat . ramp. Two gas pumps will
be. situated at:.the end of the.main service dock with two underground tanks, to be
installed b~;thebui1dingas Ulust%,ated on the attached blue line drawings.
Also seven sanltarysewage pumping . connections Will be located along the docks. An
underground sewage 'ho1ding tank Will be provided. The assortment of boat slips will
range from 20' to 40' in length and 10' to 18' in width. All docks will be floating
except for the 10' wide stationary center dock.
10. ANTICIPATED IMPACTS:
The project as proposed will cause the loss of approximately 2,640 s.f. of cordgrass
marsh (Spartina alterniflora) for the entrance channel and ramp and excavate 8,800 s.f.
of sand/silt intertidal habitat along the AIWW edge for the two access channels.
Approximately 50,000 cubic yards of upland spoil will be trucked off the site for the
4.1 acre marina highground basin. Some of the spoil will be utilized behind the
1,900 linear feet of bulkheading in order to slope the site away from the water as
proposed. When combined the roadway and gravel parking areas total 3.6 acres and the
building totals 3,600 s.f. of surface area. This comprises 29% of the tract. The
marina basin takes up one third of the tract with the remaining 48% being comprised
of "grass buffers" and wooden boardwalks. According to existing CAMA rules the
site would be covered with 8% impervious cover within the 75' "Estuarine Shoreline"
AEC.

The greatest potential impact from the project is from the long term operation of a
marina facility. The daily tidal amplitudes average 5.8' with spring highs reaching
7.0' in total range. The proposed 40' entrance channel may be too narrow for the
propo~ed basin size. The bottom slope as designed will also be an important factor
for flushing characteristics. Fueling facilities could increase potential impacts
in the are from accidental spillage. The full service concept with seven sewage
pump out stations is a much needed service for the presently heavily traveled AIWW.
It is only a guess determining how many boaters with holding tanks would utilize
this needed pump out service. The proposed public boat ramp with 60 parking spaces
is much needed in this area. particularly since the wildlife resource ramp 1.600'
tp the west has been abandoned. The applicants claim that this is an important
neighborhood amenity for their project.
