Narrative description The Topland Corp. recently purchased the old Gulf Station property located on the north side of Hwy. 24 in the Town of Swansboro on the White Oak River between Elm and Water Streets, Onslow County. The applicant proposes to redevelop the site by removing all exist- ing structures and building a series of 8-10 condo units. The plans include bulkheading the shoreline and installing individual finger piers. At present there are.several old structures on the property includ ing the cinderblock gas station building with concrete parking lot and service area, a one-story brick frame house with base- ment, the remnants of a smaller single-family house with porch, and an old boat shed leading to the water's edge. The location of each of these structures is well documented on Sheet 2 of 8 of the work plat drawings. Over the years, the shoreline has been stabalized with riprap and other sorts of concrete rubble. Work plat drawing Sheet 3 of.8 shows clearly all of. the proposed structures and associated development. As proposed, a 177' long bulkhead will be installed along the shoreline at a point some 2' landward of the MHW shoreline. The top elevation of the bulkhead at some 5' will allow the applicant to fill and landscape on the landward side of'the structure. This will create•a negative slope away from the bulkhead so that runoff water cannot easily enter the surface waters of the White Oak River. Near the existing boat shed the bulkhead will displace approximately 25 sq.ft. of salt marsh cordgrass and about 240 sq.ft..of intertidal bottom land. A pedestrian boardwalk of about 170' in length will be constructed along the top of the bulkhead over the highground property. The boardwalk should measure about 6' wide. A 20' by 12' gazebo will be located on the highground property next to the bulkhead and cen- tral to the project. The developers want to offer individual boat slips for each of the ten condo units.. To do so, they are proposing to construct five perpendicular piers 2' wide and 12' long. The water depths in the White Oak River and in the little boat channel that runs along the face of the property average 2-5' deep. Approxi- mately 50' across the small boat channel,is an existing intertidal salt marsh island that borders the waterway. The surface waters of the White Oak River in this area were reclassified by DEM from the SC classification to that of SA in December of 1979. Nevertheless, these`same waters are permanently closed to the harvesting of shell- fish. The project site is located within the historical district of the Town of Swansboro. In keeping with the building code requirements, the applicant has provided a promotional sales brochure that includes r an artist's rendering of the proposed.condominium units. In addi- tion, the architectural facade of the condo buildings is further i i demonstrated on one of the additional work plat drawings. There are eight distinct condominium units shown on work plat drawing No. 3 of 8. These townhouse type structures are set back some 30-50' from the proposed bulkhead. Each unit will average 16' wide by 32' long. The first cluster of units will contain three townhouses. The second cluster will be made up of five units. As shown on the work plat, the final floor elevation will be ll'-above MSL. This should meet the federal flood requirements as administered by Onslow County. .The applicant has made certain mathmatical calculations which address the amount of surface area within the CAMA 75' area of environmental concern. As listed on work plat Sheet 6 of 8, 410 or 5,440 sq.ft. of land will be converted into impervious surface . areas. The condo units account for about 3,253-sq.ft. of this im- pervious figure. Between Hwy. 24 and the CAMA 75' line the project plans call for a large parking lot and concrete sidewalk leading to the respective- condominium units. Porous pavers will be used in the parking lot area to reduce the overall amount of impervious surface areas. A stormwater management plan is presented in this overall application package. On Sheet 6 of 8,•a note is made that the condominium units will be guttered and drained to the parking lot area where it will intersect with a subterrainian pipeline system about 140' in.length. This perforated pipe system will have a retention capacity of 4,612 cu.ft. of water.. The slotted drainpipe system is further dia- gramed on Sheet 8 of 8 of the work plat drawings. Curriousiy, on Sheet 2 of 8 and 7 of 8 there is shown an existing 12" stormwater drainpipe leading from Hwy. 24 under the gas station and discharging into-the river. It can* only be presumed that this pipe will remain in place and operative even after the proposed project has been com- pleted. DEM will have to accept and approve the applicant's stormwater manage- ment plan before development can be authorized. 10. Anticipated impacts - It would appear from the initial review that the proposed project will have little to no significant impact on the estuarine resources in the immediate area of the White Oak River. This evaluation may change if the applicant's stormwater management plan is not acceptable in its capabilities to contain or retain stormwater runoff. CAMA-REVIEW The 1986 LUP update for the Town of Swansboro was con- sulted. The highground property is classified as "developed" and the surface waters as "conservation." It is clear that the proposed de- velopment will be serviced by the municipal water and sewer services that make up the sanitary district within Swansboro. Other than cer Itain requirements.of the historical district, no development constraints can be identified through reading the LUP that would create any major inconsistency with the policies of the LUP. Bean, Sr., for a Department of the Army permit to construct and backfill a bulkhead and to construct a boardwalk and piers associated with a condominium development on the White Oak River in Swansboro, Onslow County, North Carolina. _The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be positioned in strict accordance with permit plans. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. C. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. -2- e. If the display of lights and signals on the authorized structure is not otherwise provided for bylaw, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. f. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. The permittee will not hold the United States liable for any such damage. g. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. h. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge.
