Holst and Shields, I visited the above referenced site on 8/13/2019 to evaluate compliance with the Nationwide Permits 12, 14, and 18 verified for use on 4/16/2018. Culvert and fill for the road crossing (stream impacts) and sewer (stream and wetland impacts) have been installed. The following item was noted during the compliance inspection: 1) The culvert is currently perched by 2-3" on the upstream end and —6" on the downstream end (see attached pictures). Project plans as well as NWP 14 Regional Condition 3.6.1 require that this culvert inverts be buried one foot below the bed of the stream. 2) The downstream rip rap pad as installed included layers of rip rap above the original stream bed elevation (see attached pictures).The rip rap was permitted such that the top of the rip rap should be no higher than the original stream bed elevation (see attached plansheet). Further, NWP 14 General Condition 2 requires that the permitted activity may not substantially disrupt aquatic species movement. In order to resolve this permit non-compliance issue, submit a plan for Corps and NCDWR approval that allows the culvert pipe to comply with NWP 14 Regional Condition 3.6.1. Further, remove excess rip rap such that the rip rap is embedded in the stream bed sediment, allowing low flow water in the stream to flow over the top of the rip rap. It is suggested that the embedded rip rap be limited to an area the width of, and lined up with, the downstream stream channel (see attached example). This remedial action must be completed within thirty (30) days of the date of this email. Once complete, please arrange a follow-up site visit with me or email pictures showing that the remedial actions are complete. Please let me know if you have any questions.
