Dear Mr. Wrobleski:

Reference your application for a Department of the Army permit
to excavate two basin areas and construct a dock on Pamlico Sound,
Silver Lake, near Ocracoke Village, Hyde County, North Carolina.

Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-029i. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.

If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This pennit, issued on 17.121. / g {, , is subject to compliance with the application (where consistent
with the pennit), all applicable regulations: special conditions and notes set forth below. Any violation of these tenns may subject.
permittee to a fme, imprisonment or civil action; or may cause the pennit to be null and void.

(1) Excavati on equfpment worki ng in the water and wetlands wi 11 be supported
by mats.

(2) The temporary placement or double handling of excavated or fill materials
within waters or veg~tated wetlands is not authorized.

(3) Vegetated wetlands will not be excavated. A minimum of 10 feet will be left
between the area to be excavated and the adjacent wetlands to avoid loss
oT wetlands by sloughing of the basin's side cuts.

(4) No excavated or fill materials will be placed at any time in any vegetated
wetlands or waters of the State.

(5) Excavation will not exceed 6 feet below the elevation of mean low water (MlW).

(6) All excavated materials will be confined landward of the mean high water
(MHW) elevation contour and any regularly or irregularly flooded vegetated
wetlands. (S~e attached sheet for Additional Conditions

This penn it action may be appealed by the pennittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This pennit must be accessible on.site to Department
personnel wben the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.

December 31. 1989

agrees that your project is consistent with the North
Carolina Coastal Management Program.

ANTICIPATED IMPACTS:

The proposed dredging in the closed shellfish waters of Silver Lake will
result in the deepening of 4,350 square feet of shallow water habitat. Mats
will be temporarily placed into the water to allow the dragline to reach the
outer limits of the proposed dredging. Care must be taken during dredging to
prevent the excavation of the fringing marsh and containment of material during
placement of the spoil into dump trucks. Tne spoil disposal area must be staked
to insure that the area is a sufficient distance from adjacent waters. The proposed
construction of a deck waterward of .the cafe must be reviewed to determine its
contribution to impervious surfaces. . , .

The project site is classified as developed in the Hyde County LUP. This
proposal is consistent with that plan. Thi,~ proposal is being sent to Hyde County
for their review to determine if any other special local regulations apply.

Dear Mr. Parker:

Reference the application of Mr. Edward L. Wrobleski for a
Department of the Army permit to excavate two basin areas and
construct a dock with mooring piles on Silver Lake, Pamlico Sound,
near Ocracoke Village, Hyde County, North Carolina.

The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.

We recommend that the following conditions be included in the
State authorization:

a. Excavation equipment, working in waters/wetlands, will be
supported by mats.

b. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.

c. Vegetated wetlands will not be excavated.

d. No excavated or fill materials will be placed at any time
in any vegetated wetlands or waters of the State.

e. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).

f. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded vegetated wetlands.

g. Representatives from the North Carolina Division of
Coastal Management and the Corps of Engineers will stake the
limits of the excavated material retention area prior to
construction.

h. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work.

i. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without transferring it to a third
party.
