The modification is for development of Phase II of the same project. This office has been notified by the Division of Environmental Management that additional information regarding stormwater runoff will be required before they can complete their review of your project. Specifically, a demonstrat i on that no stormwater runoff wi 11 enter Bogue Sound as a resul t of the proposed project, using final grade maps of both tracts and surrounding areas, has been requested by the Division. It is understood that you have been contacted by representatives of OEM, but have not submitted the requested information. Therefore, until the DD~ has received this information, final review of your project by thi soffi ce must temporari ly be held i n abeyance. (1) The project wi 11 be conducted in accordance wi th the fo 11 owi ng pl ats: For phase I,.. sheet 1 of 2 dated 8/30/84, sheet 2A of 2 dated 9/3/85 and sheet 2A of 3 dated amended 9/21/84; for phase II, sheets 1-3 of 3 dated 7/12/85. (2) The accessway mus~ be for pedestrian use only and be less than six feet in width. (3) The accessway must be rai sed on posts or pi 1 i ngs of fi ve feet or 1 ess depth, so that wherever possible, only the posts or pilings touch the frontal dune. (4) Any areas of vegetation that are disturbed shall be revegetated as soon as feasible. Any building construc- ted within the ocean hazard area shall comply with Appendix D, "Windstorm (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. C. Residential Building Code, except that.when any provisions of. that appendix are inconsistent with any of the AEC standards, the "lOre restrictive provisions shall control. (6) All structures in the ocean hazard area shall be on pi 1 i ngs not 1 ess than eight inches in diameter if round or eight inches to a side ,if square. (7) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. (8) All pilings shall be appropriately treated to resist decay, insects and corrosion. (9) All exposed structural connections shall be adequately rust-proofed or enclosed. (10) (11) (12 ) NOTE: NOTE: rmE: The lowest portion of the structural member of the lowest floor (exc 1 udi ng the pi 1 i ngs or co 1 umns) shall be elevated to or above the 100 year storm elevation which is a minimum base elevation of 11 feet above mean sea level. All ut i 1 i ty systems shall be located and constructed so as to mi ni mi ze or eliminate storm damage. All wall s below 100. year base flood level shall be designed and installed to: a. a 11 ow storm waters to ri se and flow free 1y under the structure, b. not permi t the breakaway wall s themse 1 ves to become waterborne debri s, and, c. not cause! the accumulation of waterborne debris. 'Breakaway walls shall be intended to collapse under stress without jeopardizing the structural support of the structure. The permittee i~ requested to protect the maritime woods canopies as much as possible when cutting out for the proposed facilities. I n order to protect hatch 1 i ng sea turt 1 es, all 1 i ghts on the bui 1 di ng face, including balcony lights, on the oceanside of all structures should be eliminated. Where oceanside lighting is required, alternatives include shading, screening, or replacing' fixtures with modern alternative light sources. Also,' parking lots, streets, tennis courts, walkways, dune crossovers, pools and other areas requi ri ng 1 i ghts should be ill umi nated with light fixtures located close to the ground to minimize casting direct light on the beach and dunes. The permittee is reminded that seawalls or riprap revetments will not be allowed in the future should the townhouse structures become threatened from erosion. The permittee is reminded that the oceanfront setback must be reestablished immediately prior to the initiation of construction. NOTE: A revised Erosion and Sedimentation control plan will be required for this project. This plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. Narrativedescription This Bogue Banks project site is located just inside Indian Brach town- line due west Of PKS off Hwy. 58 and the Atlantic Ocean in Carteret County. Windward Development Coo is in the proces.s ofcomp1et-ing con- struction on Phase I of their 48 unit condominium project as authorized by CAMA Permit No. 253-84 which was issued on Nov. 29, 1984. The de- velopers have recently acquired the adjoining tract of land imme- diately east of Phase I. This oceanfront property is approximately 600' deep off Hwy. 58 and 242' wide along the dune line. In addition to this tract of land, the owners have also picked up approximately o~e acre of highground property on the north side of Hwy. 580 At this time the ap- plicant proposes to modifythei~ existing CAMA permit to allow construc- t 'j 0 n and d eve lop men t. 0 f P has e I I to be k now n a s .W i n d war d Dun e s II .. ' Phase 11 is almost a mirror image of Phase I. Phase II will invQlve the construction of an 8-story building, housing some 48 individual condo units. The 6900 sq.ft. building will have a finished grade of +19' and will be supported on concrete pilings at a point some 160' landward of the first line of stable vegetation. At a distance of 120' a wooden retaining wall will be constructed in order to separate the AEC from the proposed swimming pool area which will be just in front oft h e con d 0 m i n i u m b u i 1 din 9 . As with the construction and design techniques used in Phase I, a limited amount of grading and filling must be accomplished prior to construc- tion. This will allow for the proper siting of the condominium build- ing and various parking spaceso Individual parking will be provided between the high-rise building and Hwy. 58. Across Hwy. 58 tennis courts an~ an overflow parking lot will be developed. The wastewater treatment facility for Phase II will also be located in this general area. There is a possibility that the original location site for Phase I package plant will be relocated and expanded to accommodate Phase II. If this is the situation, the applicant will be required to furnish additional revised drawings showing the modifidied development. It is interesting to note that the applicant's property does not extend all the way to Bogue Sound on the north side of Hwy. 58, but rather termi- nates about 1,000' from Bogue Sound. 100 Anticipated impacts Approximately two acres of dune vegetation and live oaks will be dis- placed by the site preparation for the condo building and parking lot areas. This will be accomplished in accordance with development pro- cedures for natural areas as implemented by the Town of Indian Beach. In addition, the CAMA ocean erodible AEC will remain virtualy unchanged by the projecL This area has further been classified as IIconservation" by the town's LUP and, therefore, no inconsistencies can be identified for the proposed development. The application was received 4 months ago and with comments dated 25 October 1985, submitted by this office. A review of the requested information received 16 January 1986, indicates that the entire project contains 14% impervious surface area. The ocean side tract comprises of a 5,204 ftz 8 story condominium structure and 31,040 ft2 parking areas. The oceanside tract contours indicate a road- side grade elevation of t12 feet, while the inner parking areas inciate an elevation of t8 feet. According to the plans, storm water would be contained within the center of the oceanside tract with no chance of stormwater sheet flow toward the road or Bogue Sound. Plans were also submitted for the sound side tract comprising of a parking lot, waste- water treatment plant and tennis courts. The total impervious surface area of the sound side trace is approximately 8.5%. Fruthermore, the impervious surface areas are located no less than 800 feet from Bogue Sound. Varying contours on the soundside tract would further prevent any stormwater runoff from entering the surface waters of Bogue Sound in the event of a 100 year-24 hour storm. It is, therefore, the conclusion of this office that the proposed project will adequately protect water quality from stormwater runoff. The project will not require a 401 Certification. 2. The information submitted is inadequate to determine whether stormwater runoff will impact the SA waters of Bogue Sound. In order to complete an evaluation of the impacts of this project the following information is necessary: a) Does stormwater runoff from the oceanside tract enter N.C. Hwy 58 ditches and subsequently reach the waters of Bogue Sound by drainage ditches or by culvert pipes? and b) Does stormwater runoff from the soundside tract enter ditches or stormwater pipes discharging to Bogue Sound? It will be necessary that the applicant successfully demonstrate that no stormwater runoff will enter BQgue Sound as a result of the proposed project. A final grade map~of both tracts and surrounding areas will be most useful in making our final determinations in this matter. Previous contacts by our staff with Mr. Collins to obtain the information described above have been unsuccessful. Narrative description This Bogue Banks project site is located just inside Indian Brach town- line due west of PKS off Hwy. 58 and the Atlantic Ocean in Carteret County. Windward Development Co. is in the process of comp1eti.ng con- struction on Phase I of their 48 unit condominium project as authorized by CAMA Permit No. 253-84 which was issued on Nov. 29, 1984. The d~- ve10pers have recently acquired the adjoining tract of land imme- diately east of Phase I. This oceanfront property is approximately 6001 deep off Hwy. 58 and 2421 wide along the dune line. In addition to this tract of land, the owners have also picked up approximately one acre of highground property on the north side of Hwy. 58. At this time the ap- plicant proposes to modify their existing CAMA permit to allow construc- t ion and de vel 0 pm en t 0 f Ph a s e I I to be k now n a s 'W i n d war d Dun e s II . Pha~e II is almost a mirror image of Phase I. Phase II will involve the construction of an 8-story building, housing some 48 individual condo units. The 6900 sq.ft. building will have a finished grade of +191 and will be supported on concrete pi'lings at a point some 1601 landward of the first line of stable vegetation. At a distance of 1201 a wooden retaining wall will be constructed in order to separate the AEC from the proposed swimming pool area which will be just in front of the condominium building. A pedestrian wftlkway measuring about 1501 long and 61 wide will provide ocean access across the dune line. As with the construction and design techniques used in Phase I, a limited amount of grading and filling must be accomplished prior to construc- tion. This will allow for the proper siting of the condominium build- ing and various parking spaces. Individual parking will be provided between the high-rise building and Hwy. 58. Across Hwy. 58 tennis courts and an overflow parking lot will be developed. The wastewater treatment facility for Phase II will also be located in this general area. There is a possibility that the original location site for Phase I package plant will be relocated and expanded to accommodate Phase II. If this is the situation, the applicant will be required to furnish additional revised drawings showing the modifidied development. It is interesting to .note that theapplicantls property does not extend all the way to Bogue Sound on the north side of Hwy. 5a, but rather termi- nates about 1,0001 from Bogue Sound. 10. Anticipated im~acts Approximately two acres of dune vegetation and live oaks will be dis- placed by the site preparation for the condo building and parking lot areas. This will be accomplished in accordance with development pro- cedures for natural areas as implemented by the Town of Indian Beach. In addition, the CAMA ocean erodible AEC will remain virtualy unchanged by the project. This area has further been classified as IIconservationll by the townls LUP and, therefore, no inconsistencies can be identified for the proposed development. Submitted by James L.
