Enclosed is the application of the City of Wilmington for a
Department of the Army permit and a State Water Quality
Certification to construct a sewage pump station adjacent to
Hewlett's Creek in New Hanover County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request
for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by April 3, 1986, the District Engineer
will deem that waiver has occurred.

Gentlemen:
On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 31, 1986, for a
Department of the Army permit to construct a 63-foot by 75-foot
reinforced concrete, block and brick sewage pump station off
Clearbrook Drive, adjacent to Hewlett's Creek in New Hanover
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 404 of the Clean Water
Act, has been assigned No. SAWC086-N-065-0118 and will be

OPERATIONS BRANCH
Reference the application of the city of Wilmington for a
Department of the Army permit to place fill-material in vegetated
wetlands adjacent to Hewlett's Creek off Clearbrook Drive to
construct a sewage pump station, Wilmington, New Hanover County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. All fill material will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials, or
unsightly debris will not be used.
b. No excavated or fill material will be placed in any
location or in any manner so as to impair surface water flow into
or out of any wetland area.
c. Preconstruction substrate and wetland bottom contours will
be restored. All excess material will be removed to an upland
retention area.
d. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.
e. Silt barriers will be installed between disturbed areas
and waters and wetlands.

Reference your application for a Department of the Army permit

Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Dear Sirs:
Persuant to the subject Public Notice regarding an application
by Six-Rhodes, Incorporated, in a Department of the Army permit to
place sand fill material in forested, freshwater wetlands on a back-
water prong of Greenfield Lake, this letter is to advise of the
following City of Wilmington concerns:
1. The filling of a portion of this wetlands prong will
significantly reduce the available "stilling" area along this
tributary to Greenfield Lake.
2. Storm water quality may also be affected by reducing the
area of natural filtration. The City has recently retained a con-
sultant to study the water quality problems in Greenfield Lake.
The results of this study will not be available until late Spring
or early Summer of 1986. It is the City's desire that the permitted
activities in this area be compatible with this study.
The City of Wilmington understands that the time period for
written response to the public notice has been extended and would
appreciate proper consideration being given to the above concerns.

This permit, issued on "1 ` 30 ` is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
IL. .
(1) In order to protect juvenile shrimp and fin fish populations, no excavation
or filling will be permitted between April 1 and September 30 of any year
without the prior approval of the Division of Coastal Management.
(2) All fill material will be clean and free of any pollutants except in trace
quantities. Metal' products, organic materials, or unsightly debris will
not be used.
(3) If the excavated.materi_al from the.

(4) No excavated or fill material will be placed in any location or in any manner
so as to impair surface water flow into or out of any wetland area.
(5) Preconstruction substrate and wetland bottom contours will be restored.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989

fill material into a wetlands area adjacent to the waters of Hewlett's
Creek in conjunction with the proposed utility line crossings and lift
station in New Hanover County will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore,
the State of North Carolina certifies that this activity will not
violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions hereinafter
set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream-is 25 NTU's or less
are not considered significant).
2. That the backfill material shall be comprised of
clean upland sand or sand material from the
excavation.
3. That silt screens shall be utilized downstream
of the utility line crossings and adjacent to the
proposed lift station to reduce sedimentation and
turbidity impacts.
4. That road embankments and the lift station site be
stabilized with vegetation immediately after
construction.
5. That wet concrete shall not be allowed to enter the
surface waters of the State during construction of
the encasement.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

The applicant proposes to construct a sewer lift station and water and sewer
lines along Greenville Loop Road at Clearbrook Drive. The lines are proposed to
be installed beneath Hewletts Creek, classified SA.
The project has been reviewed to determine impacts to water quality. The
following comments are provided:
1. The project will require 401 certification, and should contain the following
conditions:
a. Wet concrete shall not enter the surface waters in the creek during
construction of the encasement.
b. Turbidity shall not exceed 25 NTU in the receiving stream due to the
project activity.
c. Backfill material shall be comprised of clean upland sand or sand material
from the excavation.
d. Silt screens shall be constructed downstream of the pipeline crossing
and adjacent to the proposed lift station site, to reduce sedimentation
and turbidity.
e. Road embankments and the lift station site shall be stabilized with
vegetation immediately after construction.
2. This office has no objection to the project if the above conditions are met.

9. PROJECT DESCRIPTION
The project will be located at the intersection of Greenville Loop Road and
Clearbrook Drive. The shoulders and the area adjacent to the north and south side
of Greenville Loop Road and the area east and west of Clearbrook Drive have been
recently distrubed in conjunction with the maintenance of the existing roadbeds.
The lift station site has been modified from the original site to avoid the 11404"
wetland area between the new location and Greenville Loop Road. Just waterward
of the proposed pipeline project area are scatter clumps of Giant Cordgrass,
black needlerush and Sea-Oxeye. There are two drainways of the existing unnamed
tributary to Hewletts Creek which crossess under Greenville Loop Road via culverts.
The wetlands are approximately 156' wide at this location.
The applicants propose to install two pipleines just off the shoulder of the
roadbed. The line closest to the road will be a 12" water line. The other line
is a 10" sewer outfall line. These two lines will provide water and sewer to
the recently annexed portions of the City. The water line will be covered
under the larger stream. The sewer line will cross under both drains. A
companion hydrogen peroxide 3/4" aluminum line will be installed above the
sewer.line. The sewer line will connect to the proposed lift station north of
Greenville Loop and east of Clearbrook Drive. Both lines will be concrete
encased under the stream segments. The applicants estimate that approximately
400 cubic yards of material will be used to backfill the pipeline trenches.
10. ANTICIPATED IMPACTS:
The area through which the pipelines will be aligned is at the edge of the
wetlands associated with this unnamed tributary. Providing that a silt barrier
is installed along the edge of the disturbed area and the area is returned to
existing grade no.long term adverse impacts are anticipated. The lift station
was relocated above the "404" wetland in order to avoid impacts in this area.

Pursuant to NOGS 113A-119(b) and 143-215 3(a)(1)(c), the Department of
Natural Resources and Oonminity Development hereby gives Public Notice
that The City of Wilmington "Area B"
filed an application on February 18, 1986 for a permit from the
Divison of Coastal Management to develop in an Area of Environmental
Concern and for Certification from the Division of Environmental
Management that a discharge of fill material in project wetlands will
not violate applicable Water Quality Standards.
According to said application, City of Wilmington "Area B" proposes to
install utility lines within and-adjacent to the north shoulder of
Greenville Loop Road (S.R. 1421) and to install a lift station along
the east side of Clearbrook Drive just north of its intersection with
Greenville Loop Road.
A copy of the entire application and additional information may be
examined (or copies furnished, upon payment of reproauction costs) during
normal business hours at the Division of Coastal Management and/or the
Division of Environmental Management, Regional Office, 7225 Wrightsville
Avenue, Wilmington, North Carolina 28403.
The Division of Environmental management proposes to take final action on
this water quality Certification on or after April 7, 1987 . The

issuance of the CAMA Major Development and the Section 401 Certification
may deviate from this projected date depending upon the nature of the
ocm,rents submitted and subsequent hearings that may result.
