Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by April 3, 1986, the District Engineer will deem that waiver has occurred. A review of your application received January 31, 1986, for a Department of the Army permit to construct a 63-foot by 75-foot reinforced concrete, block and brick sewage pump station off Clearbrook Drive, adjacent to Hewlett's Creek in New Hanover County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. b. No excavated or fill material will be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. c. Preconstruction substrate and wetland bottom contours will be restored. All excess material will be removed to an upland retention area. d. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. e. Silt barriers will be installed between disturbed areas and waters and wetlands. The filling of a portion of this wetlands prong will significantly reduce the available "stilling" area along this tributary to Greenfield Lake. 2. Storm water quality may also be affected by reducing the area of natural filtration. The City has recently retained a con- sultant to study the water quality problems in Greenfield Lake. The results of this study will not be available until late Spring or early Summer of 1986. It is the City's desire that the permitted activities in this area be compatible with this study. The City of Wilmington understands that the time period for written response to the public notice has been extended and would appreciate proper consideration being given to the above concerns. Project summary The applicants'propose to install utilit lines within thhe north shout o reenvi a oop oa an to install a lift station along the east side of Clearbrook Drive just north of its intersection with Greenville Loon Road. City of Wilmington - "Area B" Page 2 9. PROJECT DESCRIPTION The project will be located at the intersection of Greenville Loop Road and Clearbrook Drive. The shoulders and the area adjacent to the north and south side of Greenville Loop Road and the area east and west of Clearbrook Drive have been recently distrubed in conjunction with the maintenance of the existing roadbeds. The lift station site has been modified from the original site to avoid the 11404" wetland area between the new location and Greenville Loop Road. Just waterward of the proposed pipeline project area are scatter clumps of Giant Cordgrass, black needlerush and Sea-Oxeye. There are two drainways of the existing unnamed tributary to Hewletts Creek which crossess under Greenville Loop Road via culverts. The wetlands are approximately 156' wide at this location. The applicants propose to install two pipleines just off the shoulder of the roadbed. The line closest to the road will be a 12" water line. The other line is a 10" sewer outfall line. These two lines will provide water and sewer to the recently annexed portions of the City. The water line will be covered under the larger stream. The sewer line will cross under both drains. A companion hydrogen peroxide 3/4" aluminum line will be installed above the sewer.line. The sewer line will connect to the proposed lift station north of Greenville Loop and east of Clearbrook Drive. Both lines will be concrete encased under the stream segments. The applicants estimate that approximately 400 cubic yards of material will be used to backfill the pipeline trenches. 10. ANTICIPATED IMPACTS: The area through which the pipelines will be aligned is at the edge of the wetlands associated with this unnamed tributary. Providing that a silt barrier is installed along the edge of the disturbed area and the area is returned to existing grade no.long term adverse impacts are anticipated.
