with the pennit), all applicable regulations, special conditions and notes set forth below. Any violation of these tenns may subject
pennittee to a fine, imprisonment or civil action; or may cause the pennit to be null and void.

(1) Any new catch basi ns added to the system must have mai ntai nab 1 e sediment
traps.

(2) The activity shall be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge (increases of 25 NTUs or less, are not considered significant).

NOTE: Prior to any construction authorized under this permit, an Easement is
required from the Council of State through the State Property Office.

This pennit action may be appealed by the pennittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This pennit must be accessible on-site to Department
personnel when the project is inspected for compliance,
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
- AIi work must cease when the pennit expires on
December 31. 1989

In issumg this pennit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

8. Project summary The applicant proposes to install a new storm sewer outfall to
replace a failed system. The outlet will be to the'waters of the Cape Fear River.

9. PROJECT DESCRIPTION:

The project is located in an area of the City known as Sunset Park. There is an
existing storm water system serving the area. The outfall for this system is
apparently collapsed. The drainage area served by this system is approximately
6.0 acress. The Wilmington State Ports Authority (SPA) is west of the drainage
area. The SPA has quite an extensive area which has been converted to "hard-
stands" with impervious surfaces. The Cape Fear River is classified as SC
waters and is designated primary nursery area.

The City plans to install a new outfall along Virginia Avenue in the project
area. Approximately 800 linear feet of 66" RCP will be installed. The trench
will be approximately 6' wide. Therefore approximately 4,800 cubic yards of
material will be manipulated in carrying out the construction. It will be
necessary to cross the SPA in order to reach the Cape Fear River. The water-
ward end of the pipe will terminate approximately 15' waterward of the mean
high water ~) contour. It will also end underneath an existing concrete
pier. Current plans show the invert of the pipe lower than MHW.

10. ANTICIPATED IMPACTS:

In order to maintain adequate drainage we would recommend that the bottom of
the pipe be raised above the MHW contour. The actual impact of storm water to
the river at this location shall have no impact on coastal resources.
