Dear Mr. Mills:

Enclosed is the application of the City of Wilmington,
represented by Staff Engineer Michael D. Payne, for a Department
of the Army permit and a State Water Quality Certification to
place excavated and fill material in waters and wetlands to
facilitate the piping of the eastern prong of Sweetwater Branch,
Wilmington, New Hanover County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our
administrative regulations. We will not announce this proposal by
public notice; therefore, there will not be an opportunity for
coordinated advertisement.

We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.

In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by February 10, 1987, the District
Engineer will deem that waiver has occurred.

Re: Storm Drainage Improvements
Sweetwater Branch

Enclosed is an,t!lpplication for a permit to excavate and/or to fill
in connection with piping and realigning the eastern prong of Sweetwater
Branch.

The work plats attached to the permit application should clarify the
nature of the work involved.

The purpose of the project is to decrease the time required to maintain
the ditch and to provide more developable and aesthetically pleasing land.

The City of Wilmington does not believe that the project will create
a significant impact on the environment of the area, and we hope that you
can see your way to issuing us a permit as soon as possible.

Section 401 Public raws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to City of Wilmington pursuant
to an application filed on the 9th day of October, 1986 to culvert and
realign of the east prong of SWeetwater Branch.

The Application provides adequate assurance that the discharge ~f
fill material into a wetlands area adjacent to the waters of the eas'!
prong of ~etwater Branch in conjunction with the proposed stream
changes in New Hanover County will not result in a violation of
applicable Water Quality Standards and discharge guidelines. 'lherefore,
the State of North Carolina certifies that .this activity will not
violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions hereinafter
set forth.

Condition(s) of Certification:

1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant) .

2. Appropriate sedirrentation and erosion control.
measures shall be employed to minimize turbidity
and siltation inpacts from the project.

Violations of any condition herein set forth shall result in
revocation of this Certification.

This Certification shall becorre null and void unless the above
conditions are made conditions of the Federal Pennit.

The applicant proposes to realign and pipe underground the eastern
prong of the Sweetwater Branch, an unnamed tributary of Brunt Mill
Creek, classified C swamp. The project includes the filling of 2,525
square feet of creek bottom. The project has been reviewed to
determine impacts to water quality. The following comments are
offered:

1. That a 401 Certification is required for the filling of the
creek bottom.

2. Erosion control methods should.be utilized to prevent excessive
- turbidity, above 50 NTUs, downstream of construction.

This office has no objection to the project as proposed.

I met on September 23, with Mr. Dave Cotton, to discuss
the above referenced project, with respect to a 401 Water Quality
Certification. This letter is to request D.E.M. approval for
the channel realighment and piping of the eastern prong of
Sweetwater Branch.

The purpose of this project is threefold: first, to
provide better flood protection for nearby property owners;
second, to minimize ditch maintenance; and third, to provide
more developable land for the property owners.

Please note several peculiarities about this project.
In an effort to tie into existing corrugated metal arch pipe,
all of the proposed pipe was sized the same. Since this decision
did not take into account any increase in runoff, both proposed
junction boxes were designed with an opening at the top, to act
as a blow off. This safety device led to the necessity of an
overland swale system, to carry away excess storm water. Finally,
a portion of this project is currently under construction and is
the responsibility of Branch Bank and Trust (BB&T).

The impact that filling will have on the existing stream
ditch will be minimal. The amount of creek bottom area is
approximately 2,525 square feet, and the total estimated select
backfill is 1,669.73 cubic yards.
