Dear Ms. Culpepper:
Pursuant to the Special Order by Consent, EMC SOC WQ S18-010 (the "Special Order"),
entered into by Badin Business Park LLC ("Badin Park") and the North Carolina Environmental
Management Commission, (the"Commission"),this letter is notice of noncompliance with fmal
effluent limits and includes payment of the associated stipulated penalty.
Paragraph 2(a) of the Special Order required Badin Park to attain compliance with the final
effluent limits for external Outfall 005, as prescribed in NPDES Permit No.NC004308 (the
"Final Permit"), by July 31, 2019. The Final Permit requires Badin Park to meet a monthly
average total fluoride limit of 1.8 mg/L and a monthly average total cyanide limit of 5.0
micrograms/L at Outfall 005. The three most recent samples taken at Outfall 005 show
undetectable levels of cyanide; however,the recency of these samples may not support a
consistent demonstration of compliance. Furthermore, Badin Park cannot consistently
demonstrate compliance with the total fluoride limits.
In accordance with the stipulated penalties in Paragraph 3 of the Special Order, enclosed please
find a check in the amount of$5,000 (five thousand dollars) for Badin Park's failure to comply
with final effluent limits.
Badin Park is relentless in its efforts to achieve compliance at Outfall 005 and continues to
explore possible solutions to exceedances. A comprehensive review of sampling data for Outfall
005 indicates further rerouting of stormwater away from the Outfall 005 drainage area may be
appropriate at this time. Baseline concentrations of fluoride at the site further support
developing site-specific criteria for Outfall 005. In addition, Badin Park has identified concerns
with current analytical methods and has initiated a study on the means and methods currently
used for compliance assessment.

With the exceptions noted as flags or footnotes, standard analytical protocols were followed in the analysis of the samples and no
problems were encountered or anomalies observed. In addition all laboratory quality control samples were within established control
limits,with any exceptions noted below. Each sample was analyzed to achieve the lowest possible reporting limit within the constraints of
the method. In the event of interference or analytes present at high concentrations,samples may be diluted. For diluted samples,the
reporting limits are adjusted relative to the dilution required.
RECEIPT
The samples were received on 07/18/2019;the samples arrived in good condition, properly preserved and on ice. The temperature of the
coolers at receipt was 2.7 C.
Receipt Exceptions
The container label for the following sample did not match the information listed on the Chain-of-Custody(COC): Outfall 013
(680-171791-2). The container labels list Outfall 013,while the COC lists Outfall 012. Samples was logged in per the container label.
TOTAL SUSPENDED SOLIDS
Samples Outfall 005(680-171791-1)and Outfall 013(680-171791-2)were analyzed for total suspended solids in accordance with SM
2540D.The samples were analyzed on 07/23/2019.
Total Suspended Solids exceeded the RPD limit for the duplicate of sample 680-171831-1. Refer to the QC report for details.
No additional analytical or quality issues were noted,other than those described above or in the Definitions/Glossary page.
ANIONS BY ION CHROMATOGRAPHY(28 DAY)
Samples Outfall 005(680-171791-1)and Outfall 013(680-171791-2)were analyzed for Anions by Ion Chromatography(28 Day)in
accordance with EPA Method 300.0.The samples were analyzed on 07/20/2019.

With the exceptions noted as flags or footnotes, standard analytical protocols were followed in the analysis of the samples and no
problems were encountered or anomalies observed. In addition all laboratory quality control samples were within established control
limits,with any exceptions noted below. Each sample was analyzed to achieve the lowest possible reporting limit within the constraints of
the method. In the event of interference or analytes present at high concentrations, samples may be diluted. For diluted samples, the
reporting limits are adjusted relative to the dilution required.
RECEIPT
