Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) a) This permit authorizes only twelve (12) residential units of the 144 depicted on the application plats. Construction of additional units and the "future club house" will require a modification of this permit, due primarily to the need for additional review of a water supply system to serve the expansion. The permittee should consider a community water system, approved by the Division of Health Services, or connection to the county system when such system has adequate capacity. b) This permit further authorizes, under the total development review of the CAMA, a setiage treatment plant as approved by the Division of Environ- mental Management, general land scaping and infra-structure as shown on the attached plats, a private well to serve the first phase of construc- tion described in Condition #1 and erosion control features as approved by the Division of Land Resources. (2) The activity shall be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related (See attached sheet for Additional Condition This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (3) The reduction in units that are to be constructed does not remove the requirement to maintain, in perpetuity, erosion and sedimentation controls throughout project site so as to provide water quality protection described in Condition #2, above. NOTE: The permittee has provided reasonable evidence of an adequate volume of water for the twelve units authorized herein. It is recommended that the quality of potable water be assured by treatment as necessary. NOTE: An encroachment agreement may be required from the Dept. of Transportation, Division of Highways to place a sewage line on tre SR 1108 bridge. Contact the D.O.T. Right-of-Way Branch at 919/733-7694 in Raleigh. NOTE: A Sedimentation and Erosion Control Plan has beE!n approved for the project by the Division of Land Resources. NOTE: A slow rate spray irrigation system for sewage disposal is virtually certain to lead to massive mosquito populations, especially in this area where water evaporation/penetration is likely to be slow. Stormwater runoff into wetlands may also produce mosquitoes. Proximity to large, natural salt marsh may leave residents prey to unexpected or uunusually high mosquito levels. For information regarding appropriate mosquito measures, the applicant should contact the Vector Control E;ranch at (919) 733-6407. NOTE: The Division of Environmental Management has issued non-discharging permit #13287 for the development of a sewage treatment plant with capacity to serve future construction up to 48 units. SUBJECT: Application for C-V% Permit White Plains Development Hyde County This memo confirms our earlier discussion regarding the wastewater treatment facility proposed for White Plains, Inc. While the DEM permit for sewage disposal has not been issued to date, we do not foresee problems in issuing our permit once certain engineering problems have been resolved. The soils at the site for the ultimate disposal of the effluent are acceptable according to our field office and the permit should be issued soon. We have no objection to the CAMA permit issuance. By Rule of the CRC we can place the project on hold. Please advise this office at the earliest possible time as to your Division's needs and understanding concerning sewage treatment on this important project. (See narrative) (B) Non-vegetated wetlands: (C) Other: Project site + 34 acres 34 acres (D) Total area disturbed: Project summary The applicant is proposing to develop White Plains Hunting Club, which will consist of 144 multi family units. f Environmental Setting White Plains Inc, is the owner of a 74.3 acre tract of land in Hyde County which is bordered by SR 1108 on the north side, a + 10' wide drainage ditch and dirt road on the east side, the Pamlico Sound on the south side, and a + 70' wide by + 10' in depth canal, which is known locally as Rattlesnake Canal, or White Plains Canal, on the west side. Rattlesnake Canal has been owned and developed since the mid 1970's by Mr. Roland Dale. Various state permits have been issued to Mr. Dale for the development. Existing today on the west side of the canal is a + 200' x + 100' boat basin which can moor ± 24 boats, boat ramp, various cocks and piers, restaurant, several mobile homes, and camper trailer lots. Much of the surrounding land is parking area and agricultural fields. Significant wetland areas bordering Pamlico Sound are present near the southern end of the canal. The development which is being proposed by White Plains Inc. is located entirely on the east side of the canal except for the sewage treatment facility which will be placed in an agricultural area on the west side of the canal. The White Plains Inc. property consists of two distinct areas where the project is proposed. The first area is one which has been denuded of most of the vegetation. Significant land disturbing activities have occurred in preparation for the develop- ment. The other area is a stand of loblolly pine, + 30' in height, much of which has an understory of Garex sip., Myrtles, Iva, and other wetland species. The understory also has a heavy accumulation of pine straw litter. The wetland under- story is probably occurring due to the area being poorly drained. The property has an average elevation of + 2.5' above the normal water level. Of the 74.3 acres owned by White Plains Inc., only 34.0 acres, the area previously described, will be utilized in the proposed project. The remaining acreage is a marsh area which is dominated by Juncus roenerianus. The area is located on the southern end of the property bordering Pamlico Sound. No development is proposed within the marsh area. Proiect Proposal The applicant is proposing the following: (1) The development of 144 multi family units on 34 acres of land on the east side of White Plains Canal. The units will be constructed of wooden materials. The development will occur in phases as follows. Phase I - Construction of units 1 through 6 and 13 through 18 as numbered on the site plan; Phase II - Construction of units 7 through 12 and 19 through 24 as numbered on the site plan; Phase III - Construction of units in a south-easterly direction in groups of 6 or 12 units as sales progress. (2) Sewage - Sewage treatment will consist of a short tern mound subsurface injected system, which will be replaced by 40,000 GPD slow rate spray i=igation land applica- tion treatment system. The sewage treatment facilities will be located on a three and one-half acre site on the west side of White Plains Canal. The sewage line will cross the canal by attachment to the existing bridge which crosses the canal on SR 1108. The pipe will be placed at an elevation so as not to impede navigation. Permission must be obtained from the N.C. Department of Transportation for this action. 2 (3) Domestic Water - Domestic water is available from the Hyde County water system. (4) Stone Water Runoff - A storm water runoff system will be installed one phase in advance of the construction area. From the infonnation provided it appears that some of the runoff will be directed into an existing retention pond, and some of the runoff will be routed to the eastern property line ditch where it will then be pumped across a wooded area and wetlands. A new ditch and bern system will be constructed along the White Plains Canal to prevent runoff from entering the canal. However, any discharge from the retention pond will enter the canal. Environmental Impact Environmental concerns about the project consist of the following: (1) The effects that storm water runoff may have on the water quality of Pamlico Sound which is classified "SA" by the N.C. Division of Environmental Management. Commercial quantities of shellfish are located within the sound near the project. (2) The loss of the wetland understory beneath the pine areas on the project site. This area is dominated by upland vegetation, thus having the characteristics of such. (3) The adequacy of the proposed temporary sewage treatment system, and the adequacy of the permanent sewage system in regards to what effect both may have on adjacent water quality in White Plains Canal and the Pamlico Sound.
