THIS CERI'IFICATION is issued in confonni ty with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of EnviroIlIIEntal Management
Regulations in 15 NCAC 2H, Section .0500 to Wells Managernent Group, Inc.
pursuant to an application filed on the 1st day of December, 1986 to
construct a dam and pond at Weatherhill Project.

The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to ~rgan Creek in conjunction with the proposed dam and pond in Orange
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.

Condition{s) of Certification:

1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidi ty in the Stream is 50 N'IU's or less
are not considered significant).

2. That appropriate sedimentation and erosion control
rreasures be employed to minimize turbidity and
siltation impacts from the project.

Violations of any condition herein set forth shall result in
revocation of this Certification.

'Ibis Certification shall becorre null and void unless the above
conditions are made conditions of the Federal Permit.

Dear Mr. Rintoul:

Thank you for your inquiry of November 19, 1986, regarding our
regulatory program and your plans to accomplish construction in
Tarboro, Orange County, North Carolina.

Enclosed is a pamphlet designed as a guide for applicants that
explains, in general terms, why a permit is required, when a
permit is needed, and how to submit a permit application.

We and the State of North Carolina, having similar regulatory
jurisdiction, have developed a joint application form (enclosed).
This form should be used rather than the Engineer Form 4345 shown
on pages 11 and 12 of the pamphlet. Clear and accurate
information, including drawings, must be provided. Supplemental
pages may be used. Complete application packages should be
furnished to us and the North Carolina Division of Environmental
Management in Raleigh.

After you have reviewed the enclosed information, questions

Dear Mr. Wells:

Reference your and Mr. John Rintoul's November 25, 1986,
meeting with Mr. Jeff Richter of my staff regarding proposed
development adjacent to Morgan Creek, near the Chapel Hill Tennis
Club, Carrboro, Orange County, North Carolina. Mr. Greg Shepard
and Ms. Amy Parker, of the Town of Carrboro's Planning Department
were also present.

The develop~ent is not located within the Corps of Engineer's
regulatory jurisdiction, but a proposed impoundment dam is to be
constructed across regulated wetlands on a tributary to Morgan
Creek. A Department of the Army permit, pursuant to Section 404
of the Clean Water Act, must be obtained prior to the placement of
any excavated or fill material in wetlands. Before submitting an
application to us for this Federal authorization, you must apply
for and obtain a Section 401, Clean Water Act, Water Quality
Certification from the North Carolina Department of Natural
Resources and Community Development, Division of Environmental
Management. A copy of your State Water Quality Certification must
be submitted with your application for Federal authorization.

Dear Mr. Mills:

Enclosed is the application of the Wells Management Group, Incorporated,
represented by Mr. John W. Rintoul, for a Department of the Army permit and a
State Water Quality Certification to place fill material in the waters and
wetlands of a tributary to Morgan Creek to construct an earthen dam,
Weatherhill, Carrboro, Orange County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations. We
will not announce this proposal by public notice; therefore, there will not be
an opportunity for coordinated advertisement.

We are considering authorization of the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification may be required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.

In accordance with our administrative regulations, 60 days after receipt
of a request for certification is considered a reasonable time for State
action. Therefore, if your office has not acted on the request by February 9,
1987, the District Engineer will deem that waiver has occurred.
