Dear Mr. Taylor:
Reference your application for a Department of the Army permit
to excavate a channel in Duck Creek to provide access to a
proposed dry-stack boat facility and to construct approximately
450 linear feet of bulkhead near Bridgeton, Craven County, North
Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permitter to a One, imprisonmant or civil action; or may cause the permit to be null and void,
(1) In order to protect the spawning success of anadromous and resident fish
speciesv no excavation will be carried out in puck Creek or the Neuse River
during the time period of February 1 through July 31, It should be noted
that this condition does not prevent the proposed excavation within the
boat basin behind a plug with such plug to remain i,n place for at least
72 hours after excavation is completed,
(2) Excavation will not exceed 6 feet below the elevation of mean low water
KW), in the drystack canals and 8 feet below MLW in the channel from the
canal to the Neuse River,
(3) The channel width will be limited to 50 feet,
(4) No wetland vegetation will be excavated or filled,
(a) No excavated material will be placed at any time in any marshes or waters
of the State, There will be no double handling of excavated materials,
This permit action may be appealed by the parmittee
or Other qualified persons within twenty (20) days of the
issuing data. An appeal requires resolution prior to work
initiation or continuance, as the pass may be,

personnel when the project is inspected for compliance.

ADDITIONAL CONDITIONS,
(b) A buffer zone, whether natural or artificial, must be provided betwoen ol.l
disturbed areas and natural watercourses,
(7) All excavated materials will be confined on high ground behind adequate
dikes or other retaining structures to prevent spillover of solids into
any marsh or surrounding waters,
(8) The diked disposal area will. be,constructed_ a sufficient distance from the
NWL and any marsh to eliminate the possibility of dike erasion into or upon
any.marsh or surrounding waterways,
(9). The disposal area effluent will be contained by pipe, trough or similar
device to a point at or below the normal low water mark to prevent gully
erosion and resultant unnecessary siltation,
(10) The terminal end of the pipeline will be positioned at or greater than 50
feet from any part of the dike and a maximum distance from spillways to
allow adequate settlement of suspended solids,
(11) A water control structure will be installed at the intake end of the effluent
pipe leading from the retention area in order to ensure maximum settlement
of suspended solids,
(12) Silt fences coupled with slops drains will be utilized to contain the excavated
material and associated runoff.
(13) All graded and/or disturbed areas must be provided with temporary sedimentation/
erosion control measures during active construction and must be provided
with a ground cover within 30 working days (or 120 calendar days) after
the final phase of grading,
(la) All temporary sediment control measures must be maintained throughout the
active construction period until a permanent ground cover has been established,
(la) The spoil area must be properly graded and provided with a ground cover
sufficient to restrain erosion within 30 working days of final placement,
(lb) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge,
(17) All hi ghground construction activities will conform to all local zoning
and building requirements for Craven County,
(18) A pumpout facility for boats with holding tanks will be installed at the
marina and operable by April 1, 1987 or prior to occupancy by any boats
at the marina,
(19) The marina shall prominently post and enforce a no sewage discharge policy,

(20) All floating structures, other than boats, used for habitation or commerce
(as defined in lb NCAC 7M,0602) shall be in conformance with local regulations
for,onshore sewage treatment,
(21) No attempt will be made by the pgrmittee to prevent the full' and free use
by the public of all navigable waters at or adjacent to the authorized work,
NOTE: Any expansion of the marina or its highground development will require
a modification of this permit,
NQTC: Organic sand and muck spoil will potentially breed mosquitoes unless adequate
""drainage for the spoil is planned or a sand cap is placed over it, The
permittee should contact the Vector Control Branch, Environmental Health

Reference the application of Mr. John T. Taylor for a
Department of the Army permit to excavate a channel in Duck Creek
to provide access to a proposed dry-stack boat facility and to
construct approximately 450 linear feet of bulkhead near
Bridgeton, Craven County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to protect juvenile anadromous fish, no
excavation will be permitted between the dates of March 1 and
October 31 of any year without the prior approval of the North
Carolina Division of Coastal Management and the National Marine
Fisheries Service.
b. All excavated material will be confined landward of the
normal water elevation contour within adequate dikes or other
retaining structures to prevent spillover of solids into any marsh
or surrounding waters.
c. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and at a maximum distance from spillways

to prevent dike erosion and to allow adequate settlement of
suspended solids.
d. The bulkhead alignment will be staked by Office of Coastal
Management and Corps of Engineers representatives prior to project
initiation.
e. A water control structure will be installed at the intake

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received January 2, 1986, for a
Department of the Army permit to hydraulically dredge an
additional 900-foot by 50-foot channel to a depth of -8-foot MLW
in Duck Creek to provide access to your proposed Dry-Stack Boat
facilities in Bridgeton, Craven County, North Carolina, indicates
it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of
Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC086-N-025-0099 and will be

9. Narrative Description
State Permit No. 61-75 was transferred, reneledaand modified6in,
the name of J. T. Taylor in 1984• That trance channel, 50' wide
highground boat basin and a 3000' long entrance a separate
and 8' deep leading to the Neuse River. Subsequently,
permit No. 68-85 was issued to J.. Tayliratoad?ointpsa dry sstac ta k dince
storage facility on the same property,
upstream on Duck Creek.
Today, Mr. Taylor proposes to combine those two state permits under
one new permit which will allow iadditiona1d900e upcDuckcCreeklto
from the highground boat basin an to the project

10. Anticipated impacts
.The surface waters of Duck Creek off tne aNeu ctsenRiver have blynim-
classified by DEM as SC. There are, however, the inland waters
portant shellfish in the project area;
of Duck Creek more than likely provide habitat for anadromous fish,
particularly in the early spring and fall.
As proposed, the dredging will, on an average, remove only 2' ofttthe8'
bottom profile, adjusting the water depth from approximately 6
on NWL. A review of the known archeological sites indicates the pre-
sence of a submerged boat near the project channel. It can be anti-
cipated that the applicant will work with all the various agencies
desig-
to conduct the project in a manner that will least imp
nated resources.
