Dear Mr. Jolly and Mr. Wilms: 1he Pamlico-Tar River Foundation is a private, nonprofit citizen group concerned with water quality and natural resources in the watershed of the Pamlico estuary and Tar River. Wetland protection is a high priority for our organization, and we review all permit applications within our watershed. The PTRF does not wish to put itself in the position of opposing plans of small private landowners. We are, however, concerned that in some cases alternatives to wetland destruction or alteration do not appear to be considered. It is in that regard that we write to comment on W. Keith Tankard's application to fill a wetland on Back Creek , in Bath, Beaufort County, N.C. Referring to the map on sheet 2 of the public notice, it appears that the proposed home could easily be constructed on the site without filling the wetlands. This could be accomplished by reorienting the structure, relocating further back on the lot, or a combination of the two. Relocating the proposed home further back on the lot seems a logical approach. The diagram indicates that the fr~nt of the house is only about 30 feet from the creek edge. A setback of 75 feet would reduce potential impacts of nonpoint source pollution from the site, provide a buffer from future shoreline erosion, and eliminate the need for wetland fill. It would also, incidentally, eliminate Mr. Tankard's need to obtain a major development permit from the N.C. Division of Coastal Management. The wash where the wetland now exists appears to be the site of persistent erosion problems. Has the applicant considered the problems associated with locating a structure in such an unstable geomorphological feature? There is also a major concern for the fate of any fill emplaced at the site--it appears as though it might well end up in Back Creek in a short time. If the plans were carried out as submitted, extensive engineering might have to be incorporated into the site plan to avoid problems for water quality (the existing wetland filter would be eliminated) and the stability of the proposed house. ~ f' ~ Page 2 ~ You are undoubtedly aware of Bath's historical significance. Important prehistoric archeological sites are also found in and near Bath. The wash existing on the property may well serve as a sink for archeologically significant material transported with eroded sediment from nearby uplands~ It is therefore important that an archeological survey be conducted before any permit is granted. , Based on information now available to us, we must recommend denial of SAWC086-N-007-0188 and associated Clean Water Act certification. Back Creek is a scenic water body ~hich supports an important fishery. However, its hydrodynamic characteristics make it extremely vulnerable to nonpoint source pollutant loading. Back Creek has in recent years seen enormous development pressures and a marked decline in water quality. Given these trends, creekside development must be designed to mitigate potential damage to the water resource, including wetlands. It appears that this permit can be denied without causing any significant hardship to the applicant. Given the federal policy to protect wetlands and the environmental and archeological sensitivity of this site, such a denial seems appropriate. Thank you for the opportunity to comment. Plans submitted with the application show the proposed placement of fill material into an approximately 36-foot-widet 66-foot-Iong wetland drain off Back Creek. The drain has silted in ~omewhat from upland runoff over an extended period of time and is pres~ntly vegetated primarily by sedges (Carex sp.). The applicant proposes to f[ll the wetland drain to an average elevation of 2.8 feet above the existingt natural contours. The purpose of the proposed work is to provide a site for the applicant's proposed home. Plans showing the work are included with this public notice. I I I ,The State of North Carolina will review this public notice to determine thelneed for the applicant to obtain any required State authorization. No Dep~rtment of the Army permit will be issued until the coordinated State vi~oint on the proposal has been received and reviewed by this agencYt nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. " i The District Engineer has consulted the latest published version of the ~ational Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion thereint and this worksite is not registered property or property listed as being eligible ,.for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeologicalt scientifict prehistoricalt or historical data may be lost or destroyed by work under the requested permit. .~,.,:".,..,'~,,"\" ~~, ,,}~ -2- The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after May 6, 1986. The area that is being proposed to fill is approximately 2300 sq. ft. In talking to Keith and his father, Thad Tankard, Jr., I mentioned to them the possibility of maybe mitigating this loss of wetlands at a 2:1 ratio with the Corp of Engineers. They were receptive to this and are willing to do whatever it takes so Keith can build his home on this property. Keith has lived in this area all of his life and has always wanted ,to build his home on Back Creek. This lot is a. gift from his grandmother, In my meetings with him he has impressed me with his desire not to hurt water quality in Back Creek.
