Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will not extend waterward more than two feet from the existing old bulkhead at the time of construction. (2) All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. (3) All fill material 'to be placed below normal water level will be confined behind the permitted bulkhead. (4) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. NOTE: Future development on the permittee's property may require a modification to this permit. Contact a representative of the Division of Coastal Manage- ment for this determination prior to commencement of any such activities. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. SULLINS BIO REPORT PAGE 2 SITE DESCRIPTION: FAST TRACK The applicant's property is located in Dare County in Colington Harbour Subdivision, Lot 5, Section E, on Barkentine Inlet, a man made canal off the Albemarle Sound. The lot is undeveloped, with native lawn grasses and no marsh species present on the lot. The lot is approximately three feet above MHW and is 2500 square feet in size. There is an existing delapidated asbestos bulkhead, which has 2 eroded pockets behind it. The applicant proposes to construct a new bulkhead approximately two feet waterward of the old existing bulkhead. This will result..in the filling of the two eroded pockets, which are a maximum of 9' tvterward of the existing bulkhead and an average of 4'. axc % ANTICIPATED IMPACTS: The proposed project will result in approximately 26 cubic yards of fill, with 4.2 of these being below NWL. The project as proposed will result in increased levels of turbidity, however, these should be localized and short termed.
