THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Mr. H.A. Strickland pursuant
to an application filed on the 12th day of September, 1986 to construct
a?dam for a farm pond.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of a tributary
to Virginia Creek in conjunction with the proposed farm pond in Pender
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That appropriate sedimentation and erosion control
measures must be employed to minimize siltaticn
and turbidity impacts from the project.
3. There shall be a 30-foot vegetated undisturbed
buffer maintained around the pond so as to minimize
effects of surface runoff from fields.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Dear Mr. Strickland:
On May 16, 1986, Mr. Ken Jolly of my staff and Mr. Robert
Stroud, North Carolina Division of Coastal Management, met with
you concerning your proposed construction of a new impoundment and
excavation in an existing impoundment on your property on an
unnamed tributary to Virginia Creek near Holly Ridge, Pender
County, North Carolina.
Your proposed excavation in the upper limits of the existing
impoundment onsite will not require Federal permits provided all
excavated material is placed and retained on high ground landward
of the flagged pool elevation limits. However, your creation of a
new impoundment will require Department of the Army permit
authorization.
A Department of the Army permit, pursuant to Section 404 of
the Clean Water Act, must be obtained prior to the placement of
any excavated or fill material in wetlands. Before submitting an
application to us for this Federal authorization, you must apply
for and obtain a Section 401, Clean Water Act, Water Quality
Certification from the North Carolina Department of Natural
,Resources and Community Development, Division of Environmental
Management. A copy of your State Water Quality Certification must
be submitted with your application for Federal authorization.

between FEDERAL PAPER BOARD COMPANY, INC., a New York corporation
with one of its places of business in Columbus County, North
Carolina, Party of the First Part, and STRICKLAND ENTERPRISE,
INC., a North Carolina corporation, Party of the Second Part.
WITNESSETH:
THAT the said Party of the First Part, for and in
consideration of the sum of ONE HUNDRED DOLLARS ($100.00) and
other valuable considerations to it in hand paid by the said
Party ,of the Second Part, the receipt whereof is hereby
acknowledged has given, granted, bargained and conveyed, and by

BEGINNING at an iron pipe, said iron pipe being located
North 64 degres 15 minutes East 10.30 chains, South 64
degrees 00 minutes East 6.67 chains and South 66
degrees 00 minutes East 2.56 chains from an 18 inch
reinforced' concrete culvert, said culvert being under
U.S. Highway NO-17 leading from Wilmington to
Jacksonville, N.C., and also being 2.07 miles Northeast
of Woodside, North Carolina, and running from said iron
pipe, the beginning corner, South 66 degrees 00 minutes
East 28.59 chains to an iron pipe in the run of Black
Swamp; thence down the run of Black Swamp approximately
10 chains to an iron pipe, a corner of the Winslow

Batson land; the last mentioned iron pipe being located
South 32 degrees 00 minutes West 4.12 chains, South 43
degrees 00 minutes East 1.36 chains and South 15
degrees 55 minutes East 3.82 chains from the preceding
pipe; and running thence from the iron pipe in Black
Swamp along the Winslow Batson line South 86 degrees 20
minutes West 20.29 chains to an iron pipe; thence North
14 degrees 40 minutes West 23.13 chains to the
beginning, containing 33.4 acres, more or less and
being a portion of the tract conveyed by Roy L. Batson
to Riegel Woodlands Corporation.
TO HAVE AND TO HOLD the above granted and described
premises, together with all and singular, the rights, privileges,
easements and tenements and appurtenances thereunto belonging, or
