Dear Mr. Stallings:

Reference your application for a Department of the Army ~ermit
to construct a pier and to construct and backfill a bulkhead on
Currituck Sound, Church's Island, Currituck County, North
Carolina.

Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Additionally, to ensure that known archaeological
resources are not disturbed, the following conditions will also
apply: ,.

a. The deadmen used to stabilize the bulkhead will be
positioned waterward of the existing bank. No excavation landward
of the face of the bank is authorized.

b. All fill material, to be placed landward of the permitted
bulkhead will be obtained from an upland source outside of the
boundaries of the Waterlily Site Complex District. The bank
landward of the bulkhead will not be graded or otherwise
disturbed.

Implementing these additional conditions prevent the work from
impinging upon the significant cultural resources that have been
identified by the North Carolina Department of Cultural Resources.
Failure to comply with the State authorization, the conditions of
the general permit or the above stated conditions could result in
a violation of Federal law.

If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on I~,? / g /;, , is subject to compliance with the application (where consistent
witbthe permit), all applicable' regulations, special conditions and-notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.

(1 ) The bul khead wi 11 not extend waterward more than 5 feet from the normal
water level at any point along its alignment at the time of construction.

(2) All backfi 11 materi a 1 wi 11 be obtai ned from a hi gh ground source and confi ned
behind the permitted bulkhead.

(3) The fill material will be clean and free of any pollutants, except in trac~e_;;
quantities. Metal products, organic materials, or unsightly debris wi"
, not be used.

(4) The activity wi 11 be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.

(5) The permittee will maintain the authorized work in good condition and in
conformance with. the terms and conditions of this permit. The permittee
is not.~ '~lieved' of this requirement if he abandons the permitted activity
without transferring it to a third party.

or . other ~ified persons within twenty (20) days of the
isSuin!.date.: An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on.site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.

On February 6t 1986t we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which prov~des Federal authorization for
construction activities that receive authorization from th~ State
of North Carolina.

A review of your application received June 2t 1986, for a ·
Department of the Army permit to construct a pier and bulkhead
with backfill on Currituck Soundt Church's Island, Currituck
County, North Carolina, indicates it to be a candidate fQr Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be a~complished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.

If your application must be withdrawn from this gefteral permit
process for any reasont you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Enclosed is the application of Mr. John W. Stallings, Jr., for
a Department of the Army permit and a State Water Quality
Certification to construct a pier and construct and backfill a
bulkhead on Currituck Sound, Churchs Island, Currituck Sound,
North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.

We are considering authorization of the proposeQ activity
pursuant to Section 404 of the Clean Water Act, and we,. have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the-certification has
been obtained or waived.

PROJECT DESCRIPTION

The applicant owns a lot on the waterward side of S.R. 1142 on Church's Island
in Currituck County. The property ranges from 3 feet above normal water on the
southern border to 15 feet on the northern border. The shoreline has experienced
some erosion and a steep high bank continues to crumble and fall into the water
exposing some layers of shell midden. No marsh exist along the shoreline. The
property to the north is not bulkheaded and the property to the south is bulkheaded
with a rather unusual alignment. The adjacent property owner to the south has given
the applicant permission to apply for a bulkhead alignment on both properties to
obtain a relatively straight ali9nment.

The applicant proposes to construct a bulkhead along the 192 foot long shoreline.
The applicant reports that this alignment will average of 4-5 feet waterward of the
normal water contour but my calculations indicate 10 feet. The alignment proposed
would range from 4 feet to 30 feet waterward of the normal water level and would
straighten the bulkhead along the shoreline. This alignment is proposed to provide
strength for both bulkheads and remove Sharp angles which are exposed to wind generated
wave action from the northeast. The alignment on the north side is necessary to
obtain working room adjacent to the high escarpment.

Also proposed is a pier 40 feet long by 6 feet wide with a 8 X 20 foot "T" head.

ANTICIPATED IMPACTS

The bulkhead construction will result in the filling of 1920 square feet of
shallow water habitat of Currituck Sound. Some short term turbidity can be expected
as a result of the construction activities. The project should be reviewed for
potential impacts to cultural resources.

CAMA REVIEW

The project site is classified as rural in the Currituck County LUP. The
proposal is consistent with that plan.
