Upon review of your request for Water Quality
Certification to place fill material in wetland areas
adjacent to White Oak Creek and its tributaries, we have
determined that the proposed fill can be covered by General
Water Quality Certification No. 2176 issued November 4,
1987. A copy of the General Certification is attached.
This Certification may be used in qualifying for coverage
under Corps of Engineers' Nationwide Permit No. 26.

Water Quality Certification
Dear Mr. Mills:
As per your telephone discussion of May 12, 1988 with Rod Cummins of Bechtel,
we are requesting that you confirm that the proposed Nabisco bakery in Garner,
North Carolina is covered by the N.C. State General Water Quality Certification
Program. It is our understanding that you will issue a letter stating that the
Nabisco bakery is eligible for the State General Program and allowing us to
proceed with the project.
As you are aware, we plan to fill less than one acre of wetlands located above
the headwaters of White Oak Creek and were authorized by the U.S. Army Corps of
Engineers under the Nationwide Permit Program. The details for the fill area
are shown on the Wetlands Roadway Crossing drawing 440-AL-10 which was
previously provided to you.
If you have any questions please contact Rod Cummins at (415) 768-7254. Your
assistance and cooperation in issuing the State General Water Quality
Certification will allow Nabisco to maintain the project schedule.

Dear Mr. Teiser:
Thank you for your inquiry of April 18, 1988, regarding plans
to fill less than 1 acre of wetlands located above the headwaters
of White Oak Creek, at I-40 and U.S. 70, at the Nabisco project
outside of Garner, Wake County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330,
published in the Federal Register on November 13, 1986, lists
nationwide permits. Authorization was provided for discharges of
dredged or fill material into non-tidal rivers, streams, and their
lakes and impoundments, including adjacent wetlands, that are
located above the headwaters and other non-tidal waters of the
United States, including adjacent wetlands, that are not a part of
a surface tributary system to interstate waters or navigable
waters of the United States.
Your work is authorized by nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions.
Please be aware that this authorization does not relieve you of
the responsibility to obtain any required State or local approval,
including a Section 401 Water Quality Certification from the North
Carolina Division of Environmental Management. You should contact
Mr. William Mills, telephone (919) 733-5083, concerning this
required certification.

This letter is intended to keep you informed of the development of the
engineering basis for the Nabisco Greenfield Project relative to wetlands
on the site, which is located northeast of the intersection of Inter-
state 40 and U.S. Highway 70. The project's site design includes the
construction of an access road and a parking area which will require
discharge of fill into a portion of the wetlands area verified by the
Corps of Engineers. Generally, the site layout has been designed to
minimize fill and other disturbance (e.g., clearing) of the wetlands
onsite, as shown on the enclosed site plan.

We understand that you will issue a nationwide permit based on this letter
appliction because of the size of the project, although we propose fill of
less than one acre in size. Because the Nabisco project will involve fill
of a maximum of 0.419 acre of wetlands, it is our understanding that the
project need only inform your office of the site development planned. We
would appreciate confirmation that construction of the project, as
designed, can proceed. In order to maintain our schedule, we would
appreciate your response within 30 days. If you have any questions,

On March 7, 1988, and March 14,1988, you and Martin Freeman of
Nabisco met with Ms. Kathy Trott of my staff at the Nabisco site
located at I-40 and State Road 70 outside Garner, Wake County,
North Carolina. The purpose of this meeting was to inspect the
property for the presence of waters or wetlands subject to
Department of the Army authority.
At a meeting in the the Raleigh Field Office on March 25,
1988, you provided Ms. Trott with a survey dated March 17, 1988,
representing the wetlands flagged and verified at the previous two
meetings. The survey accurately depicts the wetlands onsite and a
Department of the Army permit will be required for the discharge
of excavated or fill material into these wetlands.
The property is located above the headwaters of an unnamed
tributary to White Oak Creek. The proposed fill activity may
qualify for a nationwide permit, provided the best management
practices conditions are met. Authorization was provided for
discharges of dredged or fill material into non-tidal rivers,
streams, and their lakes and impoundments, including adjacent
wetlands, that are located above the headwaters and other non-
tidal waters of the United States, including adjacent wetlands,
that are not a part of a surface tributary system to interstate
waters or navigable waters of the United States.
