Upon review of your request for Water Quality
Certification to place fill in waters and/or wetlands in
Torrence Creek, we have determined that the proposed fill
can be covered by General Water Quality Certification No.
2177 issued November 4, 1987. A copy of the General
Certification-is-attached. This Certification may be used
in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 14.

Dear Mr. Fisher:
On February 10, 1988, you and Mr. Ray Kluth met with Mr. Hugh
Heine of my staff regarding your plans to develop property off
Torrence Creek near Huntersville, in Mecklenburg County, North
Carolina.
In order to gain access from Gilead Road to the high ground, a
fill roadway is to be constructed across an unnamed stream,
Torrence Creek, and its adjacent flood plain. This flood plain
has been used over the years as pasture for an existing farm.
Both streams appeared to have been maintained over the years and
are at least 6 to 8 feet below the ground elevation. The Corps'
regulatory jurisdiction does not include the pasture found within
the flood plain.
However, before any fill material is placed within the unnamed
stream or Torrence Creek, the required Federal permit must be
obtained. As indicated, this work would be eligible for
nationwide permit No. 14. Once the roadway alignment has been
determined, please provide us with a copy of the drawing so that
we may issue this nationwide permit.
