Dear Mr. Baker:
Upon review of your request for Water Quality
Certification to place fill material in a tributary to
Corapeake Sound, we have determined that the proposed fill
can be covered by General Water Quality Certification No.
2176 issued November 4, 1987. A copy of the General
Certification is attached. This Certification may be used
in qualifying for coverage under Corps of Engineers`
Nationwide Permit No. 26.

bullet). Can I clean this out so there is a ,zood flow of water after rains?
When I pircha.sed the property, a gwx group of people had been using the
property as an ohsta.cle course for "aIP1'" vehicles (3 wheel Honda's and
Motorcvcles), and quite frankly, thev made a tremendous mess. Can I
attempt to repair_ the damage? This would require moving- dirt back in holes,
mavbe adding a whellharrow of dirt here and there, and planting trees and
shrubberv to close off the manv`trails.,

Dear Mr. Baker:
Reference your February 24, 1988, meeting with Mr. Jeff Richter of my
staff at your property adjacent a tributary of Corapeake Swamp, near Jones'
Millpond, off S.R. 1332, in Corapeake, Gates County, North Carolina.
During this meeting you informed Mr. Richter of your plans to place fill
material to facilitate construction of a house and driveway. Mr. Richter
determined that most of the area which you planned to fill is wetlands subject
to our regulatory jurisdiction pursuant to Section 404 of the Clean Water Act.
But, from review of USGS maps he has determined that the average annual flow
in the tributary at the crossing of S.R. 1332 is less than five cubic feet per
second; and therefore, your proposed work can be authorized by nationwide
permit.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330, published in the Federal Register
on November 13, 1986, lists nationwide permits. Authorization was provided
for discharges of dredged or fill material into non-tidal rivers, streams, and
their lakes and impoundments, including adjacent wetlands, that are located
above the headwaters and other non-tidal waters of the United States,
including adjacent wetlands, that are not a part of a surface tributary system
to interstate waters or navigable waters of the United States.
Your work is authorized by nationwide permit provided it is accomplished
in strict accordance with the enclosed conditions. Please be aware that this
authorization does not relieve you of the responsibility to obtain any
required State or local approval.
